How many Ministers agree with Azam Baki that the MACC Chief Commissioner has been declared innocent by the Securities Commission of committing any offence against the law?

There is a simple test of comprehension in Malaysia today – how may Ministers agree with Azam Baki that the MACC Chief Commissioner has been declared innocent by the Securities Commission of committing any offence against the law?
If the majority of the Cabinet believes that the Securities Commission had not declared Azam Baki innocent but left the question open and unanswered as the Securities Commission is unable to “conclusively establish that a breach under section 25(4) of the Securities Industry (Central Depositories) Act 1991 (SICDA) had occurred”, then only one option is open: the Cabinet and the least it should do is to ask Azam to go on leave as MACC Chief Commissioner until the question whether he had breached the law had been answered one way or another by other investigative agencies including the Parliamentary Special Select Committee on Agencies under the Prime Minister’s Department. Has the Securities Commission made history by ending an investigation which will spark a thousand other investigations?
In declaring that the Securities Commission (SC) “is unable to conclusively establish that a breach under Section 25(4) of the Securities Industry (Central Depositories) Act 1991 (SICDA) has occurred” with regard to the shareholding case of the Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Azam Baki, the Securities Commission has left open the question under what circumstances the SC will be able to “conclusively establish” whether SICDA has been breached or not. Azam Baki has just welcomed the Security Commission statement that it had concluded its enquiry into his shareholding and is unable to conclusively establish that a breach under section 25(4) of the Securities Industry (Central Depositories) Act 1991 (SICDA) and pledging that he will “continue my responsibility as the Chief Commissioner of MACC to fight corruption without fear or favour”.
Is Azam Baki living in dreamland?

If Azam is not prepared to appear before the Parliamentary Select Committee in January itself to clear himself of the conflict-of-interest allegations, a motion should be moved when Parliament meets on Feb. 28 to remove him as MACC Chief Commissioner

If Azam Bani is not prepared to appear before the Parliamentary Select Committee in January itself, he should resign or go on leave immediately because he could not be an example of integrity in public service.

Azam-gate may lead to 15th General Election to be held after the Chinese New Year – and not just Johore state general election

There is much speculation as to whether Johore state general election will be held after the Chinese New Year.
The possibility of a Johore state general election being held after the Chinese New Year cannot be ruled out as it is an open secret that after the Malacca and Sarawak state general elections, UMNO leaders are pressing for the 15th General Election to be held as early as possible and a Johore state general election will be a form of pressure by the UMNO leaders on Prime Minister Ismail Sabri to dissolve Parliament as soon as possible to hold the 15th General Election.

The Prime Minister, Ismail Sabri should not allow a parliamentary paralysis and schedule Thursday 27th January for a Special Parliament to discuss Azam-gate as Parliament cannot allow anyone, even if he is the MACC Chief Commissioner, to hold it to ransom from deciding important national questions.
Many issues on Azam-gate happened today.
First, the Public Accounts Committee (PAC) Chairman Wong Kah Woh rightly challenged the position of the Speaker, Azahar Azizan Harun that the Parliamentary Special Select Committee on Agencies under the Prime Minister’s Department cannot be open to the public and the media under the Dewan Rakyat Standing Orders except on one point. The Malaysian Anti-Corruption Commission (MACC) Chief Commissioner Azam Baki could be jailed for contempt of Parliament if he defies the parliamentary subpoena to appear before the Parliamentary Select Committee on the Agencies under the Prime Minister’s Department on January 19 to clear himself of the conflict-of-interest allegations.
Azam was foolishly wrong when he said he was responsible only to the MACC Anti-Corruption Advisory Board (ACAB) when he owes a higher responsibility to Parliament and the people of Malaysia to be honest and upright as MACC Chief Commissioner.

I welcome the meeting of the Parliamentary Special Select Committee (PSSC) on the Agencies under the Prime Minister’s Department on January 19, 2020 to discuss MACC Chief Commissioner’s Azam Baki’s share ownership in two public listed companies especially as the Dewan Rakyat secretary Nizam Mydin Bacha had made an error in judgment by writing to the Minister in the Prime Minister’s Department (Parliament and Law) for consent to allow the PSC to meet.
To ensure that the national furore over Azam-gate could be resolved at the earliest available opportunity, I suggest that Azam should volunteer to appear before the PSCC on 19th January to answer any question on his conflict-of-interest allegations to clear himself of any doubt about the integrity of the MACC Chief Commissioner at the earliest opportunity – as it does not serve any national interest that the worst national crisis of confidence in the MACC about the integrity of the MACC Chief Commissioner should drag on for a single day. There are no signs that the Prime Minister, Ismail Sabri will salvage his premiership from a kakistocracy-in-the-making by securing a Cabinet decision tomorrow to call a special Parliament next week to restore public confidence in the government’s anti-corruption programme and to debate and decide on the report of the Parliamentary Special Select Committee on Agencies in the Prime Minister’s Department on Azam-gate.

Ismail Sabri has a last chance to salvage his premiership from becoming a kakistocracy.

The Prime Minister, Ismail Sabri, has called for a special Dewan Rakyat meeting on January 20 focussing on the floods disaster in various areas in Malaysia.
It is an eternal shame to the Malaysian Parliament that the government was not prepared to have a special debate on the floods disaster when the floods were at or near their worst at a time when Parliament was still in session, but now there is going to be a special one-day Parliament on the floods disaster on January 2001. The Malaysian Anti-Corruption Commission’s (MACC) Anti-Corruption Advisory Board acted ultra vires in clearing the MACC Chief Commissioner Azam Baki of conflict-of-interest allegation when the Board has no power to do so under the Malaysian Anti-Corruption Commission Act 2009.
Section 13 of the MACC Act 2009 stipulates six functions of the of the MACC Anti-Corruption Advisory Board and none of them gives it power to clear the MACC Chief Commissioner of conflict-of-interest allegations. Read the rest of this entry »

The Chairman of the MACC Anti-Corruption Advisory Board Abu Zahar Ujang said the MACC Chief Commissioner Azam Baki had told the Board on Nov. 24 that his trading account was used by his brother to acquire shares in two companies in 2015.
Abu Zahar said the Board was satisfied with Azam’s explanation that he had neither pecuniary interest nor conflict of interest in the acquisition of those shares.
The pertinent question is why Azam is not prepared to say that he is prepared to appear before the Parliamentary Special Select Committee on Agencies under the Prime Minister’s Department; to clear himself of the conflict-of-interest allegations first made against him more than two months ago.

Would MACC approve the appointment of a convicted corruption criminal as a Cabinet Minister?

A website reported on Sunday that there was going to be a Cabinet reshuffle and four Ministers will be replaced – the Finance Minister, Tengku Zafrul Aziz; the Minister of Youth and Sports, Ahmad Faizal Azumu; the Minister in the Prime Minister’s Department, Abdul Latiff Ahmad, the Minister for Women, Family and Community Development Rina Harun would be replaced by, among others, Najib Razak as Economic Adviser in the Prime Minister’s Department, Ahmad Maslan as Finance Minister and Shahril Hamdan as Minister for Youth and Sports.
I do not know how true is the report but appointing Najib Razak to any Ministerial position or post would be crossing the “red line” and will jeopardise the confidence-supply-reform (CSR) Memorandum of Understanding (Mo0) signed by Prime Minister Ismail Sabri and the four Pakatan Harapan leaders on Sept. 13, 2021.
