Kit Siang: Forced suicide is homicide

KUALA LUMPUR, July 21 — Lim Kit Siang has likened Teoh Beng Hock’s suicide under duress from graftbusters to murder and said that those responsible for his death must “face the full consequences”.
The DAP parliamentary leader said any layman would agree that being forced to commit suicide by Malaysian Anti-Corruption Commission (MACC) officers was not the same as suicide but was “equal to homicide”.
“You cannot have a situation it’s not homicide but (rather) forced to commit suicide,” he told The Malaysian Insider.

KUALA LUMPUR, July 21 — A royal commission has ruled that Teoh Beng Hock committed suicide as a result of pressure from aggressive and continuous questioning by Malaysian Anti-Corruption Commission (MACC) officers.
The MACC officers had wanted to pressure Teoh to be a witness in their case against a DAP assemblyman for alleged abuse of public funds.

KUALA LUMPUR, July 18 — DAP’s Lim Kit Siang today lauded the Cabinet’s decision to make public the Royal Commission of Inquiry’s (RCI) findings on Teoh Beng Hock’s death but warned that its release might not lay the two-year controversy to rest.
The senior politician reminded the government that it was still yet to be determined if the RCI had successfully unearthed the mysterious circumstances that led to Teoh’s fatal fall in 2009.
“We do not know if the RCI was able to get to that depth, to the root of the matter . . . to determine the details behind Teoh’s death and whether it is acceptable. We will still need to study it,” he told The Malaysian Insider.

SERI KEMBANGAN: The cute little toddler played and ran about, bringing a tinge of a smile to the crowd of serious-looking adults around him.
Clad in an orange shirt, the 17-month-old Teoh Er Jia’s cheerful disposition bore a stark contrast to the tears of his family and the sombre mood of some 400 people who gathered to commemorate the anniversary of his father’s death.
Today, marked the second year of Teoh Beng Hock’s death.
Last night, a memorial function in his honour was held at the Seri Kembangan multipurpose hall, attended by Teoh’s former employer, Selangor exco Ean Yong Hian Wah and other DAP leaders.
Throughout the event, Er Jia was the centre of attention as his mother Soh Cher Wei received praises and support from the people. Read the rest of this entry »

The Cabinet has been sitting on the Royal Commission of Inquiry report into the death of Teoh Beng Hock for three weeks since it was first submitted to the Yang di Pertuan Agong on June 22, 2011.
This is most inconsiderate to the Teoh Beng Hock family members as well as inefficient, as in developed democracies which fully upholds the principles of accountability, transparency and good governance, Royal Commission of Inquiry reports are invariably made public at the same time they are submitted to the heads of states.
There is no need for the government of the day to study the Royal Commission of Inquiry reports concerned as to whether they are in agreement or otherwise, as the RCI reports are commissioned in the name of the people and country.
If the government has any views and decisions pertaining to findings or recommendations of Royal Commissions of Inquiry, they could be made public subsequently.
As in another four days it will be the second anniversary of Teoh Beng Hock’s mysterious and unusual death at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16, 2009, the Cabinet should not sit on the Teoh Beng Hock RCI report any further but must act responsibly by releasing it immediately to the public tomorrow itself in line with the principles of accountability, transparency and good governance and in time for Teoh Beng Hock’s second death anniversary.

Veteran opposition lawmaker Lim Kit Siang has urged the cabinet to order the disclosure of the report by the royal commission of inquiry into Teoh Beng Hock’s death when it meets tomorrow.
In a statement today, Lim said that although RCI head Justice James Foong had said that the decision on whether the report can be made public lies with the Agong, the Agong still acts on the advice of the cabinet.
Citing Articles 39 and 40 of the federal constitution, Lim explained that the cabinet still had a large say on the matter.
“In another 23 days, it will be the second anniversary of Teoh’s mysterious and unusual death at the Malaysian Anti-Corruption Commission (MACC) headquarters in Shah Alam on July 16, 2009.

The Royal Commission of Inquiry report into the death of Teoh Beng Hock submitted its report to the Yang di Pertuan Agong yesterday, three days ahead of its deadline of June 25.
The RCI Chairman Tan Sri James Foong told a press conference yesterday that a copy of the 124-page report had also been submitted to the Prime Minister.
However, the contents of the report will remain secret, pending a decision from the Yang di Pertuan Agong if the report should be made public.
This means, under Article 39 on “Executive Authority of Federation” and Article 40 on “Yang di Pertuan Agong to act on advice” of the Federal Constitution, the Yang di Pertuan Agong shall act in accordance with the advice of the Cabinet on the question of making public the RCI report on the death of Teoh Beng Hock. KUALA LUMPUR, June 15 — The family of Selangor Customs assistant director Ahmad Sarbaini Mohamed has rejected Putrajaya’s decision to hold an inquest into his death and are insisting instead on a royal commission of inquiry (RCI).
The inquest, to be presided over by Coroner Aizatul Akmal Maharani, was set for July 4 to 15 at the magistrate’s court here.
Sarbaini’s son, Shahril Ahmad, told The Malaysian Insider that his family preferred the RCI as it would be harder to determine the cause of his father’s death through an inquest and that this would delay the pursuance of justice.

KUALA LUMPUR, June 9 — Both the police and the national anti-graft agency must respond to claims by blogger Raja Petra Kamarudin that police found no proof of unusual wealth in the assets of deceased Customs officer Ahmad Sarbaini Mohamed, Lim Kit Siang said today.
The DAP parliamentary leader said the authorities should not wait for an inquest or a royal commission of inquiry (RCI) to confirm or deny the allegations, especially as this was the second mysterious death under the Malaysian Anti-Corruption Commission’s (MACC) watch.

The Attorney-General Tan Sri Gani Patail and the Inspector-General of Police Tan Sri Ismail Omar should accede to the most reasonable request of Sarbaini’s family that police reveal its probe into the senior custom officer Ahmad Sarbaini’s death at MACC premises at Jalan Cochrane on April 6 before any inquest is decided upon.
In this connection, both the police and the MACC owe the Sarbaini family and the Malaysian public a response and explanation on the revelation by blogger Raja Petra Kamaruddin that the police had conducted a thorough check on Ahmad Sarbaini’s assets and found no “unusual or extraordinary” wealth.

DAP stalwart and Ipoh Timor MP Lim Kit Siang has called on the prime minister and cabinet to override the police and attorney-general’s (AG) call for an inquest into senior customs officer Ahmad Sarbani Mohamed’s death, and replace it with a full-blown royal commission of inquiry (RCI).
Lim (left) said such a move will restore public confidence in national institutions and also in the prime minister and cabinet.

KUALA LUMPUR, June 7 — A royal commission of inquiry (RCI) looking into Customs officer Ahmad Sarbaini Mohamad’s death would restore public confidence in the country’s institutions, Lim Kit Siang has said.
The DAP parliamentary leader said Cabinet should be prepared to override the Attorney-General (A-G) and the police tomorrow as an RCI, like the one established for Teoh Beng Hock, was the only way to determine the cause of Sarbaini’s death.

There should be a Royal Commission of Inquiry into Sarbaini’s death at MACC

The authorities concerned should learn from the unsatisfactory outcome in the Teoh Beng Hock inquest and have a Royal Commission of Inquiry straightaway into senior Customs officer Ahmad Sarbaini Mohamad’s death – second fatal fall-from-height incident at MACC premises in the short history of MACC.
The conduct of the MACC, the police, the Attorney-General’s Chambers and the Cabinet have been most unsatisfactory to date – taking two long months for the police and the Attorney-General’s Chambers to recommend that an inquest be held.
Clearly, the inquest proposal is strongly opposed by the MACC, which had right from the beginning disclaimed any responsibility for Sarbaini’s death – just as it had disclaimed responsibility for Teoh Beng Hock’s mysterious death falling from 14th floor of MACC hqrs at Shah Alam on July 16, 2009 – even suggesting that Sarbaini had committed suicide, just like in Teoh Beng Hock’s case: that Beng Hock committed suicide, or “honour suicide” and even making the outrageous suggestion that DAP had murdered Beng Hock at the MACC hqrs!
