SEPT 2 — An internet blackout day was declared in Malaysia on 14 August 2012.
This was in protest against Section 114A of the recently-amended Evidence Act, which enables the authorities to act firmly against individuals who post defamatory, inflammatory and/or seditious content on the Internet.
The law not only holds the user/blogger potentially accountable for the offending post(s) but also any individual or organisation connected to the objectionable website or blog such as a person who: owns, administers or edits the website; is registered with the network service provider; and is in custody or control of the computer at the time the offence was committed.
These new amendments have alarmed many netizens and civil society groups because of the legislation’s wide scope and the heavy onus placed on the accused to prove his or her innocence. Many individuals have interpreted these amendments as an attempt by the Malaysian government to stifle internet freedom. The Stop 114A campaign was spearheaded by the Centre for Independent Journalism (CIJ), a civil society group, but it soon attracted support from several prominent civil society organisations, bloggers and opposition parties.
In the wake of Internet Blackout Day, the Najib administration promised to re-evaluate Section 114A, with the prime minister assuring the public that ‘Whatever we do, we must put the people first’. While this outcome may be interpreted as a success for online activism in Malaysia, the question this raises is whether such online activism can truly create an impact on its own or whether it needs support from opposition parties and political notables to do so. When the Prime Minister, Datuk Seri Najib Razak yesterday personally led three senior UMNO Ministers to attack the Pakatan Rakyat with the canard that PR wanted to replace the national flag Jalur Gemilang, it was more than anything else a reflection of their sense of desperation about UMNO/Barisan Nasional prospects in the impending 13th General Election than respect for the truth.
I do not believe that with all the police and intelligence resources at their command, the Prime Minister and the Home Minister, Datuk Seri Hishammuddin Hussein could be unaware that there is completely no basis whatsoever in the canard that Pakatan Rakyat wanted to change the national flag.
The change of the national flag is never a Pakatan Rakyat agenda and has never been discussed or raised in any Pakatan Rakyat meeting.
This was why I had yesterday twittered in response to the allegation that PR wanted to change the national flag:
“Never came across such scatter-brained idea before. UMNO/BN dirty-tricks dept very busy”

SEPT 1 — There are very few things that observers of Malaysian politics can regularly agree on.
However, there will be much concurrence with the suggestion that there are two significant traits for those who follow the local political scene very closely — a sense of humour, and a dose of masochism. Naturally, the agreement will be because those involved deem these traits necessary due to the ineptitude of those on “the other side”.
An unhealthy and extreme partisanship has evolved in Malaysian politics since 2008. This is even more obvious to anyone who follows political “commentary” on Twitter (to whom my use of the inverted commas would be obvious).
There is nothing wrong with a bit of banter and partisan one-upmanship. The disconcerting thing is when the immaturity comes from elected representatives, who forget (or perhaps never realised in the first place) that they are supposed to represent everyone, not just those who voted for them or their party.
Despite the frustration and disappointment, I do still follow some of these tweets, including the propaganda offered by full-time political commentators who are prominently featured in national newspapers. I did mention masochism earlier on.
However, the recent discussions about the Merdeka theme have taken things beyond what should be acceptable to any Malaysian, political or not.
I waited some time before putting my thoughts into writing, as I harboured some hope that the theme would be scrapped following the incessant criticism. Perhaps those responsible would hold their hands up and admit that it was a mistake? Silly me. Read the rest of this entry »

Datuk Seri Najib Razak did not conduct himself as Prime Minister for all Malaysians when he divided the people on Merdeka Day and urged Malaysians to “defend independence” against Pakatan Rakyat.
In his closing speech at the “Merdeka 55: Janji ditepati” gathering at the Bukit Jalil National Stadium last night, Najib called on the audience “to defend the nation’s independence from enemies and the opposition alike”. (Malaysiakini/The Malaysian Insider)
He said:
“Ladies and gentlemen, remember that independence only knocks once for any nation. Let us close ranks and defend our independence with a solid front, at every corner and at any time.
“Even more so when enemies and the opposition are trying to bring chaos into the situation.”
This the final and ultimate proof that the 55th Merdeka Day celebrations had been hijacked by UMNO/Barisan Nasional as part of their desperate gambit to hang on to power in the impending 13th General Election – which had been evident when the UMNO/BN election theme of “Janji Ditepati” had been imported lock, stock and barrel to be elevated as the 55th Merdeka Day/49th Malay Day theme. AUG 30 — A very young demographic profile, a high urbanisation rate, ever increasing access to the Internet and extreme longevity in power, among other factors, will be working against the ruling coalition in Malaysia’s coming election.
There are many reasons for the international community to be deeply cognisant of this fact, and to prepare for a regime change in that country for the first time since it gained independence in 1957.
Soon after the government suffered severe setbacks in elections held on March 8, 2008, the country went into a permanent campaign mode, and has remained that way ever since.
A general election have to be called soon, since the Malaysian Constitution requires that Parliament be dissolved by 28th April 2013 upon the completion of its five-year mandate. Read the rest of this entry »

The Cabinet tomorrow must place on top of its agenda the very serious allegations of fake crime statistics to give the false and misleading picture of “Big Wins” and “Big Fast Results” milestones in the Reducing Crime NKRA, claiming a dramatic reduction of 35% in Street Crime and 15% in Index Crime in 2010, followed by a further drop of 39.7% in Street Crime and 11.1%drop in Index Crime in 2011 – hailed as “the highest drop ever since Independence”.
Yet Malaysians have never been more afflicted with the debilitating “fear of crime” – whether the fear of taking a neighbourhood stroll with the family or the fear of going out at night!
I hope there are courageous and fearless Ministers who dare to speak up at the Cabinet meeting tomorrow to point out that the week-long deafening silence to the very credible expose by the “whistleblower” 30-year police officer of how crime statistics have been doctored to give the false picture of “Big Wins” and “Big Fast Results” in the Reducing Crime NKRA in the past two years is the greatest disservice to the present administration.
The Cabinet must take full cognizance of the inescapable fact that continued silence on the part of the authorities concerned and failure to rebut the very credible account of fake crime statistics by the “whistleblower” police officer would rubbish all the Government Transformation Programmes (GTP) and Economic Transformation Programme (ETP) claims of success and “Big Fast Results”.

Was Najib aware of doctored crime statistics which caused him to single out a “safe Malaysia” as the theme of his Hari Raya message last week?

When in his Hari Raya message last week the Prime Minister, Datuk Seri Najib Razak pledged “a safe Malaysia” by assuring that all agencies responsible will be more effective in tackling crime to enhance security in the country, it raised eyebrows and queries among thinking Malaysians for two reasons:
Firstly, the assurance of a safe country is the most basic and fundamental duty of any functioning and successful government. The Barisan Nasional Government has claimed to be a very successful government, even making the Barisan Nasional election theme “Janji Ditepati” the 55th Merdeka Day/49th Malaysia Day theme! Why then the need to make such a pledge after 55 years of governing the country, unless Malaysia is no more as safe a country for its citizens, investors and tourists as in the past decades?
Secondly, the “safe Malaysia” theme of Najib’s Hari Raya message is even more baffling when his government has been trumpeting its extraordinary success and “Big Wins” in its Government Transformation Programme (GTP) and National Key Result Area (NKRA) in reducing crime – i.e. in 2011, drop in street crime by 39.7% and drop in overall crime index by 11.1% although Malaysians have never felt so unsafe in public places or even in the privacy of their homes!

At last, Malaysians appear to have got the answer to the three-year mystery why Malaysians suffer increasing fear of crime in the midst of official claim of drastic fall in crime rate.
This came in the form of an email from a righteous and patriotic police officer with more than 30 years in service, which I received on Tuesday, 21st August, during the last day of my four-day 500-km visit to Sabah interior.
The email, under the subject “Crime Statistics – Let the truth be told”, had also been sent to other receipients and has since been published widely on news portals and websites.
In the email, the police officer who said he wished to remain anonymous, wrote:
“The police and Pemandu have feigned ignorance about the crime statistics manipulation. The figures dished out does not reflect the actual crime situation. How the figures were doctored is explained in the attached article. In fact the police and Pemandu knows about the manipulation but unable to undo the wrong.
“The public’s fear is justified. The police are in the wrong track of tackling crime.”

AUG 24 ― Crime is an issue of great concern to everyone in the country. This is why it is necessary for the authorities to respond as soon as possible to the whistle-blowing letter from a police officer of over 30 years experience and his allegations of the doctoring of the official statistics. The longer the delay, the greater will be the impression that a cover up is taking place.
This disclosure of massaging and manipulation of the official statistics has been the hottest news over the internet media in the last few days and it has now been picked up by the opposition politicians.
To ensure that it does not become a political football and to preserve whatever trust and respect that the public has for the Barisan Nasional government’s statistics, especially related to the Government Transformation Programme, I would like to provide some advice to the Najib administration. PENANG – The defection of two key ruling coalition parliamentarians to the political opposition has shifted Malaysia’s pre-election equation and highlighted the importance of the crucial swing states of Sabah and Sarawak in what is expected to be a neck and neck contest.
Historically a “fixed deposit” of votes for the Barisan Nasional (BN), the coalition that has ruled the country consecutively since independence from colonial rule, Sabah and Sarawak are expected to play a prominent role in the coming general election pitting Prime Minister Najib Razak versus opposition leader Anwar Ibrahim.
BN won 140 of 222 federal parliament seats at the 2008 elections, a result that saw the Pakatan Rakyat opposition win control of five of 13 federal states. After the recent defections, BN holds 20 of 25 federal parliament seats allocated to Sabah and 29 of 31 in Sarawak on the island of Borneo.
If the recent defections signal a gathering trend away from BN, as some political analysts suggest, the two states have the potential to swing the next general election in favor of the opposition. The present parliamentary term expires in April 2013 and general elections must be held by October, although Najib has the prerogative of calling a snap election at any time. Malaysiakini reported today that outspoken former Malaysian Anti-Corruption Commission (MACC) panel member Tan Sri Robert Phang has been cleared of the corruption allegations made against him.
This follows the confirmation by the MACC director of investigations Mustafar Ali in an SMS in response to a query from Malaysiakini.
Phang had been issued with a letter from Mustafar, dated November last year, clearing him of the allegation made by an anonymous blogger.
However, the letter from the MACC that cleared Phang also stated that it cannot be used for the purpose of publication by the media.
The MACC Chief Commissioner Datuk Abu Kassim Mohamed should be censured in Parliament if he cannot give satisfactory explanation why MACC suppressed information for some 15 months that Phang had been cleared of corruption allegations made against him.
In this connection, the Chairman of the MACC’s Operations Review Panel, Tan Sri Hadenan Abdul Jalil should also explain why he withheld information about Phang being cleared of corruption allegations some 15 months ago in May last year. Read the rest of this entry »

The world is on the brink of an economic crisis and the consequences are likely to be dire.
The current state of the global economy presents multiple challenges to Malaysia. While the effects will first be felt within the economic sphere, they will also have a significant impact on domestic politics. This will add to the prevailing state of political uncertainty.
Some of Malaysia’s key trading partners are already struggling economically. The crisis rocking the euro zone has received a considerable amount of analysis, but the economic situation in other countries also merits attention.
The performance of the US economy is a concern for Malaysia. US GDP, which saw growth of 3 per cent in the fourth quarter of 2011, decreased to 1.9 per cent growth in the first quarter of 2012. Growth in the US hardly recovered, but whatever recovery it had achieved now appears shaky. Analysts put the forecast for US growth at 1–1.5 per cent for 2012. Some have raised the probability of a recession to 50 per cent. The unemployment rate has not budged from 8.2 per cent, as the increase in employment opportunities has not kept pace with population growth.

Pemimpin Umno masih lagi menyandarkan optimism kepada kaji selidik mereka. Tapi bolehkah hasil kajiselidik ini dipercayai? Semua orang tahu, kaji selidik Umno ditambah 30%. Ertinya, kajiselidik Umno hanya 70% tepat. Dalam bahasa mudah, jika kajiselidik Umno kata dia akan menang 100 kerusi parlimen, mereka akan menang 70 kerusi. Itu pun jumlah kerusi yang Umno akan menang kali ini.
Kenapa Najib lambat buat pilihanraya? Ramai orang lupa saya lama menjadi AJK Umno bahagian Pekan dan jadi ketua penerangan Umno bahagian. Najib lambat kerana dia tidak yakin dengan hasil kajian ejensi-ejensi yang diupah kerajaan. Kecuali dia sudah yakin, baharulah dia akan buat pilihanraya. Prominent, though not necessarily cerdik, Malaysians evidently love to make inane comments. And in public at that. It’s, like, become a national pastime.
Politicians do it all the time. And since the mainstream Malaysian media of the press and television virtually only provide coverage of BN politicians, it often seems as though it’s only BN politicians, invariably from Umno, who were born with foot in mouth disease.
Or were trained as performing berok.
That’s the small price you pay, I guess for not providing non-BN politicians and members of civil society access to the media that everybody knows you own.
But while BN politicians seem to have a monopoly on making stupid public statements, once in a while we do get others, often their apparatchiks, elbowing their way in, equally anxious to make utter ninnies of themselves.

Najib to Reassess Malaysian Web Law

Malaysian Prime Minister Najib Razak took to microblogging site Twitter on Tuesday to say that he will ask his government to reassess a new law that critics say could restrict online freedoms.
Throughout the day, Malaysians surfing popular blogs and some political websites were greeted by pop-up banners and blacked-out pages prepared as part of a concerted campaign against section 114A, a controversial amendment to the country’s Evidence Act. The law holds owners of Wi-Fi connections or editors of blogs or forums legally accountable for any seditious or defamatory material spread through their accounts or websites.
A series of prominent websites, including those of the Malaysian Bar Council, the opposition Democratic Action Party, and news portals Malaysiakini, Free Malaysia Today and BFM Radio, were either blacked out voluntarily or featured a pop-up message: Stop 114A.
