Rulers can be sued – are judges, lawyers, law professors/lecturers to be charged for treason?


The police questioned DAP National Chairman Karpal Singh for two hours yesterday in connection with 89 reports which had been lodged against him nationwide for being disrespectful to the Sultan of Perak over the most simple proposition – that rulers in Malaysia’s system of constitutional monarchy can be taken to court in their official capacities.

This is the height of nonsense in the police and the Home Ministry!

Are all the law professors and lecturers in the Malaysian universities and colleges going to be questioned by the police for the crime of treason for teaching their students that rulers can be sued in court for their official capacities?

Are all the judges and the lawyers in the country going to be charged for treason for holding that rulers can be sued in their official capacities?

The Home Minister, Datuk Seri Syed Hamid Albar and the Inspector-General of Police, Tan Sri Musa Hassan should be fully aware of this simple legal proposition or they are simply not fit to continue for a single second in their high positions and in Hamid’s case, everyone must wonder how he got his law qualifications in the first place!

Why then are Hamid and Musa condoning and pandering to such criminal activities in lodging false police reports against Karpal, which under section 182 of the Penal Code, are crimes, as the offence of “false information, with intent to cause a public servant to use his lawful power to the injury of another person”, is liable on conviction to a penalty of six months’ jail, RM2,000 fine or both.

All the 89 persons who had lodged police reports against Karpal had committed the offence of giving false information under Section 182, and the police should have opened investigations to prosecute them, instead of questioning Karpal.

The “illegitimate” MCA Perak State Exco member, Dr. Mah Hang Soon is one of the 89 who should be investigated by the police and prosecuted under the Penal Code, for he had joined the Umno and Umno Youth extremists in lodging a false report against Karpal in his capacity as Perak MCA Youth leader.

The illegitimate MCA Perak Exco member and the other 88 who had lodged false reports against Karpal cannot be such simpletons that they do not know the law that rulers in Malaysia can be taken to court in their official capacities.

If they still have doubts, the illegitimate MCA Perak Exco member and the other miscreants need only refer to the article by Dr. Shad Faruqi, Professor of Law at UiTM, in the Star yesterday, “Legal turmoil over Perak defections” where he concluded:

Treason: Opinions are being expressed that to defy the Sultan and to threaten to go to court for defence of one’s legal rights amount to treason and a ground for deprivation of citizenship. There are fundamental misunderstandings here.

From day one of Merdeka, the King and the Sultans were open to civil suit for their official actions. They were only immune personally. In 1993 even the personal immunity was taken away.

In sum it is not a violation of the Constitution to resort to the courts to seek an authoritative opinion on one’s rights and duties. Where else does one go, what else does one do, if one has a claim?

Ignorance of the law is however no defence for the commission of any crime. It may go to mitigation, and only if Dr. Mah and the other 88 are prepared to immediately admit remorse and withdraw their false reports forthwith.

Hamid and Musa have again made Malaysia into an international laughing stock. When are they going to make immediate amends?

If Hamid and Musa are not prepared to take immediate action against the 89 (including Dr. Mah) by opening police investigation papers against them, is the Attorney-General Tan Sri Gani Patail who is currently overseas, prepared to restore public confidence in the impartiality and professionalism of the law enforcement agencies by instituting criminal prosecutions against the 89 troublemakers the first thing he returns to his duties?

    We should thank Karpal for having the courage to test the courts for our basic democratic rights – otherwise that too will be taken from us.
    Unfortunately the police again come out smelling like rotten eggs as they prove yet again that they practise double standards.
    Maybe DAP can start a fund to help Karpal defend our democracy.

    Just like the EC ruling regarding the Perak two Aduns resignation letters, they are the law and worst still is they are above the law.

    We are living in a very dangerous situation where the ruling umno/bn does not go by the laws and using the pdrm and judiciary to abide to their whim and fancy.

    We can keep on highlighting their wrongs and put on record but not much we can do for now. Our only hope now is to drum up support to go for “THE CHANGE IN FEDERAL GOVERNMENT” comes the 13th GE.

    Are they simpletons or not? Malaysians are not over exposed to the letter of the Law, nor to good quality examples of its application. What did the police reports allege? I imagine there are no end of laws that might appear sufficiently applicable for a person to ‘fancy their chances’. There’s sedition and defamation for starters, and if I’m to believe what I read about a Frenchman on The Star online this week, Malaysia still has laws with ‘outrage’ in the title.

    Ignorance of the law
    In a country with selective and surprising application of law one needs to be neither a lawyer nor an intellectual to decide whether a police report is a good idea or not: ‘feeling lucky’ is probably as good as it gets. Your government once again is seeking to teach you the hazards of exercising knowledge of the law. Karpal has gone against BN’s Two Commandments: “Don’t cause trouble” and “Nobody should question”. He will be painted in the mainstream media as ignorant. More people will see that.

    not prepared to take immediate action
    BN’s police-report gophers have lodged theirs, what is DAP doing to protect Karpal? Have you lodged counter reports yet? I realise a bit of cyber c0ck-waving will go down well with the DAP faithful, but it’s not going to have much effect in the real world, is it? I don’t understand the “admit remorse and withdraw” suggestion – that strikes me as not entirely in the spirit of law and order. I think in the UK if I reported a serious offence to the police and tried to go back a few days later and say “changed my mind, no need investigate, sorry sorry ah?”, I could expect a police caution at the very least. A police caution is part of a UK citizen’s criminal record, and is to be avoided. If anybody in the UK thought they could avoid a criminal record by sucking up to the right people, there’d be a lot more crime and a lot more sucking.

    I think DAP and PR should really stick like glue to Karpal’s insistence on the law. Since in the absence of law, might is right, and BN have all the might in Malaysia, you have little else to protect you. There’s no point in hoping for a big result in GE13 if the law isn’t on your side: you’ll just find yourself locked out again as soon as the necessary deals are struck. I don’t think Karpal is risking anything (except perhaps being the victim of crime) by taking legal recourse. If his attempt succeeds, we’ll all suck up to him for free. If his attempt fails for the wrong reasons, there’s a good chance Malaysians will be more motivated to vote PR to right the wrong of a biased judiciary. If his attempt fails and the judicial review comes up with an unpredictably good reason why it must fail, then we’ll all learn something, and PR can make a more informed strategy for the future.

    All these problems just because the Perak Sultan might have erred innocently perhaps still labouring under the outdated principle that “the King can do no wrong” and even if he did, it is still never wrong.

    Should the learned Sultan be now of the opinion that he was wrong, he must not allow his error to continue for another second. For to allow his error to continue, he will now definitely be in the wrong and this will then be unforgiveable.

    The Ruler swore to defend and protect his people and to reign justly so he must act accordingly. Perhaps he is finding it difficult to reverse his error without losing his dignity and stature. So it just might be up to the politicians to sit down and find an honourable way out for him – and to correct whatever errors without going to the courts. Where is King Solomon?

    All those 89 police reports against YB Karpal for insulting the Perak Sultan have no basis whatsoever in the eyes of the country’s laws and do not hold any water at all. Every time there are controversial issues concerning the royalty, there are calls for the powers-that-be to invoke the ISA, renouncing one’s citizenship, issue banishment orders and the like. Is this the way to solve and settle the problems at hand and ignoring the due process of law?

    Those ignorant of the country’s laws should stop barking at the wrong tree and instead face stark reality and the truth. Why all the hooha and unnecessary show of emotions?

    He was ordered by the court to pay 1 Million US. No Umno guys went berserk then? No IGP came out with gun blazing then.

    Malaysian police are plain stupid. If the PM says Karpal would be investigated, then they take it as a command when the reports so filed doesn’t disclose a criminal offence.

    The police is also stupid in receiving the 89 reports when it refers to the same alleged offence of so called ‘treason’ when a report had earlier been lodged. It is a waste of police man-hour, a waste of paper, a waste of printing materials and a demonstration of sheer stupidity on the part of the police to entertain the other 88 idiots. ONE report is all that is required. The Police shld have told those idiots that A report had already been lodged and any further reports regarding the same alleged offence are sheer stupidity and waste of time.

    By investigating the case, the police exhibited another of their foolish traits when suing a Sultan or charging any sultan for committing crime is a permissible/ or MANDATORY legal process. So what offence has been investigated to merit a police investigation.

    The police would be better off investigating the swearing-in ceremony because the antagonist who were present then were installing an unlawful government to supplant a legally constituted government of the people. That is treason of the highest order.

    When people are prepared to play political dogs to Umno, then the absurd and the unthinkable which borders on sheer stupidity always happen

    Yesterday’s article by Dr. Shad Faruqi, Professor of Law at UiTM, which appeared in the Star, “Legal turmoil over Perak defections” speaks crystal clear of what the current constitutional crisis in Perak embroiled.

    What is also clear is that our rulers are not immune from prosecution personally as Mahathir himself has removed such immunity in 1993 via constitutional amendment after the incident which happened to the Sultan of Johore.

    If Karpal’s public statement that the Sultan of Perak can be sued amounted to sedition and treason by some ignorance people, then wouldn’t Mahathir committed sedition and treason in 1993?

    If Dr. Mah Hang Soon is also one of the 89 trouble-makers who lodged a police report against Mr Karpal Singh based on false accusation, then Dr. Mah is not a competent and qualified person to represent the people in the State Assembly of Perak. Dr. Mah should have resigned from the post of Chenderiang State Assemblyman immediately since the Perak people will be shameful to have such an incompetent and disqualified State Assemblyman sitting in the state legislature.

    Before the demise of Tuanku Jaafar of Negeri Sembilan, the late Tuanku had been given a court order requiring His Royal Highness to pay back his RM1 million debt to Standard Chartered Bank upon the bank’s filing petition against Tuanku. If Dr. Mah Hang Soon cared to read the domestic news in the mainstream newspaper, he should have realized that the commoners or civilians of Malaysians have been given the full rights by the Federal Constitution to file a lawsuit against the rulers so long as the Attorney-General finds that there is certain consideration to be taken as the legal basis to commence the lawsuit. Dr. Mah Hang Soon’s ignorance in this respect of the people’s basic constitutional rights has proven that MCA is just a lousy party which has been operated by some half past six cum stupidly over-zealous politicians.

    In year 2009 there has been another court created in Malaysia, i.e. EC High Court. Hope the new appointed JAC panel will appoint quite number of judges in the said court.

    Whoever has any problem with any letters can forward it to them for verification purpose.

    Good news is no lawyers need to be engaged for such cases. It will be decided open handed by the penal.

    From ISA abuse through confiscation of Suara Keadilan to charging Karpal Singh for being disrespectful to the Sultan of Perak, the Home Minister, Datuk Seri Syed Hamid Albar, had shown his incompetence in handling these cases despite having law qualifications.

    His foolish acts gave people the impression that he is very much a conservative minister who is unable to accept the reality of an ever-liberalizing world brought about by rapid globalization.

    I wonder how Pak Lah could make such a blunder in selecting the wrong person for such an important position as Home Minister.

    His continued tenure will hasten BN’s downfall in the 13th GE.

    At the rate we are going politically & legally, we will never be a developed nation. This goal will never be achieved when we have 3rd grade politicians & none other than supreme 3rd grade UK-Oxfarts (UK = Ulu Klang) grads inciting hatred & get away with it. We don’t need this kind of people in Malaysia. He is asking ex-Perak MB to be banished…he should have look in the mirror before shouting those words. If I had the power, I would banish him first.

    The same goes to the Perak fiasco created by BN – if they want to show their sincerity, BN should leave the 4 katak seats empty – probably pay more to the katak or monyet to do so – & call for by-elections themselves. The Pakatan should challenge BN to this & swallow what they (BN) preach.

    As read in Hannah Yeoh blog, the approach by Anwar was different to that of BN. As he said it very clearly, BN was all out to get Perak by hook-or-by-crook…but more crook. Our PM in waiting has shown his true colours. He want to redeem himself within BN after losing Kelantan (12th GE), PP by-election & also KT by-election. It was Pakatan-BN 3-0 score. Our PM in waiting is desperate. In desperation, BN used the powers that defy both the legal system of the country & the constitution. Looks like our only rights & power is only at the ballot box – & when that time comes, BN will sing love songs to the rakyat. After they win, they screw us all.

    It is an offence under section 182 of the Penal Code to “false information, with intent to cause a public servant to use his lawful power to the injury of another person” and “ignorance of the law is however no defence” for the commission of such offence– YB Lim Kit Siang.

    As, according to Kit, “all the 89 persons who had lodged police reports against Karpal had committed the offence of giving false information under Section 182 of the Penal Code” in respect to which ignorance of the law is not excuse, why doesn’t Karpal Singh or the DAP lodge 89 counter reports with the police against the 89 persons for the offence of giving false information under section 182 of the Penal Code?

    Let the police investigate and take Karpal’s statement in respect of the 89 police reports lodged against him – and then let the police further investigate and take the statements from the 89 who have lodged the police reports in the first instance and now have 89 counter reports made against them for making the first reports….

    Confuse the situation, give them more work lah…

    I felt so unwelcome and insecure there.
    They are so cold and not even care.
    What they care is the political order/duty from BRUMO???
    Many people never want to report to police when they get snatch, steal or rob & etc.

    The Constitution is Supreme. Whatever is mentioned in it is Supreme and shall be abided. But the Constitution can be amended by 2/3 votes in Parliment. God bless, luckily for the next 3-4 years it cannot be amended so easily in Malaysia.

    Does Anwar also want to play to the gallery of the Malays who protest againg the suit against Sultan?

    Anwar has to make a crystal clear stand in order to earn the credibility.

    If DAP has not problem to sue the Sultan based on legal aspect, Anwar must agree, otherwise DAP must object rather than keep quiet. (This is the same line as Karpal is frustrated with LKS and LGE on the hopping matter). DAP must be seen to be credible, silence in this context is not golden.

    This is the main problem of PR for deteriorating trust from Rakyat, lask of cohesion among the PKR and DAP.

    i really hope anwar cease to promote the katak/hopping culture in near future as this will only serve damaging consequences rather than goodness to the rakyat. if the survey poll shows that rakyat really dislike hopping then what for PR especially PKR still insist on it. Anwar has miss the golden opportunity for 916 to lure bn mp to hop and so be it, bn are counter attack and the games goes on. Human nature is simple, everyone likes money and power and selfish including PR. The rakyat only want counter balance in a bi partisan manner so that both side can be checked and balanced, we don’t want PR leaders becoming future crooks like chen sui bian when taking power . Nevertheless, BN and gangs are really acting too much by the way they act. There’s no logic for what they did judging either by law or from the common senses. Nevermind, MCA or MIC or Ong TK foru sure will get their “paid” when come next GE. I suggest PR just manage their respective states well and be careful all the way till next GE. Sure BN will lost. But for me is stupid if PR still engage in hopping policy for now until a day rakyat said enough is enough.

    Standard Chartered Bank Malaysia Berhad successfully sued the late Tuanku Jaafar for US$1.0 million for a banking transaction. The case was heard in the Special Court reserved specially for the royalties in Malaysia.

    Anwar is playing safe side to not conflict with Royal group for the power crazy of BN. His enemy is BN and not Royal group. Not now I guess. Fight the right enemy is the smart strategy. Do you want to add more enemy? Fight for justice but need strategy not emotion. Get the court order to nullify the 3 frogs, then set a by-elections or dissolve the DUN for fresh all-elections. A simple as that. No politicking with Royal group which will only going to waste your time and energy. Need to prioritize your goal for realistic achievement. Just a thought.

    I agree with mifadzil’s view.
    As for party-hopping, it is a major distraction for both sides and since money (not ideals) is the main determinant for success, PAKATAN should begin a campaign to get the Constitution amended to bar party-hopping.
    As the poll shows, most voters are against this corrupt practice and thus removing it will create a bigger problem for the BN.
    Of course the present sentiments among voters will sweep the PR to power in the next elections and we don’t want or need this scenario at the federal level.

    Do remember that when we talk politics not all voters have the same wave length, the majority of the PR leadership cannot simply ignore the reality of the CURRENT environment. Some so-called presumed clear cut logical conclusions may not be so clear to a vast number of the voters.
    If we are to take all the bloggers and their families at this site, how many votes can you realize?
    At this rate of conclusion, very soon we will think like BN or rather UMNO.
    We all know the whole system of the country is corrupted by easy money and this had started some 25 years ago. The corruption was accepted by the majority of the voters because we kept putting BN back to power.
    Now with a younger set of voters, especially among the BUMIs who sense a need for change which will take place albeit at a slower pace than many of us wanted. It is for us the build up this desire for change without putting away those still sitting on the fence with second thoughts.
    If we keep on ‘creating more issues, which is exactly what BN wanted, then we will get distracted from the fundamental aim of getting those fence-sitters to support the change we need. At the end of the day, we all look for a two party system for the nation.

We are not living in Thailand where lese majeste laws are rigid and draconian. Or perhaps we would like to emulate them and enact such laws.
    And oh yes, we should enact laws to please the UMNO ultras who like to strip citizenship of alleged offenders. Then we can put karpal, Kit Siang, and all non-Malay criminals in a motor-less boat and tow it out to open sea since no country will accept them as they are stateless.     There are many court cases filed vs Rulers, it’s not uncommon. Does this means that we cannot act against the government now ? because all of the documents are marked ” URUSAN SERI PADUKA BAGINDA ” ??? even if it’s wrong ???

    Are we reverting back to absolute monarchy system ? when the Rulers acted ultra vires, it is considered as a treason to reject it ?

    Royalist are particularly ignorant to this facts and judging from the fact that Bkt Gantang is a royalist stronghold, just as Kangsar , Kpg Gajah and Sg Manik, PR will have to work hard to clarify it to voters or risk losing next poll.

    Don’t we all know by now that no one should be above the Rule of Law if one really wants to live in a truly civilised and secure nation and society?

    In a democratic nation state, those in public office, including constitutional heads of state, are all only ordinary mortals (similar to you and I and Jo/Lat Public are in our private roles/offices) are all merely doing a defined job, through mutually agreed employment contracts for service in those public functional roles, with the People through the defined roles within the architecture of the nation’s governance system and in which system the collective good will of the people, the entity referred to as the People, being right at the very pinnacle of that governance pyramid.

    So based on democratic wisdom and ideals of freedom, equality and fairness, and also on the principle of obvious common sense, along with you and I and our Jo/Lat Public, judges, prime ministers, Cabinet ministers, AGs, IGPs, and even constitutional heads of state must be subject to the laws of the nation because they, along with you and I and Jo/Lat Public, are not there in those roles by….er….divine hereditary right….as didn’t we clear that obfuscation up in 1649, courtesy of one O Cromewell I think it was, and which has led to the well-known mantra now on failure about how “heads will roll”.

    So if one abuses the privileges or fails in the duties that come attached with public or private roles, then one needs to be judged fairly and held accountable for any abuse and failings and if found wanting, needs to be prepared to lose that privilege or role based on the common sense maxim that says: abuse it, lose it!

    This is what happens in the real world in all normal spheres of human activity in reality, so what’s the problem here with these self-created grey areas?

    All these silly police reports are being used as excuse for police not to catch/prevent the real criminals out there – robbing & raping the innocent rakyat.

    The mainstream media will always & only highlight current issues – the editors are just puppets. All the past & previous incidents will never be compared or debated.

    Hamid the botak Home Minister and the IGP are both living in this world, and understand what Karpal Singh has said as well as those people who made police reports based on their own interpretation. If Hamid and IGP think that Karpal had gone against the law, then he could very well charge him in court without having to rely on the reports and harass Karpal in the name of making investigation. If police reports have to be acted on like what they did, why did not police and Hamid made investigation on police report in connection with the murder of a foreigner in this country which had become world infamous? That case must have been important that a person making statutory declaration about the events in connection with the murder had to retract it within 24 hours. Are the people of Malaysia going to believe that that person who has since gone into hiding after making a second declaration to retract his first declaration made those declarations for self aggrandizement to draw attention to his disappearance? Was the disappearance a justification for police to ignore the report?

    The IGP and the Home Minister are not only wasting tax payers money in collecting their pay, they were even tools for action contrary to the interest of the nation.

    The BN government and its institutions are practicing double standards, and doing it out loud.
