i have been informed that Raja Petra Kamaruddin has been ordered to surrender himself at the Jalan Duta magistrate’s court at 9.30 am tomorrow to be charged with sedition.
I have not been able to contact RPK to get confirmation.

Penang education director stops DCM from distrubuting spectacles to poor students
GEORGE TOWN (May 5, 2008): Last year, prescription spectacles were distributed to poor students in several Tamil schools without a glitch but when the state executive councillor for education tried to carry on with the programme now, he was stopped from doing so by the state Education Department.
Dr P. Ramasamy, who is also the deputy chief minister II, informed the state Education Department of his intentions to distribute spectacles to 223 pupils from 11 Tamil schools in Seberang Perai Utara.
“We planned to do it on May 12 during school hours in a Tamil school in Jawi so that it is easier for the pupils to turn up and receive the spectacles,” he said.
However, the department told Ramasamy they are not allowed to go ahead with the programme during school hours.
“They told us that it would disrupt the schooling hours of the pupils so we should not organise it during school hours,” he told a press conference today.

1.Are the immigration records so unsecured that files can be deleted?

Somebody is ranting again! I never said he would be found guilty - certainly not when he was not even charged for anything.
Those comments were made on another thread in the context of the discussion of whether there was basis for a sedition charge since what was obvious was that RPK made comments sub judice when he wrote about the Altantuya murder case - a matter involving contempt of court and nothing seditious. I thought so initially. My opinion when reading the entire article later, however, was that there was enough material in that article to support a charge for sedition. Whether he would be found guilty or not is another matter which would be decided by the courts applying the high criminal standard of proof beyond reasonable doubt.
Readers would appreciate that that is different from saying that I want RPK to be charged for sedition!
Of course, you can depend on limkamput who clearly is on Prozac or some other psychotropic drugs not to see the difference. Godfather and I have been advising him many times not to self-medicate and see his doctor but he won’t listen!

Under the Sedition Act, the intention of the person charged – whether he intended or attempted to be seditious is irrelevant. The offence of sedition will be made out if act, speech, word, publication has, in language of section 3(1) of the Act, a “seditious tendency”. There is a seditious tendency if it excites disaffection amongst the people and brings into hatred or contempt both the government and the country’s administration of justice…..
The case against RPK for his article “Let’s Send The Altantuya Murderers To Hell” will most likely focus on that part of what he wrote, which is not part of public knowledge, still a rumour, unproven as to facts which (hint hint) begins with : “Rumour has it, and it remains just that, a rumour, is that all this ‘evidence’ has been given to….”
I don’t even dare to repeat it in fear of being also charged for sedition and I advise that you don’t too.

What authorities don’t seem to grasp is that they are not dealing with a simple sedition case by ordinary print…..What RPK is alleged to have committed is a cyber offence of using cyber space and blogosphere to write allegedly seditious postings. This has implication because it attracts vexed legal complications involving international versus domestic laws……
The first question/challenge to the Prosecution will be : is it the intent of Sedition Act 1948 extraterritorial in its application? Is it intended to apply to people allegedly making seditious postings under our Sedition Act in America???
This cannot be - because in US (the domain of MalaysiaToday) our narrow terms of what is sedition don’t apply. Internationally other countries may subscribe to the UN’s Convention of Human Rights so by international law and convention (by which Malaysia is also governed), Malaysia cannot impose her domestic laws on the international scene (the same reason by cruse ships operate their casinos in international waters).
For if every national member of the international community were to do so, there would be international chaos and conflicts which international law seeks to prevent….
Even big bully USA [which sent the marines in 1989 to Panama to arrest and whisk away General Manuel Antonio Noreiga to South Miami-Dade prison] generally recognise that US domestic laws do not apply out of the US other than very exceptional cases where the particular US legislations evince an explicit and affirmative intent to apply extraterritorially…If there were no such explicit and affirmative intent expressed in the particular domestic law, then it must be presumed to the contrary that it did not intend to risk “international discord” to apply extraterritorially…..
The same may be said of our Sedition Act. If this is correct, then Undergrad2 is free to post seditious statements here with impunity, immune from the long arm of Malaysian laws with dire consequences to Uncle Kit who hosts this blog unless this blog one like MalaysiaToday has its domain name registered in (say) Iceland, server in Barzil with the blog sitting in the US!

RPK is in fact spoiling for a legal battle to test and set legal precedents for cyber and international law.
These are complicated questions. I am not sure our prosecutors/lawyers are experts in this new field.
To fight this case (along the lines suggested above) will take 5 years at least, having regard to the complexities of the issues by which time Pakatan Rakyat might have by then formed the government….
And in the meanwhile, the complexities of the issue, of which local lawyers and prosecutors have not much knowledge or experience in, will justify RPK’s appointment of the real QCs (Queen Counsels) specializing in Cyber laws to argue the case here, raising the international profile of the Altantuya Shaariibuu’s murder case and its proceedings so far (like the way Hindraf raised international profile of Tamil Indian plight here) – the last thing the Powers-That-be can afford.
They are ill advised to charge RPK : he is maneuvering them to an eventually unacceptable position, in my humble view.
Which is why, as I said before in my earlier posting, somebody is making a terribly big mistake, and I don’t think it is Raja Petra Kamaruddin, the webmaster of news portal Malaysia Today, who until now is still ahead in the game….

The dictionary meaning of sedition is “incitement of resistance to or insurrection against lawful authority” (see Merriam-Webster.com).
Can one person’s words and or actions give rise to “incitement of resistance to or insurrection” against the BN Government?

If there is incitement, then is there resistance or insurrection arising from it?

I am sorry to disagree with you all. There are ways to stand for justice and freedom and people like LGE and Uncle Kit have done it time and time again.
But RPK’s style of “fighting” do not subscribe to ethics, fairplay and truth. He is obviously highly biased, but the way he goes about mixing facts and fiction without adhering to the fundamental tents of good and ethical journalism is high objectionable.
Many people find him entertaining and would love to believe him but personally I find him not above using half-truths and fiction to attack his enemies.
Let’s not our political beliefs cloud our ethical and moral compass. RPK is not being held under ISA but charged in the open court of law and he has the right to defend himself.

This is obviously a political prosecution. The full weight of the police, the AG’s Chambers and the judiciary are being imposed on one man. Ask the police how many murders there are in Bolehland recently, and how many remain unsolved ? Ask Gani Patail his success rate recently in high profile cases that were supposed to be “watertight”. While I pity RPK for being potentially jailed or severely fined under the Sediction Act, the law in place has to be respected by all. Spreading malicious rumours could be a complication of everyday’s life but to the affected person may also result in loss of face and severe repercussion on his or her image. Let’s see examine the case of RPK. Do you think based on principles of fairness and justice, RPK has maintained a high standard of journalism and integrity ? While RPK complains so bitterly about the mainstream media, has RPK himself practised ethical and fair reportage ? RPK is a classic case of “cakap tak serupa bikin”.
I would say that RPK’s blog enjoys much popularity for its entertaintment value rather than truthful and bold reporting. Most people defend him not because he stands for justice but because he stands against BN.
The only reason why he has escaped lawsuits so far because of his royal connections. However, in the much changed Post-March 8 period, this protection is as useful as IP rights law in China.
If DPM sues RPK for slandering, then he will be deemed to beinterferring with the course of justice as the case is on going. Even if this is not the case, RPK will claim that the DPM using his position to silence the political opponents from speaking out. This stance is nothing new, a common strategy adopted by those who have no evidence to back up wild allegations.
If RPK really courageous, then he should welcome the opportunity to present the evidence that he has so that skeptics like myself and the rest of the world can be convinced. If he can’t then he should shut up and apologise to all concerned. I am sure RPK also knows that with holding evidence is a crime as well.

Raja Petra was granted a bail of RM5,000/- which he refused to post, deciding instead to remain in custody until the hearing date(s) Oct 6 to 10 - 5 months from now!
His act of electing to remain in custody, when posting bail of RM5,000 is not a problem, baffles me in a disconcerting way. I don’t know why he is doing this and what great point he is trying to prove. To me it makes no sense.
First of all, the charge may be withdrawn but even if it were not, it may not, in law, stick and be thrown out by the court – so why stay 5 months in Sungai Buluh prison under remand for nothing?
Secondly, even if the charge were considered by the court as proven, RPK might as first offender be imposed a short custodial sentence of (say) two months imprisonment, so why serve 5 months before the trial has even begun?
Thirdly, if the logic is that RPK wants to show that the prosecution was all a political persecution of him as a martyr, again the fact that they charge him for sedition already proves that in public eyes and he does not really go into prison until October to show he is martyr for the Malaysian Cause.
Fourthly, if going on remand by refusing to post bail were a strategy to pressure authorities to unconditionally withdraw the charge, then (unless there’s prior understanding with some one at the top), there is no reason to think why such a strategy would work. After all they do not force him to go to prison; he was offered bail; he could well afford the RM5000/- bail : so if he decides not to post bail, it is RPK’s own doing and fault.
Fifth and lastly, RPK does not know the prison conditions – I hope he does not think it is great fun. He has many enemies, some in high places outside prison walls, who would wish him harm and could use inmates within the prison to put him
