The Yang di Pertuan Agong should ask the Judiciary for its opinion as to whether Article 150 of the Constitution allows the proclamation of Emergency and suspension of Parliament to enable the Prime Minister to resolve his political problems

Before yesterday, nobody discussed Article 150 of the Proclamation of Emergency as a possible solution to the Covid-19 pandemic.

The reason was simple. Only the most desperate or the most mediocre Prime Minister would seek to invoke Article 150 of the Constitution to proclaim an emergency to deal with the Covid-19 pandemic, as there is nothing which the Government cannot do presently to fight the war against the Covid-19 pandemic but which requires a proclamation of emergency to empower the government to do so.

As of yesterday, Sabah has 6,827 Covid-19 active cases, followed by Selangor 960, Kedah 586 and Penang 372, while the rest of the states have less than 200 active cases, with Kelantan, Pahang and Perlis less than 10 active cases.

Is the Proclamation of Emergency going to be confined to Sabah?

How can there be justification for the imposition of a state of emergency in Sarawak, Malacca, Johore, Putrajaya, Terengganu, Kelantan, Pahang and Perlis which have all less than 100 Covid-19 active cases each?

Has the government lost control of the Covid-19 pandemic in Kedah, Penang, Kuala Lumpur, Perak and Negri Sembilan as to justify the proclamation of emergency under Article 150 of the Constitution for these states?

Yes, there is a need for more effective action against the third wave of the Covid-19 pandemic, and what is urgently needed is to forge an “all-of-government” and “whole-of society” campaign against the third wave of the Covid-19 epidemic.

Will the proclamation of emergency and the suspension of Parliament forge such an “all-of-government” and “whole-of-society” approach?

I dare say the opposite is more likely, as the people can see that the very persons who had undermined such an “all-of-government” and “whole-of-society” approach are none other than the Perikatan Nasional Ministers and leaders themselves.

Furthermore, why must Parliament be suspended in a proclamation of emergency to fight the third wave of the Covid-19 pandemic.

Did the Cabinet present to the Yang di Pertuan Agong the option of a proclamation of emergency without suspension of Parliament?

And will Malaysia proclaim an emergency every time there is a new wave of the Covid-19 pandemic?

May be, the Yang di Pertuan Agong should ask the Judiciary for its opinion as to whether Article 150 of the Constitution allows the proclamation of Emergency and suspension of Parliament to enable the Prime Minister to resolve his political problems.

Yang di Pertuan Agong patut mendapatkan pendapat pihak Kehakiman sama ada Perkara 150 Perlembagaan Persekutuan membenarkan perisytiharan darurat dan penggantungan Parlimen untuk membolehkan Perdana Menteri menyelesaikan masalah politik beliau

Sebelum semalam, tidak ada sesiapun membincangkan mengenai Perkara 150 Perlembagaan Persekutuan mengenai Proklamasi Darurat sebagai penyelesaian wabak Covid-19.

Sebabnya mudah. Hanya Perdana Menteri yang paling terdesak dan lemah sahaja yang akan terfikir untuk menggunakan peruntukan Perkara 150 ini untuk mengisytiharkan darurat bagi melawan wabak Covid-19, memandangkan tidak ada perkara yang kerajaan tidak boleh lakukan sekarang ini untuk melawan wabak ini tanpa perisytiharan darurat.

Setakat semalam, Sabah mencatatkan 6,827 kes aktif Covid-19, diikuti dengan 960 kes di Selangor, 586 di Kedah, dan 372 kes di Pulau Pinang, manakala kesemua negeri-negeri lain mencatatkan kurang daripada 200 kes aktif, dengan Kelantan, Pahang, dan Perlis mencatatkan kurang daripada 10 kes aktif.

Adakah Proklamasi Darurat ini akan hanya digunapakai di Sabah?

Bagaimanakah perisytiharan darurat ini wajar untuk dilaksanakan di Sarawak, Melaka, Johor, Putrajaya, Terengganu, Kelantan, Pahang, dan Perlis sedangkan ke semua negeri-negeri ini mencatatkan kurang daripada 100 kes aktif Covid-19?

Adakah kerajaan telah hilang kawalan terhadap wabak Covid-19 di Kedah, Pulau Pinang, Kuala Lumpur, Perak, dan Negeri Sembilan sehingga ia merasakan wajar untuk mengisytiharkan darurat di bawah peruntukan Perkara 150 Perlembagaan Persekutuan di negeri-negeri ini?

Ya, terdapat keperluan untuk satu tindakan yang lebih berkesan terhadap gelombang ketiga wabak Covid-19 ini, dan apa yang kita perlukan segera adalah untuk membentuk satu kempen dan pendekatan yang melibatkan “keseluruhan kerajaan” dan “keseluruhan masyarakat” dalam melawan gelombang ketiga wabak ini.

Adakah proklamasi darurat dan penggantungan Parlimen ini akan membentuk usaha melibatkan “keseluruhan kerajaan” dan “keseluruhan masyarakat” ini?

Saya berani katakan, yang perkara berlawanan yang akan berlaku, memandangkan rakyat akan dapat melihat individu yang telah merendah-rendahkan usaha melibatkan “keseluruhan kerajaan” dan “keseluruhan masyarakat” adalah tidak lain tidak bukan daripada para menteri dan pemimpin Perikatan Nasional sendiri.

Tambahan lagi, mengapakah Parlimen perlu digantung dalam proklamasi darurat untuk melawan wabak Covid-19?

Adakah Kabinet telah membentangkan pilihan untuk mengisytiharkan darurat tanpa menggantung Parlimen kepada Yang di Pertuan Agong?

Dan adakah Malaysia akan mengisytiharkan darurat setiap kali berlakunya gelombang baharu penularan wabak Covid-19?

Mungkin Seri Paduka Baginda Yang di Pertuan Agong patut mendapatkan pendapat pihak Kehakiman, sama ada Perkara 150 Perlembagaan Persekutuan membenarkan perisytiharan darurat dan penggantungan Parlimen bagi membolehkan Perdana Menteri untuk menyelesaikan masalah politik beliau.

    Truth is an election will worsen the pandemic possibly beyond our medical system to cope. The Agung may just favor Muhiyiddin to allow him to declare emergency because he really does not fancy the alternatives.
