The Anwar Government should give priority to legal reforms to ensure that the abuses of Security Offences (Special Measures) Act 2012 (Sosma) in the last decade to muzzle corruption scandals, promote free and fair elections, and to arrest Malaysians in non-existing links with Tamil Tigers could not be repeated

The SOSMA abuses in the last decade include:

  1. The arrests of Khairuddin Abu Hassan and his counsel Matthias Chong to prevent them from launching an international campaign to expose the 1MDB scandal. In fact, Khairuddin won a lawsuit for wrongful detention against the government and was awarded RM300,000 in damages and RM50,000 in costs.
  2. The arrest former Bersih 2.0 Chairperson and former Petaling Jaya Member of Parliament, Maria Chin Abdullah for Bersih campaign for free and fair elections.
  3. The arrest of former DAP Malacca Executive Councillor and State Assemblyman, G. Saminathan and Negeri Sembilan State Assemblyman P. Gunasekaran for alleged links to the LTTE, claiming that they were part of a plot to attack the Sri Lanka Commission in Malaysia.
  4. A total of 33 families in Sungai Petani, Kedah, who were left in the lurch after police arrested their sole breadwinners under the Security Offences (Special Measures) Act 2012 (Sosma) in 2020 after over two years later, the men aged 22 to 60 are still in remand waiting for their court hearing, after being subsequently charged under the Penal Code.

It was because of these SOSMA abuses that 88 Pakatan Harapan MPs voted against then the extension of Subsection 4(5) of the Security Offences (Special Measures) Act 2012 (Sosma) for another five years in July this year.

The Home Minister at the time and now the Opposition Leader Hamzah Zainudin, while winding up the Sosma motion debate in July this year, agreed with the government and opposition lawmakers on the existence of unfair provisions and clauses in the Act.

Hamzah said the cabinet led by Dr Mahathir Mohamad agreed on Nov 29, 2019, to make an amendment to Sosma.

Hamzah said the Ismail Sabri administration needed more time to execute what the cabinet decided in 2019 as it needed to engage with stakeholders, including the police.

The Anwar Government should complete the Ismail Sabri’s government consultations on the repeal of the draconian provisions in SOSMA, and bring the amendments to SOSMA to Parliament in the February session to prevent a repeat of the abuses of SOSMA in the last decade.

Kerajaan Anwar perlu memberikan keutamaan terhadap reformasi undang-undang untuk memastikan salah guna SOSMA dalam dekad yang lepas untuk menutup skandal rasuah, untuk menyekat kempen pilihan raya yang bebas dan adil, dan untuk menangkap rakyat Malaysia yang tidak mempunyai apa-apa kaitan dengan Tamil Tigers tidak berulang lagi

Kerajaan Anwar perlu memberikan keutamaan terhadap reformasi undang-undang untuk memastikan salah guna Akta Kesalahan Keselamatan (Langkah-langkah Khas) 2012 (SOSMA) dalam dekad yang lepas untuk menutup skandal rasuah, untuk menyekat kempen pilihan raya yang bebas dan adil, dan untuk menangkap rakyat Malaysia yang tidak mempunyai apa-apa kaitan dengan Tamil Tigers tidak berulang lagi.

Antara contoh salah guna SOSMA dalam dekad yang lepas:

  1. Penangkapan Khairuddin Abu Hassan dan peguamnya, Matthias Chong, untuk mengelakkan mereka dari melancarkan kempen antarabangsa untuk mendedahkan skandal 1MDB. Malah, Khairuddin telah menang saman penahanan tidak sah terhadap kerajaan dan dianugerahkan ganti rugi sebanyak RM300,000 dengan RM50,000 kos.
  2. Penangkapan bekas Pengerusi Bersih 2.0 dan bekas Ahli Parlimen Petaling Jaya, Maria Chin Abdullah, kerana kempen Bersih untuk pilihan raya yang bebas dan adil.
  3. Penangkapan bekas ADUN DAP dan EXCO Melaka, G. Saminathan, dan ADUN DAP Negeri Sembilan, P. Gunasekaran, atas dakwaan kononnya terdapat hubungan dengan LTTE, mendakwa yang mereka adalah sebahagian daripada rancangan untuk menyerang Pesuruhjaya Tinggi Sri Lanka di Malaysia.
  4. Sejumlah 33 keluarga di Sungai Petani, Kedah, yang berhadapan dengan kesusahan selepas pencari nafkah dalam keluarga mereka ditangkap di bawah SOSMA pada tahun 2020. Dua tahun kemudian, mereka yang berusia di antara 22 ke 60 tahun ini masih di bawah tahanan reman sambil menunggu perbicaraan mahkamah mereka, selepas didakwa di bawah peruntukan Kanun Keseksaan.

Kerana salah guna seperti inilah 88 orang Ahli-ahli Parlimen Pakatan Harapan mengundi untuk menentang pelanjutan Subseksyen 4(5) Akta Kesalahan Keselamatan (Langkah-langkah Khas) 2012 (SOSMA) untuk lima tahun lagi pada bulan Julai tahun ini.

Menteri Dalam Negeri ketika itu, yang kini menjadi Ketua Pembangkang, Hamzah Zainudin, semasa dalam penggulungan perbahasan usul berkenaan SOSMA ini bersetuju dengan Ahli-ahli Parlimen Kerajaan dan Pembangkang yang menyatakan bahawa terdapat peruntukan dan klausa yang tidak adil di dalam Akta ini.

Hamzah mengatakan yang kabinet yang diketuai oleh Dr Mahathir Mohamed bersetuju pada 29 November 2019 untuk membawa pindaan kepada SOSMA.

Hamzah mengatakan yang pentadbiran Ismail Sabri memerlukan lebih banyak masa untuk melaksanakan keputusan kabinet yang dibuat pada tahun 2019 kerana mereka perlu melaksanakan libat urus bersama dengan pemegang taruh, termasuklah pihak polis.

Kerajaan Anwar perlu menyelesaikan sesi libat urus mengenai penghapusan peruntukan zalim dalam SOSMA yang dimulakan oleh pentadbiran Ismail Sabri ini dan bentangkan pindaan-pindaan yang perlu ke Parlimen dalam sidang bulan Februari untuk mengelakkan dari berulangnya salah guna SOSMA yang pernah berlaku sebelum ini.

    LKS, can the Minister of Transport explain what PM Anwar said: truly mind boggling that KL (Dec 21): ECRL will proceed at RM74.96b and savings of RM11 billion achieved? ARe we living in dreamland or another scandal on the way?

    Even under the Najib regime in 2016-2017, the ECRL kicked off at RM65.5 billion.

    Duplication, triplication, now quadruplication. Is the govt sincere and working well? 1. First the KSN was told to prepare a comprehensive plan to solve the Kos Sara Hidup issues, given TWO WEEKS to prepare the comprehensive plan (from 27th November 2022). Missing the comprehensive plan. Merry Christmas

    2. Then on Dec 3rd 2022 the new Cabinet was announced which included the Kementerian Perdagangan Dalam Negeri Dan Kos Sara Hidup headed by Salahuddin Ayub. So there is a full Cabinet Minister dedicated to deal with Kos Sara Hidup. Great.

    3. Then there is also that “federal level task force to deal with the rising cost of living, the National Action Council on Cost of Living” also known as NACCOL.

    4. Now (according to The Vibes ) Zahid has been instructed “to form a new cost of living implementation and monitoring committee along with other responsible ministers and their ministries to help deal with the issue more effectively”. 

    How will these four different outfits tackle Kos Sara Hidup issues. The more the merrier. Just four weeks and they already have two Federal level committees, one Ministry and the KSN’s plan to tackle Kos Sara Hidup.  Are you all serious?
