Call on Nazri to make ministerial statement on why Pornthip “pressured” not to testify at TBH inquest


The Minister in the Prime Minister’s Department, Datuk Seri Nazri Aziz should make a ministerial statement in Parliament tomorrow on the scandalous and outrageous development in the Teoh Beng Hock inquest with the renowned Thai pathologist Dr. Pornthip Rojanasunand “pressured” not to come to Malaysia to testify.

In an exclusive interview with Malaysiakini, Pornthip said she would not appear for the Teoh Beng Hock inquest when it resumes on April 20 citing “political pressure” from the Malaysian government.

Pornthip told Malaysiakini that she was “advised” by high-ranking officials from the Thai Justice Ministry – where she is director-general of the ministry’s Central Institute of Forensic Science – not to go to Malaysia next week for the inquest.

She said the Justice Ministry had received information from the Thai Foreign Ministry that she may face problems should she go, including the possibility of being stopped from entering the country.

According to her, the Thai Foreign Ministry had received “signals” from the Malaysian government through “informal channels” suggesting that her presence at the inquest later this month would not be welcomed.

She said: “It was conveyed to me by certain senior Thai government officials that there has been political pressure from certain Malaysian government circles to block my presence in court, so much so that it might interfere with my current important forensic mission in southern Thailand.”

Pornthip, who is to testify on her findings of Teoh’s second post-mortem next Tuesday, said she was concerned that her involvement in the controversial inquest could impinge on her work in the three troubled southern Thailand provinces where thousands have died in a Muslim separatist insurgency.

Part of her on-going forensic work involved the need to go to Kelantan to investigate a case related to the killings in southern Thailand. According to Pornthip, she had tried to obtain permission to enter Kelantan in January this year but was denied entry to Malaysia on “a ‘signal’ from the authorities forbidding her from crossing the Thai-Malaysian border”.

With Porthip barred from the Teoh Beng Hock inquest, public confidence in the Barisan Nasional government and MACC would plunge to a new all-time low as the overwhelming majority of Malaysians do not believe that Teoh Beng Hock committed suicide by jumping off the 14th floor of the MACC headquarters in Shah Alam on July 16 last year.

Nazri should also arrange for his ministerial statement on Pornthip barred from testifying at the Teoh Beng Hock inquest to be fully debated in Parliament.

    The act of
    exerting political pressure on an impartial professional expert to influence her finding or to prevent her from doing her job to the utmost honesty
    is implying that there is something to hide and almost like admission of the guilt by the party that caused to the application of such pressure.

    Pornthip Rosanasunand, the Thai pathologist, said that he had a problem getting into Kelantan in January this year. This indicates that the problem she faced had to do with her testimony to the TBH inquest when she declared she was 80% certain it was homicide. Ordinary Thai will not be in that special position facing problems coming into Malaysia.

    Immigration office at Kelantan was not manned by Kelanatan civil servants. The federal officers at that office must have been instructed by the BN Federal government to teach Pornthip a lesson. That lesson is very well learned indeed. Now to Pornthip she has to choose between doing her job for a large number of Thais or doing it for a Malaysian purely on professional ground. To Malaysians the truth of the cause of TBH’s death would determine the responsibility of the office which held him until his death. That would exert influence for bringing about reform at MACC, saving it from being a permanent tool of UMNO.

    BN government is aware that covering up the case will send a signal that MACC was responsible for TBH’s death. But the truth are not officially determined. So long as the TBH inquest did not have argument to counter what the two pathologists who could not even detect the injury around TBH’s neck said, It was suicide for TBH. An injustice to the deceased and his family. ( Actually they could not be pathologist if they had missed it, but they had chosen to forgo their professional reputation in exchange for we know not what.)

    It seems that Obama would be seeking advice from Najib on the speedy disposal of court cases through using sworn statement in churches. Obama appreciates the fact that a statement in mosque could spare Malaysian governement the need to investigate homicide, and in the TBH inquest, consolidated views of government pathologists give finality to the inquest.

    Immigration is under Ministry of Home Affairs. Why don’t you also ask the proper Minister, Datuk Seri Hishammuddin Hussein to check with Director of Immigation if there were such a thing as alleged by Pornthip?

    Why don’t you ask HH for a public assurance and undertaking to ensure that nothing of the sort Pornthip alleged is true or should be feared, and that he would promise her and the Thai Govt a safe and unobstrusive passage to her not only for her case related to TBH’s Inquest but also the other case in Kelantan related to the killings in southern Thailand?

    Pornthip is a great woman who acted professionally irrespective. The way our BN ban her from coming here to testify shows that the government is afraid the truth on TBH murder will come out. Imagine the panic and fear it will create on those murderers either from the BN politicians and MACC goons.
    Why does the government so so afraid of her??. That Nazri bum got the cheek to say she is a liar. As a matter of fact, it was he himself is a big fat liar. I mean, what has she got to gain from these and moreover she doesnt even know TBH in the first place????.
    This might well prove that TBH was brutally murdered by those who were politically scare of him as a rising star. May all of these murderers go to hell soon.

    Apart from confirming that there is foul play, this development is dragging Malaysia down to the gutter level as fas as international reputation is concerned.

    Intimidating witness? Pressuring witness? That is denial of justice and interference of justice process. Plain and simple. Any blind man can see that.

    In addition, is this not an abusive use of the diplomatic channels?

    Najib administration has badly managed the TBH thingy. It would have been reasonable to consider the political costs to make those who are really at fault to be brought to justice – save some public relation expense as well – he need not repeat the message that he is a fair and great PM who wants to show result. There is a simple resolution to this issue and for whatever reason, there is no leadership exhited in settling this issue.

    Now it is too late. Hulu Selangor voters, please do us a favour. Please do Mrs Teoh and junior Teoh a favour

    Though Pornthip would not be bothered by statement made by person she does not consider important, but for those who care about and believe in her professional intergrity, Nazri should be made to be responsible for what he said. PR should set up a fund to facilitate Pornthip taking up the case against Nazri. Just tell us the account number to contribute.

    It is now 100% certain that Teoh Beng Hock’s death was a homicide case.

    I believe the government and MACC knew the cause of Teoh Beng Hock’ death, otherwise they would not have blocked Pornthip’s entry to Malaysia.

    Malaysiakini reported today that Nazri is alleged to have said “Dr.Pornthip lied at the coroner’s inquest!!”

    This is scurillous, sub-judice, an attempt to pervert the course of justice, bringing our courts into disrepute and insulting the judge. It can also be deemed to be an attempt to intimidate Dr. Pornthip.

    It is disgraceful conduct by a Minister in the UMNo/BN Govt.

    I think Pakatan/DAP should make a police report and haul Nazri up for contempt charges before the judge at TBH’s death inquest!!

    the ex-Romania Ambassador to Singapore killed a Malaysian /Singapore PR with his car and gone to great lengh to lie about it. he stated that he is willing to compensate but not attend the inquest after fleeing back to his home country

    SIngapore conducted an inquest and found the fler lied on every count. The inquest found him guilty and now requested the Romanian government to assist in getting justice back.

    If Malaysian can get justice from Singapore government, but looking at what Malaysians’ own government do to one of their own…shocking, absolutely shocking

    Neither asking Nazri to make ministerial statement in Parliament nor Gobind Deo’s challenge “to offer himself as a witness at the inquest to prove his allegation (The MalaysianInsider, April12) is likely to help matters and advance TBH’s cause because (basically) one can’t take the matter forward by arguing with someone who totally denies there is such a thing in the first instance but who sees it as his ministerial duty to side the govt on all issues, whatever their merits/demerits like for eg the other Allah issue where he said that although he was personally not racist and had no beef on use of the word by East Malaysian Christians he would nevertheless support Govt’s decision to appeal against Justice Lau bee Lan’s decision.

    This a very tricky ruse hatched to thwart the proper course of justice if Pornthip’s allegations were to be believed – there being, at the same time, no reason not to believe her just like there’s no reason to believe TBH would want to commit suicide at, of all places, MACC precincts, when he had every reason to live and rejoice being a father!

    I say “tricky” because, according to Pornthip, the pressure, according to Thai Foreign Ministry was in the form of “signals” from “informal channels” purtporting to speak on behalf of the Malaysian Govt , which also means if Putrajaya were to be confronted, it is likely going to officially deny there was such a thing. They would blame the Thai govt. “If she is unable to perform her investigation there, it is problem with the Thai government, not us,” added Nazri – Malaysiakini (April 11). They cannot afford NOT deny it. It constitutes thwarting course of justice, the Inquest is also a kind of court, and therefore to pressure witness not to come is tantamount to another species of contempt of court other than the type for which Matthias Chang was held liable for.

    The preferred course is to confront the Ministers directly in charge of Immigration – Home affairs’ Hishammuddin Hussein – that he should immediately give a public assurance and undertaking to Pornthip & Thai Govt that nothing of the sort Pornthip alleged will happen and that the Malaysian Govt. will promise her a safe and unobstrusive passage to her not only for her case related to TBH’s Inquest but also the other case in Kelantan related to the killings in southern Thailand. The argument is, if one alleges as Nazri does, that Pornthip lies, the best way to contradict that lie is to give such an assurance/undertaking, so that the excuse of Malaysian Govt. obstructing does not become credible in the face of such public assurance/undertaking to the contrary.

    This is the only way but then again it one cannot be sanguine that it will work. Or for that matter necessarily the video-conferencing of Pornthip’s testimony (as suggested by Selangor State govt) even if (assuming again) Inquest’s coroner were to agree to it. Its an assumption because Coroner may not agree to video-conferencing. For to do so is to indirectly admit Porntip’s allegations of pressure not to testify as true, which also means Coroner will face the pressure of looking for those “informal channels” to cite for contempt of Court!

    (Continuing) This is because Pornthip herself may not, on her own accord, want to testify (even by video-conferencing).

    This of course not sure I am only speculating the possibility and not certain as to fact… But why I say this is because the greatest point of pressure applied to Pornthip not to testify will invariably come directly from her own government. She has no choice, she is Thai, works in Thailand and depends on Thai Govt for regular jobs.

    If its just “signals” from “informal channels” purporting to represent Malaysian Govt, the problem is easier to resolve : just get Hishammuddin to give the public assuarnce/undertaking (that he cannot afford to refuse not giving) and then get Gobind to Thailand to personally escort Porntip across Immigration on this side!

    Here cleverly the powers-that-be use “informal channels”. Now these must be very credible “informal channels” to convince the Thai Govt that these have authority to represent the other government’s position or at least a powerful section of the Govt.

    Yet precisely because they are informal channels they permit our govt to officially deny such obstruction and act ignorant, and to even issue safe passage assurance to Porntip without it being taken by her!

    It gets complicated because they use government-to-government (“G-to-G”) relations as leverage.

    What can the Thai Govt do if this side tells it that we won’t help in the other side’s Muslim insurgence problems in Southern Thailand, won’t coorperate G-to-G in Thai’s hot-pursuits of insurgents/separatists when they across the border opver to this side and all other matters, whether economic cooperation or other matters, unless the Thai Govt reciprocates by applying pressure and persuasion on her own national (Porntip) not to testify, whether here or video-conferencing from the Thai side???

    This is very effective because to the Thai Government, Thailand’s national interest especially security interest, will take precedence and priority over the interest of justice for an individual (TBH) who, in any case, is another’s national. Likewise Pornthip. She cannot fight pressures directly exerted from her own government, indirectly likewise pressured by informal channels from this side of the border using G-to-G relations and cooperation as leverage!

    So much for ASEAN governments holding up human rights pursuant to Article 1(7) of ASEAN Charter! I mean if they can (for economic considerations) forsake and not stand up for an icon of democracy like Myanmar’s Aung San Suu Kyi, that the rest of the world have sympathy for her Cause, so much less will they stand up for Teoh Beng Hock.

    For TBH – and large sections of Malaysian Public seeking justice for his case – there can be no closure. They will speculate that complicity in TBH’s death go far beyond MACC and right up (relating to certain very powerful quarters going to all lengths to destabilise Selangor govt) for something like this to happen with help of all apparatuses of govt.

    Whether such a perception will translate to even more votes against in the next GE of course remains to be seen.

He has to act doubly stupid like umno if he is going to testify against porntip’s, which will hurt his professional image worldwide.

    What should she lie in the first place. No logic.

    We could not say NAzri is liar too, because any claim the government will say give me the documents that prove the claim, how can it be documents to proof such a claim.

    But people will believe in what Dr. Pornthip Rojanasunand’s say simply she is a person known for her integrity. And there is no reason that that she has to lie and there is no reason that we should not believe in what she has claim.

    Now what the government want to stop her if there is nothing to hide from TBH’s dead. It is not the best chance for MACC to clear its name after all. If there is true in what MACC claim that there was nothing to hide they should allowed her to come and assist MACC to clear its name, other wise this will enhanced people perception they are all liars and not Dr. Pornthip Rojanasunand

    Abhisit Government is vulnerable to pressure. It faces Thaksin’s red shirts in the Capital Bangkok seeking to topple his govt. It cannot afford another “front” in the South where Muslim insurgents demand separatism, and where insurgents strike at Thai forces and when chased cross the border to this side where they are provided safe havens to recoup for another strike back on the Thai side (to and fro). This is why Malaysian govt’s cooperation not to provide safe havens is a prime security consideration to the Thais…

    I am just completely amazed at how voters can seemingly continue to tolerate having this kind of leadership which is always working insidiously behind the scenes whilst the MSM continue to keep painting a hunky dory picture of the country,

    Nazri love to create sensational news….to make sure he gets elected in 13th GE…when most are rejected by voters…and become the leader of the opposition…talking cock and bull all the time.
    This maybe his short cut way to be a PM..in the next 8 years or so…hoping Malaysians will reject PR..and vote for UMNO BARU again.
