Third wave of Covid 19 pandemic serious and alarming, but we must strike a proper balance as it has not reached a stage to justify a declaration of emergency and the suspension of Parliament

There have been calls for the Yang di Pertuan Agong to declare a state of emergency under Article 150 of the Constitution and suspend Parliament as a result of the third wave of the Covid-19 epidemic in Malaysia.

The third wave of Covid 19 pandemic in Malaysia is serious and alarming, but we must strike a proper balance as it has not reached a stage to justify a declaration of emergency and the suspension of Parliament.

Otherwise, Malaysia will have the dubious honour of having a backdoor government toppling a legitimate government after 22 months of a general election under the blanket of Covid-19 epidemic, sparking a second wave of the epidemic and exploiting the epidemic to present itself as the saviour of the nation as the top concern of all Malaysians was to focus single-mindedly on the war against Covid-19 whicbh the political leadership of the backdoor government did a lousy and atrocious job, sparking a third wave of the epidemic because of its lust for power to control the Sabah state government – and then declaring a state of emergency and suspending Parliament to consolidate its power and crumbling hold of a parliamentary majority.

Under Article 40, the Yang di Pertuan Agong has to act on the advice of the Cabinet in the proclamation of emergency under Article 150, as the Constitution stipulates three situations where the Yang di Pertuan Agong can act on his own discretion, namely:

(a) the appointment of a Prime Minister;

(b) the withholding of consent to a request for the dissolution of Parliament;

(c) the requisition of a meeting of the Conference of Rulers concerned solely with the privileges, position, honours and dignities of Their Royal Highnesses, and any action at such a meeting.

The Covid-19 pandemic third wave in Malaysia is serious and alarming which was why I made three calls when the Prime Minister, Tan Sri Muhyiddin Yassin was on 14-day home quarantine to summon emergency Cabinet zoom meeting to channel all available resources to fight the Covid-19 pandemic in Sabah, but it fell on deaf ears.

From the latest statistics, the total Covid-19 death toll for Sabah alone over the past 30 days was 58 against five reported in other states (Kedah 2, Selangor 1, Kuala Lumpur 1 and Perak 1).

One can understand the gravity of the Covid-19 pandemic in Sabah when compared to the Covid-19 statistics when the movement control order (MCO) was first imposed throughout Malaysia on March 18 – a cumulative total of 790 Covid-19 cases and two deaths!

Sabah’s cumulative total of Covid-19 cases yesterday registered 8,755 infections, eleven times the cumulative total of Malaysia on March 18; while Sabah’s fatalities of 67 was 33.5 times more than the two deaths when MCO was imposed on Malaysia.

Sabah has now 78.6% of the active Covid-19 cases, i.e. 6,033 out of 7,681 active cases.

The Muhyiddin Cabinet stands condemned for its failure to channel all available resources to Sabah to fight the Covid-19 pandemic, a negligence which is duplicated by the Sabah State Cabinet which has refused to appoint a State Health Minister to be the state commander-in-chief in the war against the third wave of the Covid-19 pandemic.

This omission and negligence must be immediately remedied by the Muhyiddin Cabinet and the Hajiji Sabah State Cabinet, but there is no justification for the invocation of Article 150 of the Malaysian Constitution for the Yang di Pertuan Agong to proclaim a state of emergency and to suspend Parliament.

Let us look at the Covid-19 pandemic on the global level. According to the worldometer, over 41 million Covid-19 infections and 1.1 million fatalities have been registered, with the top 20 countries as follows:

Malaysia now rank as world’s No. 88th country in terms of cumulative total of Covid-19 cases and No. 96 in terms of fatalities – which show that we are far from the situation to justify the proclamation of an emergency and the suspension of Parliament.

Gelombang ketiga Covid-19 ini adalah serius dan membimbangkan, tetapi kita perlu bertindak dengan berpatutan memandangkan wabak ini belum mencapai tahap sehingga memerlukan pengisytiharan darurat dan penggantungan sidang Parlimen

Terdapat seruan supaya Yang di Pertuan Agong mengisytiharkan darurat di bawah peruntukan Perkara 150 Perlembagaan Persekutuan dan menggantung Parlimen akibat penularan gelombang ketiga wabak Covid-19 di Malaysia.

Gelombang ketiga di Malaysia ini serius dan membimbangkan, tetapi kita perlu bertindak dengan berpatutan memandangkan wabak ini belum mencapai tahap yang memerlukan perisytiharan darurat dan penggantungan Parlimen.

Jika tidak, Malaysia akan terkenal sebagai sebuah negara yang mempunyai kerajaan pintu belakang — yang menumbangkan sebuah kerajaan yang diundi dengan sah dalam satu pilihan raya umum selepas 22 bulan mentadbir, semasa negara dilanda Covid-19, menyebabkan berlakunya gelombang kedua wabak ini di Malaysia. Gelombang kedua wabak Covid-19 ini kemudiannya digunakan oleh kerajaan ini sebagai satu alat untuk menggambarkan mereka sebagai penyelamat negara memandangkan perhatian seluruh rakyat Malaysia tertumpu kepada usaha melawan Covid-19, sedangkan perkara ini gagal dikendalikan dengan baik oleh pimpinan politik kerajaan pintu belakang ini. Perkara ini kemudiannya disusuli oleh gelombang ketiga wabak Covid-19 yang disebabkan oleh nafsu tamak kuasa untuk merampas kerajaan negeri Sabah — dan kemudiannya mengisytiharkan darurat dan menggantung Parlimen untuk membolehkannya mengukuhkan kuasa dan majoriti Parlimennya.

Di bawah peruntukan Perkara 40 Perlembagaan Persekutuan, Yang di Pertuan Agong perlu bertindak dengan nasihat Kabinet untuk mengisytiharkan darurat di bawah peruntukan Perkara 150, memandangkan Perlembagaan hanya memperuntukan tiga keadaan di mana Yang di Pertuan Agong boleh bertindak mengikut budi bicara baginda, iaitu:

(a) pelantikan Perdana Menteri;

(b) tidak memperkenankan permintaan bagi pembubaran Parlimen;

(c) meminta diadakan mesyuarat Majlis Raja-Raja yang semata-mata berkenaan dengan keistimewaan, kedudukan, kemuliaan dan kebesaran Duli-Duli Yang Maha Mulia Raja-Raja, dan apa-apa tindakan pada mesyuarat itu.

Kerana keseriusan dan keadaan membimbangkan gelombang ketiga Covid-19 inilah saya telah membuat seruan sebanyak tiga kali kepada Perdana Menteri, Tan Sri Muhyiddin Yassin semasa beliau sedang menjalani kuarantin dari rumah selama 14 hari, untuk memanggil satu mesyuarat khas Kabinet melalui Zoom untuk menyalurkan semua sumber yang ada bagi membantu usaha melawan Covid-19 di Sabah, tetapi seruan ini telah diabaikan.

Berdasarkan statistik terkini, jumlah kes kematian akibat Covid-19 di Sabah sahaja, untuk tempoh 30 hari yang lepas, telah mencecah 58 kematian, berbanding dengan lima kematian yang dilaporkan di negeri-negeri lain (Kedah 2, Selangor 1, Kuala Lumpur 1, dan Perak 1).

Keseriusan keadaan Covid-19 di Sabah ini boleh difahami dengan lebih jelas apabila dibandingkan dengan statistik semasa perintah kawalan pergerakan (PKP) mula dilaksanakan di Malaysia pada 18 Mac — sejumlah 790 kes positif dengan dua kematian!

Sabah mencatatkan sejumlah terkumpul kes Covid-19 setakat 8.755 jangkitan, sebelas kali ganda jumlah jangkitan di Malaysia pada 18 Mac; sedangkan jumlah kematian di Sabah berada pada tahap 33.5 kali ganda jumlah dua kematian semasa PKP mula dilaksanakan.

Sabah kini mencatatkan 78.6% daripada keseluruhan kes aktif, iaitu 6,033 daripada 7,681 kes aktif.

Kabinet Muhyiddin tetap bersalah kerana kegagalannya untuk menyalurkan semua sumber yang ada ke Sabah untuk membantu negeri tersebut melawan Covid-19, satu kecuaian yang diulangi oleh kerajaan negeri Sabah yang enggan untuk melantik seorang Menteri Kesihatan Negeri untuk memimpin usaha melawan gelombang ketiga Covid-19 dalam negeri tersebut.

Kecuaian dan kelalaian ini perlu diperbaiki segera oleh Kabinet Muhyiddin dan Kabinet Negeri Hajiji, tetapi tidak ada sebab mengapa Perkara 150 Perlembagaan Persekutuan untuk Yang di Pertuan Agong mengisytiharkan darurat dan menggantung Parlimen perlu digunakan.

Mari kita lihat statistik wabak Covid-19 di peringkat global. Menurut laman web World-o-meter, lebih daripada 41 juta kes dan 1.1 juta kematian telah dicatatkan, dengan 20 negara teratas disenaraikan seperti berikut:

Malaysia kini berada di tempat ke-88 dari segi jumlah kes terkumpul Covid-19 dan di tempat ke-96 dari segi jumlah kematian — yang menunjukkan situasi kita berada jauh daripada memerlukan perisytiharan darurat dan penggantungan Parlimen.

    This recent increase in cases is because of increase testing ( we have doubled our testing rate compared to May 2020 ). They are now uncovering all the stealth cases that they refuse to look for earlier. The fear is that they will use this casedemic as an excuse to put democracy in the back burner. many of us doctors see that they are playing a game. M information tells me that cases in Sabah is settling and that the wards and ICU these last 2 days are easier. Will they suspend Parliament on covid reasons? How to tell? If they are very desperate they may just do it.
