SEPT 24 — We must not forget the larger issues involved in the case simply because the government had decided to get out of a messy situation for its own good.
The Barisan Nasional government created this untenable position that cannot be sustained by logic and facts. As a cover-up for its high-handedness, it is posturing itself as a generous institution that is capable of being considerate. The fact is it is trying to extricate itself from this unjustified and cruel action against these helpless people who only meant well.
It is unthinkable that people will be deluded by this gesture of the police. Malaysians are no more gullible or naïve to be easily fooled by such tokenism. The reprehensible conduct of the police cannot be condoned. Read the rest of this entry »

SEPT 22 — Anti-corruption officers extorted RM1 million from money changers. Policeman sentenced to five years’ jail for shooting 14-year-old boy in the back. The Attorney-General accused of a string of serious and damning offences, including fabricating evidence.
Nope, these are not headlines from a banana republic in Central America or Zimbabwe. This is what is happening in Malaysia and is only a snapshot of a system falling into a serious state of disrepair, where there is a serious blurring of lines between law enforcers and law breakers, where the culture of easy money and lack of respect for the rule of law are hurting the country’s once-respected institutions.
Oh, you can bet that the Malaysian Anti-Corruption Commission (MACC) will talk about how a few bad apples should not sully the whole basket but we believe recent evidence suggests that the problems at the anti-corruption agency are institutional rather than isolated.
Wasn’t it the Royal Commission of Inquiry into Teoh Beng Hock’s death which found the behaviour of the MACC interrogators abhorrent? And of course that was before the Customs official fell to his death and where a CCTV recording mysteriously disappeared.
Aminulrasyid Amzah was shot in the back by a policeman and in another incident, the court awarded RM900,000 to a man who became paralysed after being shot in the back. Read the rest of this entry »
‘Evidence fabricated in Anwar’s corruption trial’

Anwar Ibrahim’s 1999 conviction for abuse of power was wrong as the prosecution had concocted evidence and cheated through the actions of then investigating officer Musa Hassan and then lead prosecutor Abdul Gani Patail.
This was revealed in another open letter, sent to Inspector-General of Police Ismail Omar today, by former Kuala Lumpur CID chief Mat Zain Ibrahim.
Mat Zain states that Musa and Gani had done this for their joint benefit. Both had risen in ranks, with Musa becoming the police chief and Gani, the attorney-general. Musa retired recently.
“It is not wrong to say the jail term Anwar faced is an injustice to him as a result of both their (Musa’s and Gani’s) actions. I am basing this argument on documentary evidence and statements that I have and are within my knowledge,” he said in the letter.
“I am also saying this because there are important statements made by (former prime minister) Dr Mahathir Mohamad in Chapter 53 of his memoirs ‘Doctor in the House’ on the black eye incident, and the actions by the public prosecutor are different from what I have in the official case files of 1998.
“I believe that Mahathir was given a wrong briefing and he had been manipulated.” Read the rest of this entry »

KUALA LUMPUR, Sept 12 — A former senior police officer today claimed that Tan Sri Musa Hassan and Tan Sri Abdul Gani Patail had fabricated evidence against Datuk Seri Anwar Ibrahim, leading to his sacking from government by Tun Dr Mahathir Mohamad in 1998.
Former city criminal investigation chief Datuk Mat Zain Ibrahim claimed in an open letter to the Inspector-General of Police today that Musa, who was then Bukit Aman’s assistant criminal investigation chief, had stolen Anwar’s DNA to ensure that the sacked deputy prime minister would be convicted of sodomy.
“I believe this happened because Tun was given information or a briefing that was manipulated and misleading,” said the policeman who led the 1998 probe into the black eye inflicted on Anwar by then police chief Tan Sri Rahim Noor.
Mat Zain based his claim on “documentary evidence and statements that I have and are within my knowledge” as well as Dr Mahathir’s memoirs that were released earlier this year. Read the rest of this entry »

SEPT 10 — So far the only people not blamed for the mishandling of the Bersih 2.0 rally are Al-Qaeda, Chin Peng, Kermit the Frog and Ayah Pin.
You get the drift, right. It seems that the order to turn Kuala Lumpur into a war zone and treat ordinary Malaysians like criminals was everybody’s fault but that of Prime Minister Datuk Seri Najib Razak.
In the short time following the rally on July 9, Najib’s operatives and aides spent considerable time convincing journalists and pundits that he was all for offering Bersih organisers the use of a stadium but was persuaded otherwise by
a) Home Minister Datuk Seri Hishammuddin Hussein;
b) Information Minister Datuk Seri Rais Yatim;
c) Deputy IGP Datuk Seri Khalid Abu Bakar;
d) Datuk Ibrahim Ali and Perkasa; and

KUALA LUMPUR, Aug 18 — A former senior police investigator has questioned Putrajaya’s directive for all GLCs to drop civil suits worth billions of ringgit against Tan Sri Tajuddin Ramli, stating that the move raises the question of whether hundreds of millions of ringgit were being held by Umno nominees.
Datuk Mat Zain Ibrahim wrote in an article sent to The Malaysian Insider that the former MAS chairman held RM70 million in trust for Tun Daim Zainuddin who was finance minister during Tun Dr Mahathir Mohamad’s administration.
“The question of whether the money belonged to Tun Daim, or was shared with someone else or if it belonged to Umno will become an issue. In short, the public has the right to raise 1,001 questions on this issue,” said the former city CID chief. Read the rest of this entry »

Readers who have been following the progress of the MoCS ‘Walk for Democracy and Reform’ assembly in Kuching will be as disappointed as we are that the event has been called off. This development, though disappointing is not unexpected given the extraordinary pressure on Francis and the small group of stalwart supporters during the last few weeks. The perverted use by the government of the law enforcement agencies for its political ends has long been a feature of Barisan Nasional rule in Malaysia; and this has proven to be the case once again. It will not be the last time.
Refusal to provide permits for legitimate public gatherings and events organized by the opposition is part of the standard operating procedure of the police force. Other not so subtle forms of denial of our constitutional right to freedom of assembly are the use of restraining orders, which with the connivance of a sycophantic judiciary, is meant to prohibit leaders and supporters from gathering anywhere close to the vicinity of any planned rally that is perceived as drawing attention to the corruption, abuses and bad governance of the ruling elite. KUALA LUMPUR, Aug 12 — A former senior cop has called for charges to be brought against Tan Sri Tajuddin Ramlim saying the withdrawal of civil suits against the former Malaysian Airline (MAS) chairman does not indemnify him against criminal culpability.
Datuk Mat Zain Ibrahim told The Malaysian Insider today that Putrajaya’s decision to settle with Tajuddin out of court and directive to government-linked corporations to drop their cases against the latter did not mean that two police reports and another made to anti-graft enforcers were nullified.
“Even if MAS and other GLCs were to drop all civil claims against Tajuddin, they have no or power to indemnify Tajuddin from criminal liabilities. For that matter, no minister or even the Attorney-General has the authority.
“In fact, police have recommended that several criminal charges be preferred against Tajuddin and few others,” the former Kuala Lumpur criminal investigation chief said. Read the rest of this entry »

I was ‘honoured’ to be welcomed back at the Kuching airport on Monday (Aug 8) by five police officers.
Immediately after I crossed the immigration counter at 6.15pm, one of them who introduced herself as ASP Angela ak Ladie, approached me and she and her colleagues then ushered me into a room. Another introduced himself as Sub-Inspector Simon Low. The others said they were stationed at the airport.
I was given a letter stating that I was required to be at the Sarawak police headquarters on Aug 10 at 10am for the purpose of recording my statement under Section 112 Criminal Procedure Code. Read the rest of this entry »

AUG 10 — I have been rather sarcastically asked on Twitter such questions as, “you support freedom of assembly, you want Malaysians to riot like the Londoners?”. Another twitterati asked me, “Art, you support the riots in London?”.
Frankly, I am amused to my bone by such questions.
I am amused because the attempts at justifying the banning of public rallies in Malaysia by referring to the riotous behaviour of some others displays a certain degree of shallowness, if not lack of intelligence. Read the rest of this entry »
Jais, cops raid church over multi-racial dinner

PETALING JAYA, Aug 4 — The police and Selangor religious authorities raided a multi-racial dinner at the Damansara Utama Methodist Church (DUMC) here last night over an unspecified complaint.
DUMC senior pastor Dr Daniel Ho said about 30 police officers and enforcement officers from the Selangor Islamic Religious Department (Jais) entered the church without a warrant at 10pm.
Ho explained that an NGO called Harapan Komuniti had organised an annual thanksgiving dinner at the church, which saw an attendance of between 100 and 120 guests of all races. Read the rest of this entry »
IGP and top police officers should stop issuing arbitrary and politically-inspired directives
The past five weeks before and after the 709 Bersih 2.0 rally for a free and fair elections must be one of the most difficult times for ordinary police personnel all over the country in recent years, for they were forced to become bullies instead of being “friends and protectors” of the people whose first priority is to reduce crime to make people safe.
In these five weeks, police throughout the country were forced to comply with arbitrary and politically-inspired directives from the top police leadership whose primary objective is not to make the ordinary Malaysian people safe but to protect the existing regime in power.
Police were required to hound the public for wearing the innocuous Bersih T-shirt to the extent that xanthophobia (irrational fear of yellow) became a commonplace word with police not only arresting persons wearing the yellow-coloured Bersih 2.0 T-shirt but even for wearing yellow T-shirts!

The EO 6 freed – but are they free?

Considering the fact that all these six citizens were accused of very serious offences in the first instance and subsequently cleared, this news that they will be charged tomorrow is disturbing to Malaysians.
The police initially accused them of treason, which if proven would make them traitors to the country. This is a terrible accusation. One would think that without solid proof this accusation would not be levelled against them.
Mysteriously, this accusation simply disappeared into thin air. Next they were accused of posing a threat to public order. This, again, is a serious offence. Malaysians were anxiously waiting to be convinced in what ways these six were a threat to public order. Strangely, nothing was produced to support the police claim.

The Parti Sosialis Malaysia (PSM) Six, including the MP for Sungai Siput Dr. Michael Jeyakumar, who were released on Friday after 27 days of detention under the obsolete 1969 Emergency Ordinance after a week’s remand under the Penal Code for “waging war against the Agong”, have been informed that they will be charged in Butterworth tomorrow with “possessing subversive material”.
The Attorney-General, Tan Sri Gani Patail should drop the charges against the PSM6.
They must release that the public reaction is whether the Police and the Najib administration have not made enough spectacles of themselves both nationally and internationally in their gross and disastrous mishandling of the 709 Bersih 2.0 rally and the EO6 detention. Read the rest of this entry »

KUALA LUMPUR, July 31 — Datuk Seri Najib Razak disclosed today he had thought of Shah Alam stadium for the July 9 rally when he made offered a venue to Bersih, pointing out this was “the best option” available.
The prime minister, however, had never specified which stadium Bersih could hold the July 9 rally at when he made the offer.
“I offered a stadium. You can show dissent in a stadium, but they still wanted to do it on the streets.

The Najib administration should now learn to respect the ‘rule of law’ instead of bending over backwards to fulfill its own hidden agendas

Abusing the Emergency Ordinance 1969, six breadwinners of their families’ were thrown behind bars and defamed with having waged a war against the King, holding subversive beliefs and instigating the rakyat to attend a rally which the police had deemed illegal.
Yesterday, 28 days later, all six were set free, unconditionally. The question that begs an answer from Prime Minister Najib Tun Razak is: What happened in those 28 days’ that made him, his cousin the Home Minister Hishammuddin Hussein and the Inspector-General of Police Ismail Omar realise that the six are innocent and should rightfully be released?
Or was it a case of all three parties being well aware of the innocence of the six but proceeded to used them as scapegoats, hoping to teach Malaysians in general a lesson for taking to the streets on July 9, 2011 and challenging the ‘powers that be’? Read the rest of this entry »

DAP parliamentary leader Lim Kit Siang has demanded that the government reveal who was behind the charges that the PSM 6 were allegedly trying to wage war against the Yang di-Pertuan Agong and reviving communism.
“Malaysians are entitled to ask who are the officers or politicians who had been so ‘creative’ as to concoct the heinous charge under Section 122 of the Penal Code against the PSM activists in the first instance,” Lim said in a media statement today.

Own up to this despicable mistake of arresting six innocent Malaysians and, maybe, the rest of their fellow citizens will move on and cut the police as well as the Najib administration some slack.
Just this once, drop the political posturing and say sorry to Sungai Siput MP Dr Michael Jeyakumar and his party colleagues, Parti Sosialis Malaysia (PSM) deputy chairman M. Sarasvathy, central committee members Choo Chon Kai and M. Sugumaran, Sungai Siput branch secretary A. Letchumanan, and Youth chief R. Saratbabu.

KUALA LUMPUR, July 28 — Emergency Ordinance (EO) detainee and Sungai Siput MP Dr Jeyakumar Devaraj will begin a hunger strike today until he and five others detained under the EO are released or charged in court.
“Dr Jeyakumar told me that he would begin a hunger strike on July 28 to get justice. When I met my husband on July 27, he was feeling very frustrated and disappointed with the police and government’s stand on the six PSM activists detained under the EO since July 2,” Dr Jeyakumar’s wife Mohanarani Rasiah said today.
“I advised him against it because of his health but he resolved to do so until the PSM6 are released or charged in court.”

Government settles with ‘nude squat’ woman

KUALA LUMPUR, July 27 — The government has agreed to compensate the woman who was videotaped performing nude squats in a Petaling Jaya police station six years ago.
A settlement was reached between the government and Hemy Hamisa Abu Hasan Saari, 28, at the Kuala Lumpur high Court today.
However, the amount agreed upon by the government, the constable who recorded the video and the mother of three who had initially sought RM10 million in damages when she filed her civil suit, was not disclosed.
The widely-circulated 2005 video had embarrassed the police and resulted in a royal commission of inquiry (RCI) which called for the practice of stripping detainees and forcing them to perform squats a violation of human rights and Islamic principles.
