According to the de facto Minister, Takiyuddin Hassan yesterday, it would be a criminal offence under Emergency (Essential Powers) (No. 2) Ordinance 2021 for anyone to allege that the Prime Minister, Tan Sri Muhyiddin Yassin had an emergency declared because he had lost majority in Parliament and would be liable to be fined up to RM100,000, jailed up to three years or both.
Is this the law of the land although the issue has to be decided by the Courts and not by the de facto Law Minister.
In any event, in view of the statement by the de facto Law Minister, the Attorney-General Tan Sri Idris Harun should make his position clear, whether he would prosecute any person under the Emergency Ordinance for alleging that the proclamation of emergency was made because Muhyiddin had lost his majority in Parliament. The cat is out of the bag – to allege that the Prime Minister, Tan Sri Muhyiddin Yassin had an emergency declared because he has lost majority in Parliament is now a criminal offence under Emergency (Essential Powers) (No. 2) Ordinance 2021 and can be fined up to RM100,000, a jail term of up to three years or both.
This was admitted no less by the de facto Law Minister, Takiyuddin Hassan, who said at a joint press conference that claiming that the government sought an emergency declaration because it lost its majority in the Dewan Rakyat violates the fake news ordinance.

I welcome the statement by the Co-coordinating Minister for National Covid-19 Immunisation Programme Khairy Jamaluddin that he has spoken to inspector-general of police Abdul Hamid Bador on the issue of whistle-blowers who expose shortcomings in the ongoing vaccination exercise with regard to the emergency ordinance on fake news pertaining to Covid-19 and the emergency proclamation.
This raises seven important questions:
First, whether and when the Emergency (Essential Powers) (No. 2) Ordinance 2021 – which came into effect today and provides for a fine of up to RM100,000, a jail term of up to three years or both, for those who create, publish or distribute fake news – was presented to the Cabinet for approval? What is unusual and abnormal about the Prime Minister, Tan Sri Muhyiddin Yassin’s anniversary telecast is his failure to act on the Yang di Pertuan Agong’s advice that an emergency does not preclude the convening of Parliament.
On Feb. 25, the Yang di Pertuan Agong said the Parliament sitting can convene during the emergency.
This is enshrined in subparagraph 14(1)(b) of the Emergency (Essential Powers) Ordinance 2021 which states that Parliament should be called, prorogued and dissolved on a date as deemed appropriate by His Majesty on the advice of the prime minister. Read the rest of this entry »

Although the daily increase of Covid-19 infections have come down to four-digit two- thousand figures in the past five days, far from the peak figures of 5,728 and 5,723 figures on 30th and 29th January respectively, it is disturbing that Malaysia is one of the worst performing countries in bringing the Covid-19 pandemic under control in the past three months.
On Nov. 18, 2020, Malaysia was ranked No. 85 among countries in the world with the most cumulative total of Covid-18 cases.
We have now leapfrogged 40 places in the last three months as we are ranked No. 45 among the countries in the world with the most cumulative total of Covid-19 cases. Read the rest of this entry »

Malaysia urgently needs strong and effective action against hate speech and hate crimes which, if unchecked, could plunge Malaysia into greater disunity and polarisation resulting in a failed state.
Malaysia’s diversity must be regarded as an asset and not a liability – not just during the launching of national unity plans or blueprints but at all times so that Malaysia can benefit and leverage on our unique position as the confluence of diverse races, languages, religion, cultures and even civilisations. The Prime Minister, Tan Sri Muhyiddin Yassin should direct his Health Minister, Dr. Adham Baba to retract his Covid-19 quarantine rules to uphold the Prime Minister’s own pledge that there will be no double standards in Covid-19 quarantine SOPs.

On 1st December, 2020, I asked: “Will Malaysia overtake China with more cumulative total of Covid-19 cases before or after the end of the present Parliament meeting?”
Unfortunately, Malaysia overtook China before the end of the Parliament meeting on December 16, 2020, with Malaysia positioned as No. 79 with 87,913 cases while China was ranked No. 80 with 86,770 cases (worldometers.info), when China with 1.4 billion population has 40 times the population of Malaysia.
On December 1, Malaysia was ranked No. 83 in the world with 65,697 Covid-19 cases but we have deteriorated by leaps and bounds and today, we are ranked No. 61 with 158,434 Covid-19 cases and 601 fatalities. Read the rest of this entry »

Yesterday, I said that the five priorities which the Prime Minister, Tan Sri Muhyiddin Yassin listed in his New Year Message as the basis for an integrated national recovery strategy post-Covid do not stand up to public scrutiny by the first fortnight of the new year.
I referred to Priority Three “to ensure political stability with strong emphasis on good governance as a foundation for sustainable economic recovery” and Priority Four “to uphold the country’s sovereignty and strengthen Malaysia’s position on the world stage”.

In his New Year Message, the Prime Minister, Tan Sri Muhyiddin Yassin listed five priorities for the year 2021 in an integrated national recovery strategy post Covid-19.
But in less than two weeks, these five priorities cannot stand public scrutiny, in particular Priority Three to “ensure political stability with strong emphasis on good governance as a foundation for sustainable economic recovery” and Priority Four to “uphold the country’s sovereignty and strengthen Malaysia’s position on the world stage”. The differences and incongruities between the re-imposition of a full movement control order (MCO) on eight states and territories, namely Penang, Selangor, Malacca, Johor, Sabah, Kuala Lumpur Putrajaya and Labuan; conditional MCO on another six states namely Pahang, Perak, Negri Sembilan, Kedah,Terengganu and Kelantan and the continuation of recovery MCO on two states namely Perlis and Sarawak for two weeks from January 13-26 as announced by the Prime Minister, Tan Sri Muhyiddin Yassin yesterday and today’s proclamation of emergency until August 1 raises many questions.

UMNO, Bersatu and PAS have failed to form a stable government as the Malay Unity rhetoric has proved to be a false promise for Malaysia.
If I had made this statement, it would be taken as proof of the allegation that I am anti-Malay and anti-Islam, but this was stated by Datuk Seri Shafie Apdal, the President of Warisan and former Sabah Chief Minister, at the recent Regional Outlook Forum 2021, hosted by the ISEAS–Yusof Ishak Institute in Singapore last Thursday.

If the Minister of Science, Technology and Innovation, Khairy Jamaluddin is right that Malaysia is set to achieve herd immunity in 18 months against Covid-19 from February after the arrival of the first batch of the initial Covid-19 vaccine supply, we will only be out of the woods of the Covid-19 pandemic in July 2022.
Yet UMNO wants to have the 15th General Election by the end of the first quarter of 2021!

Is anyone surprised by the deafening silence of the government parties, in particular the trio of Bersatu, UMNO and PAS to the proposal of an all-party conference to save Malaysia from the two great problems of 2021 – the Covid-19 pandemic and corruption?
I am not surprised, for it is precisely because the Perikatan Nasional coalition government had failed in these two areas in 2020 that Malaysia is facing a crisis of losing control of the third wave of the Covid-19 pandemic, registering yesterday a record-high daily increase of 3,027 new Covid-19 cases with eight deaths, bringing the cumulative total of Covid-19 cases to 128,465 and Covid-19 fatalities to 521. The refusal of the Muhyiddin Cabinet to summon a Special Parliament to address Malaysia’s losing control of the third wave of Covid-19 pandemic is the height of irresponsibility of a kakistocracy.

The Prime Minister, Tan Sri Muhyiddin Yassin has survived the confidence test with the passage of the 2021 Budget, a most ordinary budget in extraordinary times created by the “one-in-a-century” Covid-19 pandemic, but he has not demonstrated that he was won the confidence of Members of Parliament, Malaysians and the world as illustrated by the Fitch Ratings downgrade on Malaysia’s sovereign credit rating, Malaysia’s overtaking of China today in total cumulative Covid-19 cases and the joint press conference by Tun Dr. Mahathir Mohamad and Tengku Razaleigh on Monday evening.
