Thanks goodness, it was not all news of infamy for Malaysia every day for the last week for the year 2021 – as there were also some good news and one came yesterday when the High Court in Kuala Lumpur ruled that the existence and establishment of vernacular schools and the use of Chinese and Tamil languages in schools are constitutional.
Judge Mohd Nazlan Mohd Ghazali ruled that vernacular schools are not a public authority and the use of a non-Malay medium of instruction for teaching in Chinese and Tamil vernacular schools is not for an official purpose and thus, did not infringe Article 152 (1) of the Federal Constitution. There have been many “national embarrassments” for Malaysia of late
With the global 1MDB scandal which had been described by the former US Attorney-General as “kleptocracy at its worst”; Malaysia among the worst performing nations in the two-year Covid-19 pandemic accumulating nearly 2.75 million Covid-19 cases and over 31,000 deaths; a former Prime Minister declared by the Court of Appeal as a “national embarrassment” during his premiership; catastrophic government mismanagement of last week’s massive floods in Selangor and Pahang causing loss of at least 48 lives and the absence of the Prime Minister at the annual Christmas high tea which totally demolished his “Keluarga Malaysia” slogan, one would have thought Malaysia had enough infamies for any nation.

The Minister in the Prime Minister’s Department (Parliament and Law) Wan Junaidi Tuanku Jaafar has said that Malaysia will support the United Nations Convention against Corruption (UNCAC) and has undertaken several efforts that prove its seriousness in the matter.
He said the commitment was proven through the efforts of the government to seize a part of the assets confiscated by the Malaysian Anti-Corruption Commission in the 1Malaysia Development Berhad (1MDB) scandal amounting to RM5 billion as well as the implementation of the National Anti-Corruption Plan (NACP) 2019-2023 through the National Centre for Governance, Integrity and Anti-Corruption Centre (GIACC). The answer by the Minister in the Prime Minister’s Department (Special Functions) Abdul Latiff Ahmad yesterday on the number of special advisers and special envoys of the Prime Minister, Ismail Sabri is both a shocker and an eye-opener.
The first question that comes to mind is why is the Prime Minister having so many special advisers and special envoys as he already has a jumbo-sized Cabinet of 31 Ministers and 38 deputy ministers and a full complement of High Commissioners and Ambassadors all over the world? I call on the Prime Minister Ismail Sabri to set up a Royal Commission of Inquiry into a July 2015 plot to arrest Prime Minister over the 1MDB scandal at a Cabinet meeting but was foiled a day earlier by the sacking of Deputy Prime Minister Muhyiddin Yassin and Attorney-General Gani Patail.
The story of this plot was told in a new book which will hit the bookshops next week – Najib’s former political communications adviser Romen Bose’s “Final Reckoning: An Insider’s View of the Fall of Malaysia’s Barisan Nasional Government”.

There is a deep sigh of national relief when it is known the Court of Appeal has unanimously rejected the appeal of former Prime Minister, Najib Razak against his conviction and sentence to 12 years’ jail and RM210 million fine for seven charges linked to the RM42 million of SRC International Sdn. Bhd. funds.
In delivering the ruling, Justice Abdul Karim Abdul Jalil said the Court of Appeal agreed with trial judge Mohd Nazlan Mohd Ghazali’s finding that Najib had personal interest for the cabinet to approve a government guarantee for a RM4 billion loan from Retirement Fund Inc to SRC International.

Former Prime Minister Najib Razak thought he has found a way to stop public discussion of two issues: the possibility of his return as the 10th Prime Minister of Malaysia in the 15th General Election and his brother Nazir’s proposal for a reset of national policies and institutions.
But he cannot be more wrong when he thought he could achieve these two objectives when he tried to caricature me as being too obsessed with him.
Firstly, let me declare that Najib personally is not important, but it is in the interests of all Malaysians who want a clean and honest government to ensure that he does not return as the 10th Prime Minister of Malaysia in the 15th General Election, for it would mean the return of the days when Malaysia was associated with “kleptocracy at its worst”. The light at the end of the Covid-19 pandemic tunnel is getting brighter but we must remain vigilant in view of the omnicron variant of Covid-19 virus – to adhere to mask wearing, to use good ventilation and to avoid close contact with too many people and to get vaccinated or get booster shots.
Yesterday, we recorded 4,087 daily new Covid-19 cases – the lowest in 197 days – the strongest indication that we can look forward to breaching the 4,000-line to go below 4,000 daily new Covid-19 cases after struggling for six weeks in the 4,500 – 6,500 cases region for daily new cases, and even to return to pre-Emergency days of January 11, 2021 when we had 2,232 daily new Covid-19 cases and four Covid-19 deaths. If on that date, the Court of Appeal quashes his conviction in the RM42 million SRC International corruption case and sentencing of 12 years imprisonment and RM210 million fine, the likelihood is that Najib will put into action his plan for his return as the 10th Prime Minister of Malaysia in the 15th general election and that the 15th General Election is likely to be held in the first half of next year,

What a contrast – one brother asking for a reset of national policies and institutions and another brother dreaming about returning as the 10th Prime Minister of Malaysia.
Undoubtedly, Najib Razak has the largest election war chest in the country and has bought over many operatives to serve his cause to return as the 10th Prime Minister of Malaysia in the 15th General Election.
In the initiative started by Nazir Razak and 54 others for a reset of national policies and institutions to realize the original aspirations of becoming a nation of Malaysians, there is recognition that there had been “negative side effects” of the nation-building policies in the past half-a-century which has led to “heightened corruption, the hardening of identity politics and concentration of power” which “feed on each other and are at the heart of Malaysia’s systemic dysfunction today”. Parliamentary Opposition Leader, Anwar Ibrahim said the cabinet must explain why it had so easily agreed in principle to former prime minister Najib Abdul Razak’s request for a property valued at RM100 million.
Anwar is right, but a more serious question for Najib to answer is whether he is completely devoid of any crumb of moral scruple which led him to apply for RM100 million housing as former Prime Minister despite the multi-billion ringgit 1MDB scandal, which made Malaysia notorious world-wide as a kleptocracy. There seems to be differences between the Finance Minister, Tengku Zafrul Abdul Aziz and former Prime Minister Najib Razak as to when Najib applied for the RM100 million housing – whether the application was made after the 2022 Budget was presented to Parliament on Oct. 29, 2021 or way back in 2018 after he was toppled as Prime Minister.

I fully support Anwar Ibrahim’s call for a review of the confidence-supply-reform (CSR) memorandum of understanding (MOU) signed between Prime Minister Ismail Sabri and the Pakatan Harapan if it is taken as a blank cheque for the most repugnant and nefarious government expenditures like the RM100 million housing for Najib Razak, the person who had abused public trust and turned Malaysia into a kleptocracy.

For the past month, Malaysia had been haunted by the 1MDB financial scandal – with Goldman Sachs pleading guilty in the United States to violations of the Foreign Corrupt Practices Act in the 1MDB scandal, “a massive global scheme to loot billions dollars” from Malaysians, and the 2021 Budget debate in the Dewan Rakyat where the former Prime Minister, Datuk Seri Najib Razak soiled and stained Parliament for 90 minutes when he spoke as Barisan Nasional Backbenchers’ Club Chairman without explaining his role as “Malaysian Official 1 (MO1)” which plunged the country into unprecedented infamy, ignominy and iniquity.
Najib was convicted on July 28 in the first of a series of 1MDB-related charges of corruption, money-laundering and abuse of power and sentenced to 12 years’ jail and RM210 million fine.
