Call for RCI to conduct full inquiry on whether Israeli agents had infiltrated Bukit Aman

DAP calls for the establishment of a Royal Commission of Inquiry comprising respected, eminent and independent-minded Malaysians to conduct a full inquiry on whether Israeli agents had infiltrated Bukit Aman.
It is downright ridiculous and an international joke to have four agencies probing into the same matter, as announced by the Home Minister, Datuk Seri Hishammuddin Hussein yesterday, namely the police, the Malaysian Anti-Corruption Commission, the National Security Council and a parliamentary select committee.
I just could not believe that Hishammuddin could make such an outrageous announcement, totally lacking in seriousness about a very important national security problem.
In the first place, who would believe that the police would be able to independently and professionally investigate into this matter, when there appears to be a tradition of lack of police independence and professionalism on sensitive issues involving the highest reaches of police and the government.
A good case in point was the 1998 “black-eyes” attack on Datuk Seri Anwar Ibrahim by the then Inspector-General of Police in the very inner sanctum of Bukit Aman, just some fortnight after losing his high positions as Deputy Prime Minister and Finance Minister. Read the rest of this entry »
Is Musa currying favour with the Prime Minister hoping to override Hishammuddin and get another year’s extension as IGP?

The Inspector-General Tan Sri Musa Hassan has acted with unusual alacrity when he announced in less than 24 hours that the police will investigate claims made by the independent Kulim-Bandar Baharu MP Zulkifli Noordin in Parliament on Wednesday that he was asked to implicate the Prime Minister Datuk Seri Najib Tun Razak and his wife Datin Seri Rosmah Mansor in the murder of Mongolian Altantuya Shaariibu.
This is in complete contrast with the foot-dragging and procrastination that top police leadership would indulge in when police reports are lodged against prominent government leaders from Umno and Barisan Nasional.
What is especially extraordinary with Musa’s high-speed response is that no police report had yet been lodged over Zulkifli’s allegation – a pre-condition always insisted on by the police before there could be any police investigation.
As MPs enjoy parliamentary privilege, they have immunity for what they say in Parliament, which bars not only prosecution but also being subject to police investigations for their parliamentary speeches – unless this is waived by the MP concerned or the MP repeated his allegation outside the precincts of Parliament as lodging a police report.

Challenge to Hishammuddin to have opinion poll on Home Ministry website whether the prominent media photo of him and IGP as best of pals are genuine or just “for show”
Home Minister, Datuk Seri Hishammuddin Hussein gave an immediate response to my press conference in Parliament yesterday, when I had commented on the photograph of him and the Inspector-General of Police Tan Sri Musa Hassan “making up” which was given prominent coverage in all the media as mere show.
I said the two must not take Malaysians as four or five-year-old children who are gullible and would believe the photo-shoot as proof that all was well between the Home Minister and the Inspector-General of Police, as if what happened over the past few days and their statements never existed!!
I called on Hishammuddin and Musa not to have any “cover up” and to address the real issues concerned.
Hishammuddin accused me of exploiting the “purported rift” between him and the Inspector-General of Police, even saying that it was “not easy” for the Home Minister and the Inspector-General of Police “to act out things”.
I challenge Hishammuddin to have an opinion poll on the Home Ministry website whether the media photo of him and IGP as best of pals are genuine or just “for show”.

Allow the Police to start on a new page on Police Day on 25th March
After a year of premiership, national and international confidence in the key national institutions and the system of governance in Malaysia have deepened instead of being improved.
Although there is a lot of talk about achievements in the NKRA for combating crime, in particular street crime, the fact is that as far as the man-in-the-street is concerned, they are still hounded by the endemic crime and the fear of crime.
The fact that there are more gated-and-guarded communities in the country in the past year is the best proof that all the talk about NKRA achievements in combating crime is no real meaning to the ordinary people.
A meaningful NKRA for combating crime is when the people feel safe and secure enough to dismantle the guarded and gated communities instead of the reverse – with more people feeling unsafe as having to build new guarded and gated communities.
The Prime Minister and the Home Minister must accept the reality that an essential element to have a new start in restoring public confidence in the efficiency, independence and professionalism of the police is to have a new Inspector-General of Police.

Hishammuddin denies demanding China Press editor’s resignation

KUALA LUMPUR, March 16 – Home Minister Datuk Seri Hishammuddin Tun Hussein today denied accusations by the Opposition that his ministry had threatened the China Press chief editor with suspension if the latter did not resign.
He said that the accusation, made by DAP adviser Lim Kit Siang in Parliament, was just the Opposition’s ploy to gain political mileage by sensationalising “common procedures”.
“No it is not true (the allegations). From what I know is that what happened with China Press was no different from the others (media publications) like Star and Al-Islam. What we did was merely to send them a show-cause letter and asked them for an explanation,” he said.
China Press was hauled up by the ministry after reporting on Saturday that Inspector-General of Police Tan Sri Musa Hassan had submitted his resignation letter to the Prime Minister and the Home Minister.
The IGP’s term of office expires in September.

Why is Hishammuddin breathing down the neck of the media threatening “all hell to break loose” when all that is needed is a correction for any incorrect report about resignation of Musa Hassan as IGP?
The Home Minister, Datuk Seri Hishammuddin Hussein is breathing fire and brimstone, threatening “all hell to break loose”, demanding an explanation from China Press for its report that the Inspector-General of Police Tan Sri Musa Hassan had tendered his resignation letter.
Warning China Press not to publish reports which are not true, Hishammuddin said he had instructed the Home Ministry secretary-general Datuk Seri Mahmood Adam to ask the newspaper editor to explain the report.
Why is Hishammuddin breathing down the neck of the media threatening “all hell to break loose” when all that is needed in the relevant case is a correction for any incorrect report about the resignation of Musa Hassan as IGP?
Is the stability and strength of security in the country and in particular the Malaysian police force so brittle and fragile that a report like that of China Press today could seriously compromised or jeopardized them?
In fact, Hishammuddin should know that if the China Press report is true that Musa has resigned as Inspector-General of Police, there would be joy and jubilation not only among loyal and patriotic Malaysians who have always put national interests above self, but also among top police officers as well as the rank-and-file.

Is Hishammuddin involving police in greater political harassment of PR leaders when he should be asking the police to single-mindedly fight crime to make Malaysia a safe country?
When DAP Penang State Assemblyman for Komtar, Ng Wei Aik, lodged a police report against the Second Finance Minister Datuk Husni Hanadzlah for uttering racially inflammatory remarks on Tuesday, there was an immediate response from the Federal CID director Datuk Seri Mohd Bakri Mohd Zinin who was in Penang at the time.
Bakri asked at a news conference: “Do you want the police to fight crime or investigate political matters?”
The answer is clear and unequivocal, the first task of the police is to fight crime and to ensure that Malaysians, investors and tourists feel safe from crime and are liberated from the fear of crime – two major failures of the Malaysian police in the past decade.
Despite the establishment of a Royal Police Commission and its recommendations in 2005 to create an efficient, incorruptible, professional world-class police service in Malaysia, crime index in the country has continued to mount until the sixth Prime Minister, Datuk Seri Najib Razak had to admit that it is one of the six priority challenges of his administration.
Despite all the publicity of KPI (key performance index) and NKRAs (National Key Result Areas) in fighting crime in the past year, the police has yet to break the back of the problem of high crime rate and prevalent fear of crime among Malaysians, tourists and investors – the very definition of an unsafe country!

KUALA LUMPUR, March 6 — Police put a stop to a dinner and ceramah organised by the Kepong DAP here tonight.
The function, which features star speakers from Pakatan Rakyat like Datuk Seri Anwar Ibrahim, Lim Kit Siang and Datuk Husam Musa, was called to an abrupt halt at 10pm when the police raided the premises.
About 1,500 people in attendance booed loudly when Sentul OCPD ACP Zakaria Pagan took to the stage and announced that the ceramah was cancelled.
He justified the action by pointing out that the function’s permit was only to organise a dinner and not a ceramah with political speeches.

Police find no element of sedition in their comments on Federal Court ruling

PUTRAJAYA: Police will not take any action against DAP adviser Lim Kit Siang and former Perak Menteri Besar Datuk Seri Mohammad Nizar Jamaluddin for criticising the Federal Court’s decision on the legitimacy of the dismissal of the Pakatan Rakyat State government in February last year and the installation of the Barisan
Nasional government.
A police report lodged against the two on Feb 11 by a retired Royal Malay Regiment officer in Kuala Muda, Kedah, had been transferred to Putrajaya for further action.
Putrajaya district police chief Supt Abdul Razak Abd Majid told The Malay Mail the decision was made after going through the report.
“No further action will be taken as we found no element of sedition as alleged in the report,” he said.
He said only one police report was lodged against the two Opposition leaders for their alleged statements reported in a Malay daily and several online news portals.

Hands off! Respect and uphold the University of Malaya Vice Chancellor Ghauth Jasmon’s decision on the moratorium and suspension of University of Malaya campus polls.
This is the message all Malaysians hoping to see the restoration of academic freedom and excellence in our public universities, particularly University of Malaya, want to send to the Higher Education Minister Datuk Khaled Nordin.
Khaled has already jumped into the campus fray by questioning the judgment of the University of Malaya Vice Chancellor in suspending the campus elections and his decision to resolve the campus poll controversy, viz:

appointment of an IT consultant by the pro-students group to test the e-voting system – a re-election to be held if it is proven that elements of fraud or abuse exist.

investigate allegations that deputy vice-chancellor of student affairs (HEP) Azarae Idris misused university funds to quarantine HEP sponsored candidates at a hotel, the night before nomination.
I call on Khaled to endorse the decision and judgment of Gauth Jasmon, taking into account legitimate complaints about the campus electoral process.

Home Minister Datuk Seri Hishammuddin Hussein should explain why he allowed police officers like the Selangor Police Chief Deputy Comm Khalid Abu Bakar to play politics with an eye to replace Tan Sri Musa Hassan as the next Inspector-General of Police instead of focusing on the core police function of conquering crime in Selangor.
The record and conduct of Khalid as a professional police officer suffered a grave dent when he was more interested in politicking, to the extent of publicly threatening to arrest Penang Chief Minister and DAP Secretary-General Lim Guan Eng on completely baseless grounds, instead of ensuring that the Selangor state is safe from criminals.
In Selangor, guarded and gated communities are mushrooming all over the state, the most potent indicator of the failure of the police to perform its core function to ensure that the people are safe and secure in the streets, public places and the privacy of their homes.
One important measure whether the police are making progress in turning the tide of endemic crime is whether the people are dismantling or erecting guarded/gated communities, where the people have to impose on themselves a new levy of “income tax” to protect themselves from crime which should have been the basic duty of the state through the police force.
Nobody will buy Khalid’s denial in today’s press that he had threatened to arrest Guan Eng for allegedly refusing to give his statement to the police over investigations that Guan Eng had made seditious remarks about the death of Teoh Beng Hock at the Pakatan Rakyat convention on Dec. 19. THE POLICE AND MACC HAVE A HIDDEN AGENDA BY LEVELLING CHARGES OF SEDITION AGAINST LIM GUAN ENG AND THAI PATHOLOGIST PORNTHIP
If the Suara Keadilan report were read carefully, it is quite clear that the ‘leaked sources’ need not be from Pornthip, but could be from anyone who was connected to the autopsy room at the time the second post mortem was conducted.
The leaked source could be from MACC or the police who are usually privy to the information from the autopsy room.
The wild accusation that Pornthip was responsible for the leaks might backfire on the police and or MACC who have their own agenda, which is to attach blame on the pathologist Pornthip engaged by the opposition to get to the truth of the death of Teoh Beng Hock.
Pathologist Pornthip has a formidable reputation of world renown and would not resort to unethical behaviour. To implicate her for breach of ethics is foolish and ill advised.

MACC police report against Dr. Pornthip – double test case for Selangor CPO Khalid and new MACC Chief Commissioner Abu Kassim

Last week, Selangor Chief Police Officer Datuk Khalid Abu Bakar announced a second police report lodged by the police over the mysterious death of DAP political aide, Teoh Beng Hock at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16 last year.
Khalid said the police would be hauling up the Selangor DAP State Chairman and Selangor State Exco member Ean Yong Hian Wah under Section 506 of the Penal Code and the Communications and Multimedia Act 1998 for allegedly intimidating the police in “directing” the police to cease their investigation of Penang Chief Minister and DAP Secretary-General Lim Guan Eng for sedition.
Will Khalid direct the Selangor police to lodge a police report against himself, for Khalid had been guilty of the offence of publishing “false news” under the Printing Presses and Publications Act as Hian Wah never “directed” but merely urged the police to stop their baseless investigation of Guan Eng.

On Christmas Eve, the Selangor Police lodged a police report of sedition against DAP Secretary-General and Penang Chief Minister, Lim Guan Eng, for his speech at the Pakatan Rakyat national convention in Shah Alam on December 19 expressing national sentiments that the mysterious death of DAP aide Teoh Beng Hock at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam was a case of murder.
Three days later, the Selangor Chief Police Officer Datuk Khalid Abu Bakar alleged that the DAP Selangor Chairman and Selangor State Executive Councillor Ean Yong Hian Wah had “intimidated” the police in “directing” the police to stop their investigation of Guan Eng – when all that Ean Yong had done was to call on the police to stop their baseless investigation.
Yesterday, two MACC officers, Mohd Yusoff and Raub Ghani, lodged police reports against Suara Keadilan for an article in the Parti Keadilan Rakyat newspaper “which confirmed as murder the death of Teoh” as well as against Thai pathologist Dr. Pornthip Rojanasunan for “leaking” the information to unauthorised people the forensic report of the second post-mortem on Teoh on Nov. 22.
In the Top News of 2009 for the various media, Teoh Beng Hock invariably topped the list for his tragic death at the MACC headquarters last July.

When did Malaysia’s police chiefs develop “egg-shell skull” paranoia
I had tweeted in Osaka yesterday:
“Police 2interrogate another DAP rep – Sel State Exco EanYongHianWah after Penang CM/DAP SG LimGuanEng. Sel CPO – what r u up to?”
In response, I got this snide remark from the Umno MP for Kota Belud, Rahman Dahlan in his retweet:
“Same old tactics LKS!”
This could mean many things but at present, I am only concerned about the Selangor Chief Police Officer, Datuk Khalid Abu Bakar, whom I had always thought as a solid and professional policeman, raising many questions.

Teoh Beng Hock would not have died if MACC had followed the law (update)

DAP political aide Teoh Beng Hock would not have died if the Malaysian Anti-Corruption Commission (MACC) had followed the law.
This is the immediate reaction not only of family members of Beng Hock, DAP and Pakatan Rakyat, but all Malaysians following the landmark decision by the Kuala Lumpur High Court today which ruled that the MACC is not entitled to interrogate witnesses late at night beyond normal office hours, from 8.30am to 5.30pm.
Justice Mohd Ariff Md Yusof ruled that it was illegal for the MACC to question its witnesses at night as such questioning must be done during the daytime.
“The term day to day as stipulated in the MACC Act cannot mean round the clock.”
This landmark decision is the result of the suit filed by Kajang Councillor Tan Boon Hwa who was falsely imprisoned together with Teoh Beng Hock on July 15 and 16 at the MACC headquarters in Shah Alam, with the case argued by DAP National Chairman and MP for Bukit Glugor Karpal Singh.

Doctrine of separation of powers – Kula’s emergency motion on police killing of five Indians should have been allowed

DAP MP for Ipoh Barat M Kulasegaran was unsuccessful in his attempt this morning to move Parliament for an emergency debate on the police killing of five Indians in a shoot-out in Klang on November 8 for being suspected gang members.
Deputy Speaker Datuk Wan Junaidi Tuanku Jaffar conceded that Kula’s motion met two of the three criteria of being definite and of public importance, but it was not “urgent” as police investigations were “ongoing”.
I stood up to support the protests by Kula and DAP MP for Teluk Intan, M. Manogaran for rejecting a debate on the motion and argued that “investigations under way” should not be used as an excuse to disallow a parliamentary debate as this will be against the doctrine of separation of powers.
“Ongoing police investigations” is an executive action, but under the doctrine of the separation of powers, it is the executive that must be answerable to Parliament and not Parliament having to kow-tow to the Executive.
The Malaysian public are concerned about police killing of people in police shoot-outs and this is a matter which should be debated in Parliament with the executive giving a full and satisfactory accounting as at stake are public confidence in the police as well as in Parliament. I was floored.
In response to my questioning on the deplorable crime situation when winding-up his Ministry in Parliament in the 2010 Budget debate, Home Minister Datuk Seri Hishammuddin Hussein said the Home Ministry official website poll of some 10,000 respondents on crime in Malaysia do not reflect the actual situation as the number of persons involved do not come to even .01 per cent of the Malaysian population of 27 million.
I told Hishammuddin that this was a most shameful answer and demonstrated that the government was in serious denial, raising grave questions about its commitment to end the endemic crime situation to restore a safe country where citizens, tourists and investors can feel safe and secure.
