Is MACC’s year-late condolence over Teoh Beng Hock’s death genuine?

Today Malaysians remember and mourn the unexpected and mysterious death of DAP political aide Teoh Beng Hock a year ago at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam after volunteering to co-operate with MACC investigations.
In an unusual move on Teoh Beng Hock’s first-year death anniversary, the MACC commissioner Datuk Abu Kassim Mohamad issued a short three-paragraph statement, which said:
“I represent myself and all members of MACC. We share the same sadness and disappointment with Teoh’s family over what happened on July 16, 2009.
“Although a year has passed since the unfortunate incident, we still feel the pain and sadness. As a father and an elder in the family, I can deeply feel the unbearable pain of losing a family member.”
Saying that the MACC will abide by the decision of the inquest, he said MACC will not compromise or shield anyone who is involved in the case.

KUALA LUMPUR, July 15 — In a move to placate Teoh Beng Hock’s family ahead of his one-year death anniversary tomorrow, Malaysian Anti-Corruption Commission (MACC) chief commissioner Datuk Seri Abu Kassim Mohamed pledged today not to “cover up” the actions of anyone who maybe found involved in causing the DAP political aide’s death.
“The MACC will not compromise or cover up the actions of any culprit or anyone found potentially involved in the death of Teoh Beng Hock,” the nation’s top graft fighter said today in a brief statement addressed to the Teohs.
The statement was issued only in Chinese.
The 30-year-old political secretary to Selangor state councillor Ean Yong Hian Wah was found dead last year on a 5th-floor corridor at Plaza Masalam in Shah Alam, nine floors below the MACC’s Selangor headquarters.

Teoh Beng Hock’s family today urged Prime Minister Najib Razak to give Thai pathologist Dr Pornthip Rojanasunand the necessary guarantees to enable her to testify in the inquest which is probing the cause of death of the political aide.
At a press conference at the Parliament lobby today, Beng Hock’s sister Lee Lan read a prepared statement on behalf the family, expressing their sadness over news that Pornthip would not be testifying.
“We don’t want the inquest to end with a question mark,” she said.
Lee Lan added that Pornthip’s presence at the inquest was vital because the prominent Thai pathologist was their best hope in unearthing the truth behind Beng Hock’s death.
“We hope that Pornthip can help us to find out the truth. But all of a sudden… she was not able to come to testify. Everything is now back to square one. How can we not be disappointed?” Read the rest of this entry »
DAP wants emergency Cabinet meeting on Dr. Pornthip’s claims

KUALA LUMPUR, April 12 — The DAP has demanded that the Cabinet convenes an emergency meeting to discuss Thai pathologist Dr. Pornthip Rojanasunand’s claims of “political pressure” which had forced her to pull out from testifying in the on-going Teoh Beng Hock inquest.
DAP advisor Lim Kit Siang said Dr. Pornthip’s claims of external pressure from Putrajaya that “could affect her work” in Thailand was a serious matter, which needed to be addressed immediately.
“The Cabinet should convene an emergency meeting to send a message that Dr. Pornthip be allowed to come and testify..to ensure her safety and well-being here and no pressure (from any parties),” said Lim at a press conference attended by Teoh family lawyer Gobind Singh Deo.
He also slammed Minister in Prime Minister’s department Datuk Seri Nazri Abdul Aziz for accusing Dr. Pornthip of lying about allegations of political pressure, and stressed that Nazri should withdraw his statements and apologize.

The Minister in the Prime Minister’s Department, Datuk Seri Nazri Aziz should make a ministerial statement in Parliament tomorrow on the scandalous and outrageous development in the Teoh Beng Hock inquest with the renowned Thai pathologist Dr. Pornthip Rojanasunand “pressured” not to come to Malaysia to testify.
In an exclusive interview with Malaysiakini, Pornthip said she would not appear for the Teoh Beng Hock inquest when it resumes on April 20 citing “political pressure” from the Malaysian government.
Pornthip told Malaysiakini that she was “advised” by high-ranking officials from the Thai Justice Ministry – where she is director-general of the ministry’s Central Institute of Forensic Science – not to go to Malaysia next week for the inquest.
She said the Justice Ministry had received information from the Thai Foreign Ministry that she may face problems should she go, including the possibility of being stopped from entering the country.
According to her, the Thai Foreign Ministry had received “signals” from the Malaysian government through “informal channels” suggesting that her presence at the inquest later this month would not be welcomed. Read the rest of this entry »
MACC will not have a year to redeem itself as its public image may plunge to an even lower depth next few days

In an interview with Sin Chew Daily yesterday, the new Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Datuk Abu Kassim Mohammed was refreshingly frank when he admitted that the mysterious death of DAP aide Teoh Beng Hock at the MACC Headquarters at Shah Alam on July 16 last year had caused the MACC image and credibility to fall to the lowest point ever but he hoped to lead the commission out of the bottom and restore public confidence and acceptance.
This is a far cry from his predecessor, Datuk Seri Ahmad Said Hamdan who could be so insensitive as to publicly declare: “Teoh Beng Hock’s case is nothing. It is a very small case” – a height of folly and irresponsibility which cut short his brief but ignominious tenure as the first MACC Chief Commissioner.
Abu Kassim has asked for a year to reverse the bad impression the MACC has made on the public so that he could convince Malaysians that the new anti-corruption body is “independent, transparent and professional”.
MACC will not have a year to redeem itself as its public image may plunge to an even lower depth in a matter of days if rumours on the grapevine are proven right that Selangor Mentri Besar Tan Sri Khalid Ibrahim would be arrested and charged for alleged “cow and car” corruption.

Police plan to pin sedition charge against Pornthip

THE POLICE AND MACC HAVE A HIDDEN AGENDA BY LEVELLING CHARGES OF SEDITION AGAINST LIM GUAN ENG AND THAI PATHOLOGIST PORNTHIP
If the Suara Keadilan report were read carefully, it is quite clear that the ‘leaked sources’ need not be from Pornthip, but could be from anyone who was connected to the autopsy room at the time the second post mortem was conducted.
The leaked source could be from MACC or the police who are usually privy to the information from the autopsy room.
The wild accusation that Pornthip was responsible for the leaks might backfire on the police and or MACC who have their own agenda, which is to attach blame on the pathologist Pornthip engaged by the opposition to get to the truth of the death of Teoh Beng Hock.
Pathologist Pornthip has a formidable reputation of world renown and would not resort to unethical behaviour. To implicate her for breach of ethics is foolish and ill advised.

Last week, Selangor Chief Police Officer Datuk Khalid Abu Bakar announced a second police report lodged by the police over the mysterious death of DAP political aide, Teoh Beng Hock at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16 last year.
Khalid said the police would be hauling up the Selangor DAP State Chairman and Selangor State Exco member Ean Yong Hian Wah under Section 506 of the Penal Code and the Communications and Multimedia Act 1998 for allegedly intimidating the police in “directing” the police to cease their investigation of Penang Chief Minister and DAP Secretary-General Lim Guan Eng for sedition.
Will Khalid direct the Selangor police to lodge a police report against himself, for Khalid had been guilty of the offence of publishing “false news” under the Printing Presses and Publications Act as Hian Wah never “directed” but merely urged the police to stop their baseless investigation of Guan Eng.

On Christmas Eve, the Selangor Police lodged a police report of sedition against DAP Secretary-General and Penang Chief Minister, Lim Guan Eng, for his speech at the Pakatan Rakyat national convention in Shah Alam on December 19 expressing national sentiments that the mysterious death of DAP aide Teoh Beng Hock at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam was a case of murder.
Three days later, the Selangor Chief Police Officer Datuk Khalid Abu Bakar alleged that the DAP Selangor Chairman and Selangor State Executive Councillor Ean Yong Hian Wah had “intimidated” the police in “directing” the police to stop their investigation of Guan Eng – when all that Ean Yong had done was to call on the police to stop their baseless investigation.
Yesterday, two MACC officers, Mohd Yusoff and Raub Ghani, lodged police reports against Suara Keadilan for an article in the Parti Keadilan Rakyat newspaper “which confirmed as murder the death of Teoh” as well as against Thai pathologist Dr. Pornthip Rojanasunan for “leaking” the information to unauthorised people the forensic report of the second post-mortem on Teoh on Nov. 22.
In the Top News of 2009 for the various media, Teoh Beng Hock invariably topped the list for his tragic death at the MACC headquarters last July.

Teoh Beng Hock’s body exhumed

The exhumation of DAP political aide Teoh Beng Hock at the Nirvana Memorial Park, Semenyih this morning has been carried out satisfactorily and the second autopsy will be carried out at the Sungai Buloh Hospital tomorrow.
Thai pathologist, Dr. Pornthip Rojanasunand, who was present at the exhumation, said Teoh’s body is still in good condition for the autopsy.
Teoh Beng Hock’s mysterious death at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16 has become a national and international cause célèbre and touchstone of the independence, credibility and professionalism of MACC.
Teoh’s death and the ensuing crisis of confidence in the MACC is undoubtedly one major reason for Malaysia’s worst ranking and score in 15 years in the recently-announced Transparency International Corruption Perception Index 2009, plunging 33 places from No. 23rd position in 1995 to No. 56th position in 2009 and a drop of .77 score from 5.28 in 1995 to 4.5 in 2009.

Malaysia’s losing battle for international competitiveness

What is the credibility of Najib talking about a total innovation of the Malaysian economy and nation when Malaysia is facing a losing battle in international competitiveness because of continuing loss of confidence in key national institutions whether judiciary, the civil service, the police, the MACC or the Election Commission?
This is the reason for the two recent adverse global rankings for Malaysia, falling three places from 21st to 24th ranking in the World Economic Forum (WEF)’s Global Competitiveness Report (GCR) 2009-2010 and a drop of two places in the World Bank’s Doing Business 2010: Reforming Through Difficult Times from 21st to 23rd placing.
The first seven months’ of Najib’s premiership have not seen any restoration of public confidence in the key national institutions but the reverse whether in the strategic areas to fight corruption and ensure integrity; keep crime low to protect the safety of citizens, tourists and investors; or to uphold the administration of justice.

I refer to the Malaysiakini report Ean Yong furious Teoh’s bank account revealed.
I’ve always wondered who it is that frequent five-star shopping malls like the Pavilion or browse in those posh bungalow boutiques. Now I know it’s not Teoh Beng Hock. He was a lot like me, an ordinary wage earner.
We learn from the MACC that Beng Hock had slim savings amounting to RM3,611.36. Counsel for MACC at the inquest, Abdul Razak Musa inferred this to support his contention that Beng Hock was in dire need of money to get married at short notice…to what purpose this insinuation by the authorities, I do not know.
But here is a case of Razak being unfamiliar with Chinese urban lifestyle. Of all the Chinese weddings I know of, every single one has made a profit from the reception dinner. The ‘ang pow’ collection, more often than not, generously exceeds the cost of the banquet. After paying the restaurant bill, the bride and groom hosts usually have change left over.

Why is the Malaysian Anti-Corruption Commission (MACC) wasting time trying to find out whether all the 42 MACC advisory panel members share adverse opinions about the MACC following the mysterious death of DAP political aide Teoh Beng Hock when it should be giving top priority to end gross abuses and malpractices to restore public confidence in it as Malaysia’s version of Hong Kong-style Independent Commission against Corruption (ICAC)?
It is reported by Malaysiakini today that emails had been sent out recently by the secretariat to 33 members of the MACC Advisory Panel following six “offending” media statements made by panel members Ramon Navaratnam and Robert Phang.
The MACC wanted the views of the other panel members as it felt that the views of the two “were not supportive of the establishment of the anti-corruption body and wanted to know the views of other panel members on the issue”.
MACC is now run by narrow-minded and bigoted people who equate criticisms of MACC failings as being anti-MACC.
Malaysiakini reported that not everyone has responded so far, and of the handful who did, not even one panel member has been critical of Navaratnam or Phang.
Panel members Simon Sipaun and Yong Poh Kon were mentioned in the Malaysiakini report as members who were “equally critical” in their response to the MACC.

The Cabinet meeting this Wednesday (5th August) is the greatest disappointment of all the 18 Cabinet meetings in the 124 days of Najib premiership because of its utter failure to address at least six urgent national issues ranging from crime, corruption, education, health to nation building.
The Cabinet has irresponsibly skirted grave and urgent national issues including:

Cabinet’s failure to heed nation-wide outrage at its refusal to establish a Royal Commission of Inquiry into the causes and circumstances of Teoh Beng Hock’s mysterious death at the Malaysian Anti-Corruption Commission (MACC) on July 16 instead of breaking up the process into two parts – an inquest into the causes of Teoh’s death and a Royal Commission of Inquiry (RCI) into MACC interrogation techniques.
The Prime Minister, Datuk Seri Najib Razak had said in Pekan on Tuesday that the Commission of Inquiry into the MACC’s interrogation methods would only begin its work after the inquest into Teoh’s death.
It is Najib’s ensuing statement that the RCI “will take into consideration the findings of the inquest” which has given Teoh’s family the false hope that if they are not satisfied with the inquest findings, Najib is prepared to consider their request for a Royal Commission of Inquiry into the causes and circumstances of Teoh’s death.
