Parliament should honour Kevin Morais who gave his life in the battle against corruption and the heroes and heroines who saved Malaysia from the 1MDB kleptocracy

A little-noticed event in the anti-corruption battle which should have deserved greater and deeper public attention took place on Tuesday – the posthumous award to the late senior deputy public prosecutor, Kevin Morais.
In honouring Kevin Morais with the Perdana International Anti-Corruption Champion 2020 Award at a ceremony which launched the Perdana International Anti-Corruption Champion Foundation (PIACCF), the Prime Minister, Tun Dr. Mahathir Mohamad said the award symbolised PIACCF’s appreciation to all the brave officers who suffered in upholding their integrity.
In his speech, Dr Mahathir also acknowledged the contributions of former Attorney-General Tan Sri Abdul Gani Patail, former Bank Negara Malaysia Governor Tan Sri Dr Zeti Akhtar Aziz and former Malaysian Anti-Corruption Commission (MACC) chief commissioner Datuk Seri Mohd Shukri Abdull in exposing the 1Malaysia Development Berhad (1MDB) scandal.
He said it was a significant case, as it became the turning point of Malaysia’s political direction and sparked an awakening among Malaysians.
“Their collective courage and determination brought a kleptocratic regime to its feet, in an unprecedented show of people’s power,” he added.
Parliament, which is reconvening next month, should honour Kevin Morais who gave his life in the battle against corruption and the heroes and heroines who saved Malaysia from the 1MDB kleptocracy. Read the rest of this entry »
2020 is the year to leave the negative vibes of last year behind

Last year, Malaysia was virtually drowned in a sea of negative vibes.
In the first seven months of the new government in 2018, there was nothing that the Pakatan Harapan government could do wrong. But in the past year, there was nothing that the PH could do right.
This is one reason why the Transparency International (TI) Corruption Perception Index (CPI) 2019 Report which was released on the eve of the Chinese New Year was met with such grudging response, although it was the best TI CPI report in 25 years.
Without the phenomenal improvements in both TI CPI ranking and score last year , Malaysia would not be making the crucial and critical break from a global kleptocracy.
If there had been no change of government, Malaysia will be sliding down the CPI score to the thirties bracket, to find new company among the more corrupt nations of the world in the lower rankings. Read the rest of this entry »

I regard the Transparency International (TI) Corruption Perception Index (CPI) 2019 Report the best in 25 years since Transparency International started its annual Corruption Perception Index report in 1995, and should be the basis for a new era of anti-corruption in Malaysia by achieving the best TI CPI score next year, which will embark Malaysia on the road to become one of the world’s top 30 countries in public integrity before 2030.
The National Integrity Plan (NIP) 2004-2008 launched in 2004 had one of its objectives the placing of Malaysia among the world top 30 countries in public integrity.
At that time, Malaysia was ranked No 37th with a score of 5.2 out of 10 in the TI CPI 2003.
The National Integrity Plan was a total failure as Malaysia never improved on its TI CPI ranking and score, and instead went on a downward decline, ranked No. 47 out of 180 countries with a score of 5.1 out of 100 in TI CPI 2008 at the end of NIP, before heading for another period of decline, falling to TI CPI ranking of 62 out of 180 countries with a score of 47 of 100 points in the TI CPI 2017.
Malaysia’s TI CPI 2019 score of 53 out of 100 is just short of Malaysia’s top score of 5.32 out of 10 in the TI CPI 1996 which placed Malaysia on the ranking of 26 out of 54 countries.
Malaysia should aim not onto to exceed the results in the TI CIP 1996, but should also aim to achieve the NIP objective of being ranked among the world top 30 countries in public integrity before 2030. Read the rest of this entry »

The Transparency International (TI) Corruption Perception Index (CPI) 2019 released midday today is the best Chinese New Year present to Malaysia and should spark the start of a virtuous circle of delivery of Pakatan Harapan general election promises and achievements in 2020.
It is the best antidote to the atmosphere of doom and gloom which has descended on Malaysia.
In 2017, Malaysia’s TI CPI ranked No. 62 (lowest for Malaysia in 25 year since 1995) with a score of 47 out of 100; while in the TI CPI 2018 released in January 2019, Malaysia was ranked No. 61 out of 180 countries with a score of 47.
In the TI CPI 2019 released today, Malaysia is ranked No. 51 with a score of 53, registering a single-year improvement six points for the TI CPI score and 10 placings in TI CPI ranking, which is the best performance for Malaysia in the past quarter of a century.

Many public interest issues have been raised by the disclosure of the nine audio tapes released by the Malaysian Anti-Corruption Commission but among the biggest is that after a week, none of the protagonists, whether former Prime Minister, Datuk Seri Najib Razak, his wife Datuk Seri Rosmah Mansor, former MACC Chief Commissioner, Tan Sri Dzulkifli Ahmad or Baling MP Datuk Seri Azeez Abdul Rahim had denied their veracity or claimed that they were doctored or fake tapes.
In fact, Najib had indirectly confirmed the authenticity of the tapes when he claimed that the infamous “Can I advise you something” audio tape wasn’t “Rosmah scolding me, it was a normal chat” between husband and wife or his ridiculous claim that the tapes on his conversation with the United Arab Emirates crown prince Mohammed Zayed Al Nahyan on July 22, 2016 to intervene for his stepson Riza Shahriz Abdul Aziz proved that he had not been lying about the 1MDB scandal.
The resolution of these many public interest issues raised by the disclosure of the nine audio tapes, including the shocking disclosure of a prime minister involved in the high crime of treason participating in an obstruction of justice, is one of the greatest challenges facing Malaysia in the new year.

The voters of Tanjong Piai parliamentary by-election will go to the polls on Saturday, 16h November.
Tanjong Piai parliamentary by-election has reversed the role of general elections and by-elections before the 14th General Election on May 9, 2018 – as the government coalition calls for continued fight against corruption and abuses of power to transform Malaysia from a global kleptocracy to a leading nation of integrity in the world in a decade’s time, while the Opposition stands for a return to the corruption and abuses of power of the past government.
This is why the Tanjong Piai parliamentary by-election is important as a marker of future direction of the nation-building policies in the country – whether we continue in the reform agenda of the Pakatan Harapan government despite the missteps and mistakes of the past 18 months, or whether we abandon these reform programmes altogether.
The stand of Muafakat Nasional of PAS, UMNO and MCA on the 1MDB scandal is the best illustration – for up to now, they are united in denying that there is a 1MDB scandal although the whole world knows about the 1MDB scandal and the roles of Najib Razak and Jho Low in it, several bankers have been jailed in foreign countries for their role in the scandal and the Malaysian government is paying heavily in terms of tens of billions of ringgit for the 1MDB debts when the money could be used for the people’s welfare. Achievements of PH government in 18 months which are recognised internationally

Going by the campaign rhetorics of Muafakat Nasional of PAS, UMNO and MCA in Tanjong Piai by-election campaign, it would appear that the 18 months of Pakatan Harapan government in Putrajaya has been a total failure and disaster which is in total contrast to the recognition given by the world to the achievements chalked up by the Pakatan Harapan Government.
The World Bank’s Ease of Doing Business Index has improved to the 12th best in the world in 2020 from 15th in 2019, while Malaysia is among the best improved economies in the World Bank’s 2018 Worldwide Governance Indicators.
Thanks to its commitment to institutional reforms after the “509” result of the 14th General Elections, Malaysia is also among the best improved country in the World Bank’s Worldwide Governance Indicators (WGI) for year 2018.

Today, November 11, 2019 is an important date in the journey to fulfill four of the five pillar-promises of Pakatan Harapan pledge of a New Malaysia and public support must continue until the goal of a New Malaysia is achieved.
Today, the judiciary made two important decisions, viz: firstly, the Federal Court denied the application of leave to challenge the constitutionality of the existence of Chinese and Tamil primary schools; and secondly, the Kuala Lumpur High Court ordered former Prime Minister, Najib Abdul Razak to defend himself against all seven charges in relation to SRC International Sdn Bhd., placing the onus on the defence team to prove reasonable doubt in the cases established against Najib failing which the former premier would be convicted.
The four pillar-promises in the 14th General Election Pakatan Harapan Manifesto which these two judicial developments helped to advance are:
· Reduce the people’s burden;
· Institutional and political reforms, which includes transforming Malaysia from a global kleptocracy into a leading nation of integrity in the world, and the restoration of the important principles of the rule of law and an independent judiciary;
· Spur sustainable and equitable economic growth; and
· Create a Malaysia that is inclusive, moderate and respected globally.
The High Court decision today on Najib’s first of several corruption trials is an affirmation that Malaysia’s trajectory to transform itself from a global kleptocracy to a leading nation of integrity in the world is on course, although Malaysia is still a long way to achieve its goal. Another Malaysian first in the world but which Malaysians have nothing to be proud about

Malaysia has achieved another first in the world but it is something which Malaysians have nothing to be proud about.
Two days ago, Malaysian ‘billionaire’ and fugitive financier from justice, Jho Low reached a settlement deal with the United States Department of Justice and agreed to surrender US$1billion in funds he and his family had misappropriated from Malaysian investment fund 1MDB.
As Jho Low himself said his personal blog page:
“I am very pleased to confirm that a landmark comprehensive, global settlement has been reached with the United States government, which fully and forever resolves in their entirety each of the U.S. government’s civil, criminal, and administrative actions or proceedings relating to the defendant assets at issue in the Central District of California.
“The historic agreement builds on a series of successful prior agreements negotiated with the U.S. Department of Justice and is the result of good faith discussions between the parties.
“Importantly, the agreement does not constitute an admission of guilt, liability or any form of wrongdoing by me or the asset owners. We believe all parties consider this resolution, which is subject to final court approval, to be a successful and satisfactory result.”
Jho Low is not only the first Malaysian, but the only person, in the world who could surrender US$1 billion in funds, although his action “does not constitute an admission of guilt, liability or any form of wrongdoing by me or the asset owners”.

Fourth Challenge to Malaysian Youths – Be in the frontline to fight corruption and to achieve the objective for Malaysia to be among world’s top 30 countries in integrity by year 2030

For the third time in ten days, the Yang di-Pertuan Agong Sultan Abdullah Sultan Ahmad Shah reminded all Malaysians about the fundamentals of nation-building in a plural Malaysia as spelt out by the Malaysian Constitution and the Rukunegara.
Speaking at the investiture ceremony of federal awards and honours at Istana Negara yesterday held in conjunction with his official birthday celebration, he reminded all Malaysians not to play up sensitive issues in the interests of any party.
He said that every citizen has been promised rights and freedoms in accordance with the Federal Constitution, but that freedom must not go beyond the values that are fundamental to national unity.
He said: “So as in politics. There must be a line and limit that should not be crossed. If political polemics were left prolonged, sooner or later it will start taking its toll on the people.
“Believe me, the unity, peace and harmony that have been built over these 62 years, if we ever lose them, will be very difficult to get back.
“My advice is, let bygones be bygones, forgive and forget past disputes so that the broken relationship can be fixed and restored.”
In the past ten days, the Sultans of Perak and Selangor have also expressed similar concerns when they spoke on the importance of national unity and the dangers of uncontrolled spread of fake news and hate speech to destroy inter-racial and inter-religious understanding, tolerance and harmony in Malaysia. If Pakatan Harapan loses the 15th General Election, then its kaput for a New Malaysia as a top world-class nation as this is a mission that will take a decade or two – definitely more than one general election cycle

Tonight’s event is a historic event in Sarawak, even more so as we want it to achieve “history to history” to mark Pakatan Harapan making history in the 14GE when we achieved federal power in Putrajaya to making history in the 12GE in Sarawak to control Petrajaya and form the Sarawak State Government in the 12th Sarawak State General Election.
In the 12th Sarawak State General Election which must be held by mid-year of 2021, Pakatan Harapan must convince Sarawakian voters to join in the venture to create a New Sarawak in tandem with the Federal promise to build a New Malaysia.
Last Friday, at the Malaysian Economic Symposium in Parliament which was co-organised by the Parliamentary Caucus on Reform and Governance, the Backbenchers’ Club and the Speaker of the Dewan Rakyat, I said that 444 days after the historic peaceful and democratic change of government in Putrajaya on May 9, 2018 – the first time in six decades – it is time for a major review of Pakatan Harapan Manifesto and promise of a New Malaysia.
We have made the crucial and critical shift in the 14th General Election from the trajectory of a failed, rogue and kleptocratic state and headed in a new direction, resetting nation-building policies to build a New Malaysia of unity, excellence, justice, freedom and integrity to Malaysia to become a top world-class nation.
But there is no guarantee of success that we can inexorably reach the goal of a New Malaysia, for this is work of a decade or two and we can always be hijacked and the nation-building direction diverted along the way.

Proponents of klepto-theocracy in attack mode with more lies and falsehoods as accusing me of condemning Muslims as thieves and corrupt

Yesterday, while supporting the idea proposed by Prime Minister, Tun Dr. Mahathir Mohamad in Ankara that Muslim countries like Malaysia, Turkey and Pakistan pool their resources to make Islamic civilisation great again, I made the point that it is not possible to make Islamic civilisation great again based on klepto-theocracy – the political doctrine which misuses Islam to peddle lies, falsehoods, distrust, suspicion, hatred and which supports thievery and corruption.
This elicited an immediate attack by the proponents of klepto-theocracy, pouring out more lies and falsehoods as accusing me of condemning Muslims as thieves and being corrupt.
Only simpletons and the retarded will believe in such garbage, for there are Muslims who are thieves and corrupt just as there are non-Muslims who are thieves and corrupt.
A person becomes a thief or is corrupt not because of his religion but despite his religion – in fact if he is a pious follower of Islam or the great religions of the world, the last thing he would do is to become a thief or corrupt – as he had disregarded the basic teachings of Islam and the great religions of the world to be good, pious, virtuous and God-fearing.

Klepto-theocracy is a political doctrine in Malaysia which misuses Islam to support thievery, corruption, intolerance, bigotry, lies and falsehoods

I have been asked what is the meaning of this term “klepto-theocracy” which I been using for the past week.
In a nutshell, klepto-theocracy is a political doctrine in Malaysia which misuses Islam to support thievery, corruption, intolerance, bigotry, lies and falsehoods.
A most recent example of this new political hypocrisy is about the declaration of assets, with the PAS, UMNO, MCA and MIC MPs in both Houses of Parliament opposing the motion requiring MPs to publicly declare their assets.
The PAS President said declaring assets is a communist, socialist concept that may have been dreamt up by DAP while the PAS Deputy President said it was unIslamic to declare assets, until it was pointed out that the latter had in 2015 dared the then Prime Minister Datuk Seri Najib Razak to declare his assets!

18 year-olds voting and standing for election, police who are friends of people and working towards transforming Malaysia into a nation of integrity are signs of New Malaysia-in-the-making

Fourteen months after the historic decision of the 14th General Election on May 9, 2018 to save Malaysia from a failed, rogue and kleptocratic state, a New Malaysia is taking shape.
Three recent events showed that we are moving in a direction where 18-year-old Malaysians can vote and stand for elective office, police are to be regarded as friends and not bullies or oppressors of the people with the establishment of the Independent Police Complaint and Misconduct Commission and Malaysia is being transformed from a kleptocracy state into a leading nation of integrity.
The basic reason why Malaysia had lagged behind countries like United States, Philippines, France, New Zealand, Denmark, India, Hong Kong, Jordan, Pakistan, Morocca, Saudi Araba and Japan, which had lowered the voting age from 21 years to 18 years in past 48 years since I first raised the issue in Parliament in 1971 is because past governments were afraid of the youth, whom they regard as anti-establishment and anti-government.
The 12-day meeting of July 2019 Parliament ended yesterday with the presentation of the long-awaited Independent Police Complaints and Misconduct Commission (IPCMC) Bill.

The RM270 million 1MDB civil forfeiture suits against 41 local individuals and groups is a good and great start by Latheefa Koya as Malaysian Anti-Corruption Commission (MACC) Chief.
This is the largest forfeiture action in the nation’s history, caused by the dispersal to the 41 respondents from former Prime Minister, Datuk Seri Najib Razak’s personal AmBank account.
The immediate response by the acting UMNO president Datuk Seri Mohamad Hasan that UMNO will fight the civil forfeiture suits in court is showing to Malaysians the real kleptocratic colours of UMNO, that the curse of kleptocracy is not just the transgressions of one person but the fault of the entire UMNO leadership – and even the previous Cabinet!
Is Mohamad Hassan and the UMNO leadership claiming that the 1MDB scandal, which is being investigated in 10 countries, and for which banks in foreign countries had been fined and closed and bankers in foreign countries had been convicted of money-laundering crimes and imprisoned, was just a figment of imagination of the MACC?
As out of the RM270 million civil forfeiture suits, RM212 million (78.5 percent) was sought from Umno divisions, is the UMNO leadership prepared now to admit to the reality of the 1MDB scandal which made Malaysia a global kleptocracy and declare how it is prepared to co-operate with the anti-corruption authorities to purge Malaysia of the infamy, ignominy and iniquity of the 1MDB global kleptocracy?

The former Attorney-General Tan Sri Mohamad Apandi Ali and the former Inspector-General of Police Tan Sri Khalid Abu Bakar should be investigated for the role in the infamous “Week of Long Knives July/August 2015” to establish the important principle of the supremacy of Rukunegara which must be respected by all key top officials.
Three key principles of Rukunegara, namely loyalty to King and Country, the supremacy of the Constitution and the Rule of Law, were undermined and assaulted in the “Week of Long Knives July/August 2015”, causing a great damage to the system of parliamentary democracy in the country.
This was the only occasion when the 2012 amendment to the Penal Code to create a new section 124B to a create a new offence that anyone carrying out , by any means, directly or indirectly, “any activity detrimental to parliamentary democracy” could be jailed to 20 years would have applied on all fours, but instead of invocation of Section 124B of the Penal Code against the principals undermining parliamentary democracy, these principals were allowed to “run riot’ in their conspiracy to undermine the supremacy of Rukunegara.
It is the undermining of these key Rukunegara principles during the “Week of Long Knives July/August 2015” which led to Malaysia suffering the infamy, ignominy and iniquity of being condemned by the world as a global kleptocracy.

A MACC report had been lodged by a former anti-corruption agency officer in January 2016 against Apandi as the then Attorney-General for clearing the then Prime Minister Najib of corruption charges but to date, no action had been taken

It has come to my knowledge that a former anti-corruption agency officer had lodged a report with the Malaysian Anti-Corruption Commission (MACC) in January 2016 against the then Attorney-General Tan Sri Mohamad Apandi Ali for clearing the then Prime Minister, Datuk Seri Najib Razak of corruption charges but to date, no action had been taken.
This former anti-corruption agency officer had lodged a report with the MACC against Apandi after he cleared Najib of corruption charges which had been recommended by the MACC and agreed upon by the former Attorney-General Tan Sri Gani Patail for the Penal Code offence of criminal misappropriation of public funds.
His report had been accepted by the MACC and registered. Unfortunately it was never fully investigated by the MACC.
This in itself is an offence under section 217 Penal Code which says that, any public servant who is statutorily bound to perform a public duty and fails to do so intending to protect or save any person from punishment or forfeiture of property commits an offence. And Section 7 of the MACC Act makes it a statutory duty for any MACC officer to receive any report of the commission of an offence and investigate such report.
This former anti-corruption agency officer said that Apandi’s press conference on 26th January 2016 in his capacity as Attorney-General clearing Najib of any corruption offence, which was not only against the recommendation of the MACC but also tantamount to revoking the decision of former Attorney-General Gani Patail, amounted to a gross abuse of power and conflict of interest since the very person he cleared of the corruption charges was the same person who appointed him to the office of AG. Mahathir sudah memberikan salah satu cabaran terbesar kepada Latheefa Koya sebagai Pengerusi SPRM — untuk memastikan kleptokrat dibawa kemuka pengadilan sepanjang kontrak dua tahun beliau yang mendatang
Perdana Menteri Tun Dr Mahathir Mohamad telah mengamanatkan salah satu cabaran terbesar buat Latheefa Koya — untuk memastikan kesemua kleptokrat dan kaki rasuah dibawa ke muka pengadilan dalam tempoh kontrak dua tahun beliau.
Apabila ditanyakan di Jasin, sama ada kerajaan berhasrat untuk menyiasat peranan seorang bekas perdana menteri dan beberapa bekas pegawai kerajaan berpangkat tinggi dalam Minggu Pemecatan Besar-besaran yang berlaku pada Julai/Ogos 2015, Mahathir menjawab, kerajaan buat masa ini tidak mempunyai tenaga kerja yang mencukupi untuk menyiasat semua individu daripada pentadbiran yang lepas yang disyaki terlibat dengan rasuah.
Kata Mahathir:
“Kita dapati kerajaan yang telah ditewaskan tersebut dipenuhi dengan mereka yang melakukan jenayah, tapi buat masa ini, kita tidak boleh untuk fokus kepada mereka semua kerana kita tidak mempunyai tenaga manusia yang mencukupi.
“Buat masa ini, kita fokus kepada kes-kes yang amat serius, seperti kes (bekas) Perdana Menteri yang menyebabkan banyak wang daripada Kumpulan Wang Amanah Pekerja (KWAP) hilang.”
Saya telah menyatakan harapan saya sebelum ini, seperti mana yang kita dapat saksikan dalam tahun pertama Kerajaan Pakatan Harapan — para kleptokrat yang diketuai bekas Perdana Menteri Datuk Seri Najib Razak disiasat dan didakwa atas tuduhan rasuah — tahun kedua Kerajaan ini akan menyaksikan kaki rasuah yang lain dibawa ke muka pengadilan.
