    Provide full protection for Thai pathologist Dr Pornthip Rojanasunand, not by the police. Selangor State Government must engage private security to protect her at all time. Our police cannot be trusted and they will take orders from the top to finish her off, just like Altantuya, if there are any evidence that links TBH’s death to the macc.

    Ever since the inquiry started I hv been visiting sites with clips showing people jumping off great heights. My my. Believe me. There are loads of crazy people out there. There is one particular guy who was mad enough to jump of a three strorey building. He must be a stuntman by calling for he was able to roll nicely on the ground to soften the impact. I discovered one interesting point. If the falling person is enjoying the fall (I take this to mean he is not exactly scared) he has his body and legs all stretched out straight. Otherwise he would be screaming away and his legs would be retracted and held closer to his body. Very much like what beng hock appears to me to have done.

    macc will then claim that tbh had been sleep-walking, then sleep-climbing out of the window and finally sleep-jumping from the 14th floor before finally sleep-landing and sleep-dying as a result of his sleep-activities. Possibly also sleep-peeing in the toilet before that. So it is all due to sleep-killing and macc is not involved.

    When I was detained under the ISA during the quarrel between Anwar and Dr Mahathir, the police instructed me to take off all my clothes in order for them to observe my buttock for about 15 minutes. Those maniac law enforcement officers perhaps were keen to try practicing sodomy on someone so that they would take chance to torture whoever had been detained by them.

    Dr Pornthip’s conclusion (that there is an 80 percent probability that Teoh’s death was homicide and 20 percent chance of it being suicide) has vast implications if one believes her that it was probably homicide!

    She said TBH suffered several injuries before the fall : ‘manual strangulation’ penetration in the anal region, an abrasion on the thigh….

    This showed 3rd degree torture methods.

    It suggests the possibility that he was ‘tortured’ for purposes of extracting certain confession.

    This could lead to 2 consequences: either after such torture, (1) he still wouldn’t cooperate/confess or (2) he would.

    Penetration in the anal region, an abrasion on the thigh could be attributed to torture methods to extract confession….but how does one explain strangle bruises on the neck (ie manual strangulation) to kill him??? Even in the case of (1) (ie refusal to cooperate”) there’s no reason for his torturers to deliberately kill him by strangulation!

    The key question is why strangle him to death and who has motive and stand to benefit from doing so?

    2 possibilities may be speculated (a) strangulation was part of “torture”, he succumbed to it, his torturers panicked and threw him out of the window to exonerate the “accidental” killing OR (b) assuming that (2) above holds (ie. he would, due to torture, agree cooperate and confess, then some “outside” party whom he implicated in the confession would have the motive to extinguish his life so that he would not be a ‘live witness’.

    That party will not be the authorities. Dead, he is of no use to authorities because he could not be a witness and confirm contents of his “confession” in the witness box. Which will defeat the whole purpose of extracting confession from him, even if by torture methods, in the first place, to implicate PR assemblymen in corruption charges.

    It also suggests, if indeed an outsider was involved, that some renegade within MACC building let the outsider in to do the job without official knowledge….

    Either of the theories (a) or (b), authorities will carry heavy onus to shrug off responsibility as death occurred within their precincts, and insufficient protection was accorded to TBH.

    If one believes that (a) was the case (accidental killing during interrogation), one must believe that “strangulation” is usual part of 3rd degree torture methods. If so its the first I hear of it. The other thing is, if it were accidental death due to torture methods, then time of death should be during or at end of interrogation ie 3.30 am (when the accident happened). If one believes that interrogation ended at about 3.30 am in the morning how does it explain deceased was seen hanging around the pantry at 6 am with death estimated at after 8 in the morning? Why did he hang around MACC after interrogation ended? (Speculation again) could he be he was waiting for some report/confession to be prepared for his signature before he would be released, consistent with theory (b)?

    If for any reason (b) were the case, then the implications will spread wider than MACC. For it will be asked who is the “outsider” and how could TBH be in the position to implicate by confession the outsider?

    I have expected the findings by the Thai Dr. She is one great lady who acted without fear and favor. Real sad case our Bolehland does not have the expertise or investigators who have no balls and integrity and have to get opinion from Thailand. What a disgrace and shame to those so called local experts involved in this case.
    Now the findings are out, I am damn sure the government, MACC, PDRM, judges, holier than thou religious bums etc..will come out to discredit her at all cost. She MUST BE given protection irrespective.
    I admire her for what she have done so far.

    I hope that Dr Porntip’s testimony will bring some vindication of what the Teo family and his wife have known all along about Teo, that he has no reason to commit suicide. However, no matter how guilty MACC is, we all know that they will get away scott free with the blessings of UMNO and the corrupted judiciary as in the many cases before this e.g. Altantuya, Kugan. We can only hope for God’s justice to fall upon those in UMNO and MACC who were responsible for this heinous crime on Teo, and the grief they have brought upon his family and wife. Dr Porntip’s testimony is also a shining example of Malaysia’s growing lack of competence in advanced skills and technology as a result of years of abuse of our education system and policies by UMNO.

    I don’t think they strangled him to death but they repeatedly strangled him to NEAR death to try to force a confession.
    The final torture deemed beyond bodily repair was the penetration of a large object into TBH’s anus that they had to finsih him off by throwing him out of the window to fake a suicide.
    These MACC officers are nothing but barbaric wild beasts not fit for such an honorable job to fight corruption. MACC should be suspended as it does not have the trust of people!!!!!!!!!
    Mr.Teoh Beng Hock commands our absolute repects for standing up for righteouness & stand he did against evil brutes even till death. He is undoubtly a rare Malaysian HERO. I salute him!

    She made her assessment based only on autopsy reports of our local experts, the photographs of TBH’s injuries, and from snapshots taken at the site where his body was found
    Pity Dr Porntip was not allowed to carry out an autopsy on TBH
    What did her stunning testimony say about our local experts: Dr Khairul Aznam Ibrahim and Dr Prashant Naresh Samberkar?
    Did the two experts not see what Dr Porntip saw?
    Did the two experts choose not to see what Dr Porntip saw?
    Who is professionally competent n who is not?
    If our expert forensic pathologists were totally incompetent, what’s the legal implications on all previous cases assessed by them?
    Can reopen all previous cases ah?
    If our expert forensic pathologists were totally incompetent, what did they teach our medical students n interns?
    Need to send our local experts to undergo reeducation by Dr Porntip or not ah?

    Non stop professional opinions…pointing foul platy is so clear….but if you trace all records that are against the government or against their chosen ones…protecting a large group of people with one fall guy…maybe applied again.
    Look at the murder case of the Mongolian..and tell me…you agree that policeman C4ed her…for his own pleasure.
    If we suspect that case is a big cover up…Teoh’s death will have same results.
    After all….what have not seen.
    Under oath…Mahathir can lie 14 times in 30 minutes…now the hero of UMNO again…do you all really expect UMNO will be fair to Teoh’s family?
    To do that…so many MACC heads will roll.
    What about police force?
    Teoh means nothing to UMNO….but is forced to look serious…for so many votes depend on UMNO fairness. It is a side show…that have no end.

    Dr. Porntip must have told herself that it was a 100% homicide, but she allowed others to speculate.

    It was the first evening TBH was asked to appear before MACC as witness. How would outsiders know that TBH needed to be silenced? The whole episode was conducted by MACC, and since TBH had nothing to hide, he was confident not to bow to pressure. MACC officers think all along that they were God besides UMNO, and they would not accept any resistance. The pressure built up to the point that they got so enraged that they decided to kill TBH. They knew that perfect crimes are only possible without transparency. The government apparatus can find no wrong with UMNO-led government agencies. Remember Kugan, and in this case, the high 14-floor provided an excellent way to create doubts and hide their crime. Falling from high ground can be easily blamed for suicide, since Anwar was said to have inflicted himself to show black eyes to the world. Surprisingly, the inquest had been on for sometime, and Malaysian experts’ opinion was towards suicide. The experts in Malaysia could not even determine whether it was the leg or the head that landed first. They did not even mention that hard object was used in place of sodomy, and that happened while TBH was in custody.

    It was a big cover up, and MACC officials knew that they have total protection. It was bully and it did not proceed in stages. There was no panic, and suicide had all along been the way to explain away custody-death.

    The inquest will soon declare that Dr. Porntip has no Malaysian qualifications and so her opinion is well just an opinion.

    With Beng Hock’s car key, room keys, wallet, note book computer being kept by the MACC and the IO who was given the power to take Beng Hock under custody and who was also given the power to release Beng Hock (if so instructed by his immediate superior), it was too easy to understand that why Beng Hock still had to hang around in the MACC office while the IO was still sleeping at home between 3:00 am and 8:00 am before his death.

    Don’t you know that racist prejudice might be an adequate motive and the agony and the ecstasy and high experience a maniac could get from strangling someone whom the maniac hated would be the benefits from doing so?

    For a maniac who suffered from long term sexual depression because of frequent despise by his wife due to his suffering from sexual impotence, strangling a youthful man to death due to jealousy of a young man’s sexual potential might also give the maniac some kinds of sensual pleasure of the agony and the ecstasy.

    My speculation is based on my previous personal experience with the Police Custody under the ISA.

    I was also put under the police custody as an eyewitness at the initial stage because the Police suspected that I could help them to identify certain big fishes during the interrogation. However, even when I was detained as an eyewitness, all my movable personal belongings had to be surrendered to the officer who was in charge of the Police Lockup or who was in charge of the ISA detention camp.

    Since there was still no confirmation on whether to detain Beng Hock for more than 24 hours, the IO would be the officer who had the power to decide whether to release Beng Hock or not. When the officer who was in charge of taking care of Beng Hock’s personal belongings was still absent during his rest hours, Beng Hock certainly had to wait for this officer before he could take back all his personal belongings. This is just a common sense which most ex detainees could confirm about the accuracy of the detaining procedure!

    So in other words interrogation was over (at 3.30 am) and he was there waiting for hours for his belongings, and then to be released.

    As I said if, assuming it was accidental death from torture, time of death should be during interrogation. Why would any one in rank and file of MACC deliberately want to strangle him hours after interrogation ended – whilst he was waiting for return of his possessions – at after 8 am in morning (estimated time of death from forensics) when he could be an important witness to implicate DAP assemblymen for corruption or, taking the other view, he being an aide to a opposition politician, and a homicide on him will surely cause a big hullabaloo and demands for investigation? Which officer in MACC would want to do a thing like that and for what reason or purpose serving either MACC or powers-that-be’s interest? Can you figure it out other speculate that the perpetrator was a sex maniac? This puzzles me.

    That would only be plausible if TBH was giving evidence on a case the scale of PKFZ, and the ‘insiders’ are on theregular payroll. How much can RM 2,400 buy? That amount can’t even move somebody to carry out street fight, let alone commit a murder. it takes mondy to kill, and RM 2,400 is far too little.

    D Pornthip’s expert opinion gives credence to what we had secretly feared in our hearts. Whilst the expert had cautioned that it is only an 80:20 possibility that TBH’s death was a homicide, the public sort of know that it is 120% certain. Kugan’s case, and perhaps scores of others, buttresses and cements our fears in tombstones left unspoken and unvisited.

    Dr PORNTHIP NOW NEEDS POLICE PROTECTION – Thai police, I mean. One Mongolian came and our immigration records show she disappeared from the radar and then got c-4-ed in our belukar jungle. One Mongolian is bad enuf; we don’t want to add other nationalities to our infamy. So Dr. Pornthip, trhanks & godspeed. Please finish the exhumation and autopsy before returning to BKK.

    Thanks again. TBH won’t RIP till this case is settled.

    It is more likely that TBH’s interrogators did not intend to strangle him to death. They did it to terrify him into submission and then cooperate with them to fabricate a story to frame-up certain PR leader/leaders for corruption offences. They tried all forms of torture on TBH and seeing that they could not break TBH’s resolve, they dragged a half-dead Teoh threatening to throw him down the building.

    The unfortunate death of Teoh Beng Hock is an accompaniment of somebody’s instruction to the MACC to initiate the investigation of Pakatan assembly persons and to extract a confession so that a number of Selangor Pakatan assembly persons would be arrested, threatened and made to horsetrade their freedom similar to what was done to the 2 Perak assemblymen.

    MACC was given a tight schedule to complete this job before the return of Najib from overseas. This would be a present for him to savour the downfall of the Selangor state government.

    MACC job was made easier by two Pakatan members, i.e. Wee Choo Keong and Azmin Ali who made the allegations that certain Pakatan assembly persons were involved in underground criminal activities. Immediately, the AG gave the instruction for the Selangor state government to be investigated without even waiting for a police report to be lodged by Wee Choo Keong and Azmin Ali.

    The MACC immediately sprang into action under the direction of the MACC in Putrajaya. One of the unfortunate persons to be investigated was Teoh Beng Hock who was tortured in order to get a confession. … And the rest is history…

    If you’re looking for the truth of who killed TBH, the foregone conclusion is that 99.999% it will never be known.

    The inquest, which is to find out ‘whodunnit’, has to proceed on facts investigated by police. However the police have not investigated it with open mind that it could be suicide or homicide. Instead according to 9th witness Government DNA expert Dr Seah Lay Hong, instructions from police investigators did not include the possibility of Teoh Beng Hock being murdered and that angle had not been specifically considered in her analyses operating within the framework of “suicide” only. Govt forensic psychiatrist Dr Prashant Samberkar postulated suicide theory but conceded under cross examination that it was important to know the psychological state of the deceased to determine suicide (which he didn’t know). Now suddenly to fill in the psychiatric angle, they’re calling in Hiew Kim Boon, Kajang municipal councillor Tan Boon Wah and DAP MP Teresa Kok’s assistant Mandy Hui to be interviewed by psychiatrists in order to determine the state of mind of Teoh Beng Hock prior to his death.

    The suicide theory also reposes on TBH’s climbing on the ledge and jumping off but there’s no forensic evidence of his finger prints on the dusty window or ledge to show that he climbed it. The fact that TBH’s belt had irregular tear in his belt (consistent with someone holding on to it to fling him out of the window) and DNA profiles of at least two unidentified men in TBH’s jacket and trousers also contradict the suicide theory. And now a callous investigation into TBH’s finances – just to show that financial pressure in meeting weding costs could drive him to suicide – show that investigation has, right from beginning being skewed to prove suicide than to ascertain the unvarnished truth of how and whodunnit! So what chance is there that the Inquest could ascertain the truth when it only has from the forensic investigations of govt forensic experts selective facts to buttress the theory of suicide presented in evidence before it by people whose livelihood depend on being in good books of the powers-that-be?

    Selangor state govt gets a neutral Thai Forensic expert (Dr Pornthip) to give her findings of 80% homicide possibility. NST already put her on first page under byline “Bombshell in Court”.

    I don’t know “bomshell” is a reference to her testimony of 80% homicide or her wearing a tight top, long black skirt and boots, and sporting funky red and light brown streaks in her hair to the Inquest!

    The govt’s acceding to request of Royal Commission of Inquiry (RCI) is based on Inquest findings being unsatisfactory. If the findings were “suicide”, then there is no RCI. And even if there were RCI, it is probably addressing MACC’s investigative techniques and procedures, not necessarily related how he dies or who caused it within Inquest’s purview. RCI on V.K. Lingam video clip already established authenticity of the tapes – the conversations were heard and events corroborated them – yet today they have decided no action would be taken against VK Lingam or even former chief justice holidaying with him in New Zealand. It is reported that no evidence is found to prove abuse of power in judicial appointments. There’s no evidence because there’s no active investigation of these issues, and today VK Lingam is still counsel acting for Tun Dr Mahathir Mohamad successful bid to strike out the appeal filed by Datuk Seri Anwar Ibrahim in a RM100 million defamation suit against TDM for calling him a homosexual.

    So how hopeful are we that the RCI could in context of TBH’s case get us anywhere (if the Inquest were not in position to find out the truth?)

    A lot of good men and salt of the earth will not be prepared to fight the system – unless a Raja Petra Kamaruddin’s exceptional type.

    Even armed with truth and justice, one generally can’t fight the system and win when the level playing field is tilted all around against him by a solid monolithic system with money and power dedicated to its own self preservation.

    I believe Tan only asked it to save MACC asking the same questions, but without the benefit of a direct answer from Porntip.

    If one sees a person die with a gun shot wound in the head, one says it is murder, and other would claim suicide. To the expert, there is a way to tell whether it is murder or suicide. TBH was dead on the floor, and the question asked is whether he walked to his death, a suicide, or was he thrown out of the window dead or alive.

    Pathologist knows the cause of death, such as the force of impact when the body met the ground. Porntip was able to tell that there were injuries which could not happen during the fall, and certainly not after the fall. So torture was carried out, and hard object was inserted into TBH anus. That might have caused him to become unconscious, and the rascals who did that thought that TBH was dead. Throwing TBH over the window and pretended that he committed suicide was the solution for them.

    Two government pathologists should have ruled out suicide, based on the wounds inflicted on TBH which could only happened before he was thrown out of the window. But they did not address them. Did they not see those wounds, and have they any explanation. The two should be examined to see if they are indeed qualified as they claimed to have based on paper qualification.

    After having been tortured, TBH was too weak to commit suicide by jumping, even if he had wished to. Why should there be a need to check on TBH financial situation and to have psychologists interview family members of TBH who were not at the scene of murder, the -MACC building. If it most obnoxious of the authority trying to imply that TBH committed suicide, and out now on fishing mission to pin suicide as a cause of TBH death. What about the wounds inflicted on him before his demise, thrown over by Porntip’s 80% prediction over 20% for MACC to justify other means through which the body, unconscious at that time, went through the window. The 20% allows man from Mars to be involved also.

    Tan was mindful to ask Porntip the direct question. Did he ever ask questions regarding the need to check on TBH’s account, and also the interview of psychologist talking to TBH family? On probability computation, given that the psychologist come out with a cent per cent argument that TBH tended to commit suicide, it was only 20% chance since he had no opportunity to do so.

    You must realize that the political strength of Pakatan Rakyat lies in the ordinary men of the street together with the continuing educational and propaganda effort contributed by the conscientious intellectuals.

    In the past, Barisan Nasional component parties were able to get a landslide victory during the General Election easily because of their practicing the Grace Politics, where a small piece of agricultural land would be given to the needies in the rural areas whenever the date of election came near at hand. However, the political situation had already changed due to the fast depletion of aerable lands in Peninsular Malaysia. The lack of available state lands which can be given away to the needies, together with the greedy practice of kidnapping big pieces of aerable lands by the rich and influential through the practice of corruption within the Office of Menteri Besars and the land offices, have already impaired the effective functioning of the system of Grace Politics. When Umnoputras have no longer been able to create the political miracle by way of practicing Grace Politics, that will give a good opportunity for an opposition party like Pakatan Rakyat to win in the General Election.

    The only obstacle which is too obvious for Pakatan Rakyat leaders to reach out to the commoners in the rural areas is that most PR leaders speak with high technical or academic tones, which many laymen will not be able to comprehend! Therefore, Pakatan Rakyat will stand a good chance to win if its national leaders can lower their standards a bit by choosing to visit the villagers much more frequently and try to speak to the villagers with the language which they can easily understand.

    Of course, Pakatan Rakyat will have not much difficulty to win over an English-speaking person like me when its leaders keep talking something that really makes sense!

Could it be that someone on top of torturing beng hock for all sorts of information (real or fabricated), they were also trying to create some sodomy injuries (see they learned their lesson from saiful – the sodomy victim with no physical signs of sodomy) so that they can to mount sodomy charges against a certain unfortunate pakatan chap.

    Jeffrey, do you know why the villagers from my village keep casting votes in favour of the Umnoputra candidate, even though the candidate who is a minister keeps giving empty promise?

    The villagers cast votes for the Umnoputra because the Umnoputra will offer free buffet lunch whenever he came visit the village. The villagers feel that they are being loved by the politician because the politician comes visit them! The reason looks too simple but it is also real and practical — getting a free lunch and a warm handshake are better than getting none!

    Section 332 of the Penal Code – Voluntarily causing hurt to deter public servant from his duty.

    But Magistrate said “even a video recording submitted by the defence showed he had resisted arrest. Although the video recording did not show the biting, I believe it did as the policeman had testified that he had punched the accused and Chua had retaliated by biting.” – Source Malaysiakini report

    This is then a case of policeman (Constable Rosyaidi) punching Tian Chua first and Chua had “retaliated” by biting (in magistrate’s words).

    Now police have the right to use reasonable force if one resists arrest. He can for example physically wrestle your arm to hand cuff you.

    However, does reasonable force include punching Chua??? Is it discharging public duty to punch? Who is voluntarily causing hurt?

    Doesn’t a party like Tian Chua, attacked in this way by force (punch) likely to cause bodily harm, have right to self defence by biting to avert further punches?

    Tian chua was facing a criminal charge wasnt he? And wasnt it the position in law that evidential ambiguity in the prosecution’s case would be treated as a doubt in the charge against him?

    Jeffrey,
    If Tian Chua is a Malay, then only he will be given the right to self-defence. Otherwise, he has no right to self-defence. This is the law interpretation in the System of Ketuanan Melayu, which means practicing of institutionalised racist prejudice is permississble by the Umnoputras but is not permissible but others who are non-Umnoputras.

    Jeffrey,
    If Tian Chua is a Malay, then the police was not using reasonable force when he punched Tian Chua. If Tian Chua is a non-Malay, then the police was discharging his public duty lawfully when he punched Tian Chua. The police was even permitted to kill Tian Chua like killing Kugan if he wanted to do so. This is the institutionalised racist prejudice permissible by the system of Ketuanan Melayu!

    Whatever institutionalised racism there is (generally) in policies and even attitudes of law enforcement agencies, I don’t think that in a multi racial country we should just so readily (in frustration and anger) attribute and interpret any abuse of power along racial lines without clear proof of the specific circumstances and persons under review. (This kind of atribution aggravates the racial divide, don’t you think so?)

    For example, the abuses alleged to be commited by MACC when interrogating : it is easy to say TBH was treated such because he was non-Malay when for all we know it could happen to even a Malay.

    We tend to selectively forget, for example, the other allegation by UMNO Maran Division Committee Member Halimi Kamaruzzaman that he was roughed up and forced to strip by MACC officers in a politically-motivated investigation targeting another UMNO politician Norza Zakaria.

    It seems to me that if true, the overzealousness of doing everything outside the book to implicate a target could be more influenced by desire to ingratiate the boss by getting the politically desired result than motivated by the race of the victim mistreated. Anwar Ibrahim himself was roughed up in custody by no less a person than the then IGP!

    Ok. I for now will stop launching attack on the institutionalised racism and will focus more on the unfair Machiavellian practices of bi-partisan politics by the Umnoputras.

    The Umnoputras should be responsible for all kinds and all forms of human rights encroachment upon the rightful citizens of Malaysia. The police who punched Tian Chua should be charged in court for abuse of excessive force in carrying out the official duty!

    MACC should be held responsible for causing death to Teoh Beng Hock, whether directly or indirectly, due to negligence in providing adequate protection to him during his being put under the official custody of the MACC! The MACC should be taken to court and be ordered by court to pay monetary compensation in form of liquidated damages and punitive compensation to the heir apparent of Teoh Beng Hock!

    The policeman and Tian Chua chose to settle their personal scores through physical contest. Charge both of them for disturbing public peace. It would not amount to six months or RM 2,000 calculated to deprive Tian Chia of his MP position. UMNO is keen for a buy-election having won a landslide win in Bagan Pinang.

    It might be put in a different way. it is easier, or of a higher probability for the non-Malays to be treated in that manner than would a Malay. That is the problem with institutionalised discrimination. The non-Malays are considered guilty first, to be proven innocent, and the Malays, innocent until found guilty. Yes, party affiliation is another filter, after having settled the prior racial classification.

    Perhaps you are still not aware that ex IGP Tan Sri Rahim Noor had been sentenced to 2 months’ jail by the court for his assaulting Anwar Ibrahim in Bukit Aman underground Police Lockup.

    You should be holding the opinion that there is still hope for a change to be carried out by Pakatan Rakyat in Malaysia so that you choose to come here to contribute your comment. If you have already lost the hope in the possibility of bringing change to Malaysia, then I won’t believe that you will continue to contribute your comment again.

    If it is already proven that Malaysia’s democracy system never works at all, perhaps many other Malaysians will have long since chosen to take the path along the path that had been tried out by Chin Peng at the earlier days of his life, or just to take the path that had been followed through by Nordin Mat Top. If you still have faith in Malaysia, then please work hard to ask your friends and relatives to cast votes for Pakatan Rakyat in the next General Election.

    i saw ong, chua and liow in the hospital yesterday. all of them has an injury caused by 3by5 cm hard object inserted into their @sshole.

    There are no known sciences that give out such probabilities known to man where one can posthumously indicate without the body the victims mental condition.

    I think she is talking ‘channeling’ or praying throught Datuks fromn Tokongs for her telepathic indulgences with spirits for her ‘scientific results’.

    Suicide is the consequence of a mental state of mind resulting in a decision to take one’s life and is not the function of the body.

    Pornthip fails to indicate how she came to the consclusion of 80% murder and 20% suicide.

    Now heres the rub. In protecting herself (perhaps unintentionally) for her nonsense she has injected into the equation the element of doubt that would be the tool for any half baked lawyer (and Malaysia’s lawyers are about 99% half baked) to have any charges against whoever it is that is to be accused thrown out of court.

    In the criminal code, the element of doubt is necessary to secure a discharge or acquittal of the charges proffered against an accused. She has now provided it in her statements.

    I am afraid you are wrong particularly on the second sentence. She is world renown in her field.

    She concluded that TBH was unconscious on impact against the ground because there were no injuries reported which were expected when a conscious person fall onto the ground. She had examined hundreds of cases of people falling from height, and the statement must be from experience. I think if you know her field, you should question her on her conclusion regarding specific explanation. The two government pathologists were asked only to confirm that it was a suicide. They have chosen to ignore facts and clues which pointed otherwise.

    Porntip, the Thai expert will conduct an autopsy with the agreement of the late TBH’s family. A simple case has become complicated with the passage of time. She will be able to solve the mystery whether the authority in Malaysia accepts it or not, 99% of outside world will. The number refers to the percentage of the number of countries where a majority of the pathologists would accept her conclusion. The 1% is for Malaysia.

    The preponderence of Pornthip’s assessment is 80% homicide based on forensics (strangulation in neck, brises on thighs & injury at anus) and generally what Loh observed above.

    When grKumar says, “suicide is the consequence of a mental state of mind resulting in a decision to take one’s life and is not the function of the body”, he should first question government forensic experts, how prior to determining TBH’s mentals take, they came to inference that it was suicide!

    Take for examples:

    · Govt forensic psychiatrist Dr Prashant Samberkar postulated suicide theory but conceded under cross examination that it was important to know the psychological state of the deceased to determine suicide (which he didn’t know); or

    · according to 9th witness Government DNA expert Dr Seah Lay Hong, instructions from police investigators did not include the possibility of Teoh Beng Hock being murdered and that angle had not been specifically considered in her analyses operating within the framework of “suicide” only’.

    Why doesn’t grkumar question the bias of government’s forensic psychiatrist DNA expert or police investigations concentrating on suicide theory without prior examination of TBH’s state of mind earlier?

    And to say that “Malaysia’s lawyers are about 99% half baked”, thats patronising, and I wonder what’s the basis he says that, whether he include government lawyers as well, and whats the relevance of this toan assessment of Pornthip’s findings discussed here.

    If our lawyers are 99% half baked I woonder whose lawyers are full baked – English, American, Singapore’s or Thai lawyers or what? Hah ha ha!
