(a) Great flaw of TBH RCI report – failure to affix responsibility for TBH’s death on MACC despite evidence galore
The Teoh Beng Hock Royal Commission of Inquiry did not contribute to the restoration of public confidence in the independence, professionalism and integrity of key national institutions but their continued degradation.
A great flaw of the Teoh Beng Hock (TBH) Royal Commission of Inquiry (RCI) report is its failure to affix responsibility for Beng Hock’s death on the MACC although there were evidence galore before the RCI proceedings.
It was not just persons, namely various MACC officers led by Hishammuddin Hashim the then Selangor MACC Deputy Director and the “mastermind” of the illegal and massive 33-officer MACC “operation”, who must bear responsibility for Beng Hock’s death but also the institution of MACC as well. Family demands RCI, new probe into Sarbaini’s death

PETALING JAYA, July 23 — Dissatisfied with the ongoing inquest into the death Ahmad Sarbaini Mohamed, the Customs officer’s family today again demanded for a royal commission of inquiry (RCI) into his untimely demise during a graft investigation.
The family previously asked for an RCI to be convened immediately, but later relented to the inquest after Deputy Minister in the Prime Minister’s Department Datuk VK Liew said that it was the first choice, and that there was a “procedure” which needed to be followed. Read the rest of this entry »

The government maintains its stand that by law, an inquest needs to be established before a RCI. But Lim Kit Siang says the argument is flawed.
KUALA LUMPUR: The death of Selangor Customs Department assistant director Ahmad Sarbaini Mohamed continues to haunt Parliament despite a motion to disclose the deceased’s assets being rejected earlier this week.
The government has insisted that a Royal Commission of Inquiry (RCI) cannot be established to investigate the death because an inquest must be carried out first, according to the law.
Deputy Minister in the Prime Minister’s Department Liew Vui Keong reiterated the government’s stand on this issue in Parliament today. Read the rest of this entry »
Kit Siang adds voice to Sarbaini RCI call

KUALA LUMPUR, June 15 — Lim Kit Siang wants the government to override the decision by the police and Attorney-General to hold an inquest for the late Ahmad Sarbaini Mohamed, and instead convene a royal commission to investigate the death.
Lim said that the Cabinet should heed the call made by the late Custom officer’s son, Shahril Ahmad, that the family preferred a royal commission of inquiry (RCI).
Shahril earlier said it would be harder to determine the cause of Sarbaini’s death through an inquest and that this would delay the pursuance of justice.

Sarbaini kin reject inquest, demand RCI

KUALA LUMPUR, June 15 — The family of Selangor Customs assistant director Ahmad Sarbaini Mohamed has rejected Putrajaya’s decision to hold an inquest into his death and are insisting instead on a royal commission of inquiry (RCI).
The inquest, to be presided over by Coroner Aizatul Akmal Maharani, was set for July 4 to 15 at the magistrate’s court here.
Sarbaini’s son, Shahril Ahmad, told The Malaysian Insider that his family preferred the RCI as it would be harder to determine the cause of his father’s death through an inquest and that this would delay the pursuance of justice.

House rejects motion on Ahmad Sarbani

The Dewan Rakyat has thrown out an emergency motion to debate the death of Customs senior assistant director Ahmad Sarbani Mohamed while in the custody of the Malaysian Anti-Corruption Commission (MACC).
Deputy speaker Ronald Kiandee agreed that the motion is specific and of public interest, but decided that it is not an urgent issue.
“As the date for the inquest has been set (from July 4-15), there is no need to expedite a debate (on Ahmad Sarbani’s death). So the House rejects this motion,” he said after Question Time.
