Suspend ISA detention-without-trial powers for 2 years pending “comprehensive review”


Among Datuk Seri Najib Razak’s first decisions as the new Prime Minister yesterday were the immediate removal of the three-month suspension of Harakah and Suara Keadilan, the release of 13 detainees from ISA detention including two Hindraf leaders V. Ganabatirau and R. Kengaharan and the conduct of a comprehensive review of the Internal Security Act.

While these three measures are welcome, they are clearly not adequate and do not indicate that far from signalling a new Dark Age, Najib is ushering in a new era of democracy, freedom, justice and accountability for the country.

This is one of the SMS I received after Najib’s first official address to the nation last night as the sixth Prime Minister of Malaysia:

“If anything, the release of more than a dozen of ISA detainees announced by the newly sworn-in sixth Prime Minister marked the return of Mahathirism as this was exactly what Mahathir did when he became the Prime Minister.”

The sender of this SMS is very right in more senses than one.

Firstly, Najib’s accession as the sixth Prime Minister is accompanied by a very open and public return of both Mahathir and Mahathirism to Umno. In fact, Mahathir is expected to rejoin Umno in the next 48 hours and to campaign actively in the Bukit Gantang and Bukit Selambau by-elections to demonstrate that he is a greater asset to Umno and Barisan Nasional than the Prime Minister of only two days ago, Datuk Seri Abdullah Ahmad Badawi.

Secondly, the release of 13 ISA detainees announced by Najib yesterday is reminiscent of the first days of the Mahathir premiership in 1981 which saw the release of 21 detainees under the ISA – including two DAP Members of Parliament, Chiang Heng Kai (Batu Gajah) and Chan Kok Kit (Sungei Besi), former Deputy Minister now Tan Sri Abdullah Ahmad and the former chairman of Parti Rakyat Kassim Ahmad.

If the release of 13 ISA detainees is a manifestation of the return of Mahathirism, then it will not rule out a major crackdown by Najib on fundamental liberties and democratic freedoms as happened during the Mahathir premiership like the 1987 Operation Lalang mass arrests of 106 opposition leaders, NGOs activists and community leaders; the unprecedented assault on the independence and integrity of the judiciary from which the country has not recovered after more than two decades and the undermining of the autonomy of major national institutions.

Let me comment on Najib’s three announcements yesterday.

Firstly, Datuk Seri Syed Hamid Albar and Datuk Chor Chee Heung should resign as Home Minister and Deputy Home Minister respectively for the 11-day suspension of Harakah and Suara Keadilan which had been repudiated by Najib among his first decisions as new Prime Minister.

Both Hamid and Chor had tried to publicly justify the three-month suspension of Harakah and Suara Keadilan, claiming that both publications were being “punished for inciting hatred against the government” and “threatened the stability of the multi-racial nation”.

Najib’s withdrawal of the suspension of the two publications have shown that these allegations were not only frivolous and baseless but constitute a gross abuse of power by both the Home Minister and his deputy.

Secondly, on the 13 ISA release. While welcoming the release of the 13, we want the following:

• The immediate and unconditional release of the remaining three Hindraf leaders under the ISA, P. Uthayakumar, DAP Selangor State Assemblyman for Kota Alam Shah, M. Manoharan and K. Vasantha Kumar.

• The immediate and unconditional release of all remaining ISA detainees, who should now stand at more than 30 in number.

• The immediate closure of the Kamunting Detention Centre.

• The repeal of the Internal Security Act as such draconian detention-without-trial legislation has no place in a country which claims to practise democracy and respect human rights.

Thirdly, on Najib’s announcement of a “comprehensive review of the Internal Security Act”.

This is not the first time that Malaysians have been promised a review of the ISA. In the past decade, one Cabinet member after another whether from the Home Ministry or the Prime Minister’s Department had sporadically talked about reforms to the ISA but none had seen any fruition.

Malaysians do not want another vague promise of “comprehensive review of the Internal Security Act” which would be forgotten a few months or years down the road when events are overtaken by another major crackdown using the ISA – a second Operation Lalang-like mass ISA detentions.

To demonstrate that he is sincere and serious about a “comprehensive review of the Internal Security Act” , I call on Najib to make a four-point commitment, viz:

• that he would not resort to the ISA detention-without-trial powers pending the review and announce the suspension of the detention-without-trial provisions of ISA for two years;

• that the ISA review is part of a comprehensive review of undemocratic, repressive and draconian laws including the Police Act, the Printing Presses and Publications Act, the Official Secrets Act, the Sedition Act, etc.

• that the “comprehensive review” would be conducted by an independent and credible Royal Commission comprising members respected by Malaysians for their human rights record and work.

• That his government will accept and implement the recommendations of the Royal Commission so that there will no repeat of the farce of the Royal Police Commission whose recommendation for the establishment of an Independent Police Complaints and Misconduct Commission (IPCMC) to create an efficient, incorruptible, professional and world-class police service remained still-born although Abdullah had publicly pledged to implement it.

    I get the impression that the king was unhappy but was helpless to prevent Najib from being sworn in. It was a fiat accompli. So he goes through the motions with a heavy heart.

    Mahathir would have suffered the fiasco of March 8, 2008 in 2004 if he had not resigned. In a way, AAB gave UMNO four additional years before his inability to reform (due to Mahathir’s continued harassment and the gargantuan corruption) gave way to March 8, 2008.

    You shall follow Mahathir at your own peril. Mahathir was and is never a great leaders or strategists. Just look at the wastage, the blunders and the abuse he has committed. He presided over Malaysia during the period even a donkey would have managed a 8% GDP growth. If there is any, Mahathir retarded growth, destroyed institutions of government, inculcate “piratisation” and cronyism, and dispensing with well tested checks and balance mechanism like the civil service, the former ACA, and the auditor general Dept etc. He was and is a great disservice to the nation.

    You follow him; you will end up in the gutter just like AAB. Your father was only PM for six years and today you could still see his legacy. Why are there no new genuine poverty eradication programmes like Felda, Felcra and other resettlement schemes anymore? As a non-Malays, I got a government scholarship during the heights of NEP implementation in the 1970s. Today, even among the Malays are fight and complaining for not getting it.

    One can help but noted that they did not release the biggest 3 leaders of Hindraf. Compared to Badawi releasing Anwar, you can’t blame Hindraf for feeling let down. What is the 3 other guilty of that the other 2 was not? So basically the rule of is how much they are afraid of you and not by laws that should apply the same to everyone.

    The comparison to Mahathir early days is very glaring given the inconsistency with Hindraf leaders. If you are going to let go of one, you let go of the others. Hypocritical not to which of course is what Mahathirism ultimately is…

    The release of the 13 ISA detainees and the lifting of the 3-month ban on HARAKAH and SUARA KEADILAN with immediate effect as announced by new PM Najib is nothing short of canvassing for crucial votes for BN in the 3 by-elections in Bukit Gantang (Parliament), Bukit Selambau (Kedah) and Batang Ai (Sarawak). These surprised announcements are nothing to shout about as it is another affront to pull wool over peoples’ eyes. The other 3 Hindraf and other detainees should also be released and the ISA be repealed totally without further ado.

    It is still too early to judge the new PM and his actions. Time will tell whether he is committed to a new Malaysia which is more open, fair and just to all irrespective of race, religion and differing political opinions!

    The era of Mahathirism should not return. It should be history for all Malaysians!

    Yeah its election sweets. What he did not realise is this. After 50 yrs of tasting the same sweet (although only once every 5 yrs) the people have grown quite fed of the sweet. We will not be hoodwinked.

    And one more thing. Its foolish of him to do this. I shant tell the reason why I say so. It might give them ideas. Let him be foolish.

    But then again he really has no way to run. To press on with mahathirism or not is clearly a difficult decision. One way or another umno will face its demise.

    Never rejoice and do not get exited by what has been done by him. All must remember when exPM first day. He went unannounced to the immigration and every body got exited that he want to clean out the most corrupt agency in Malaysia. Now he has left and what has happened. Nothing!!!

    So the release of the ISA detainees has nothing to shut about. Every body can delivery a good speech written by professional political writer.

    We all have to remember that Abdullah may be sincere in his reform but he crumble his own party pressure of which many refused to change.

    Najib could be worst as he carry too much baggage with him and could easily hold ransom by his own party members. Also remember his the other half the big mama factor also have great influence on him politically.

    Another factor was the influence of the Old Hat. we do not know what this old hat will influence him. Many respect the old hat and pay high respect to the old hat. But can you remember he the one who has brought down the judiciary? He was the one who use ISA at his fancy!! He the one who dare challenged the sultan!!! He the want who let CORRUPTION go free!!! He the man who privatize every single project to many few billionaires and create many cronies!!!

    The old hat may have bring some good economy success but at the same time who also crippled the three foundation pillars that form the four pillars of democracy in Malaysia.

    So be careful. This Old Hat influence on Najib.

    The old Hat is playing a greater rule. and we all know how good you are when one get old will always compromise by saying that i have forgotten this and that.

    so, nothing to cheer about. The worst may yet to come.

    There is good reason why he announce immediate the relapse of 13 Isa detainees and revoke the ban of two political papers.

    He was smart to dress himself that with such a popular dress and appeal to the people that he was serious top reform. No he was not serious. He was more concern the three by elections that he can’t effort the lost any of them. He has been wisely advised or other wise to take this popular measure to enhanced BN chances of winning in the three by election. The three by elections was too crucial for him and he could not afford a lost of any one of them.

    Bk Gantang lost will mean he was wrong to take a coup of the Perak Government and this will tarnished his reputation. And he know this very will. He did all these just because of the by elections and nothing else.

    So all expect worst to come from him once the by elctions are over.

    If he says nothing I would not have been so angry but with his maiden speech it makes me more angry. Many are blinded and feel so happy for what he is doing now.

    For GOD sake, he is racist umno najib and always will be racist umno najib. What he does will always be for umno and umno only and no one else.

    He does not follow the rule of laws and that he and umno is above the law.

    These goodies are just to get him off to a better footing and trying to win the 3 by elections, nothing else.

    After living my life for 55 years, practically all my life with umno/bn rules, I can assured you there is no way I can believe in the promises.

    It is very simple. They give you 3 steps today, tomorrow they take back 4 steps and you can see how we had fallen over all these years of the type of promises they give and the way they take back.

    I remember sometime last year, after a big noise from the people and MPs of Sabah, Datuk Seri Najib was appointed by the then PM to head the Committee which was assigned to look into the problems of the legal and illegal Filipino and Indonesian immigrants in Sabah and find ways to tackle the issues.

    Perhaps, LKS should bring this matter up in Parliament and find out the outcome on the above matter.

    Sabahans are the ones who should be in the picture and anyone out there who can throw some light as whether this is any improvement on the immigration situation??

    Malaysia is very funny country. Every time whenever there is a change in the leader shall it PM or minster or Datuk Bandar, the new head will announce that they will listen to the people, they consult the view of the people before any policy being implemented. So as you see it, this was the same happening whenever there is a change in the leader. So this imply that all those before have been doing thing without regards to all the people views and just do it and implement policy to their fancy.

    Remember the lam duck ex PM say “work with me “ and thing like that, so this new PM also say “ Join me with this great journey “. All some familiar. Once a=every thing has settled down the true color come out.

    Let take what happen during the ex PM. He was determined to clean out CORRUPTION!! BUT WHAT HAS HAPPENED.

    Every time people corruption here and corruption there. The Anticorruption will say, bring in the proof bring in the report ect etc. But unless you are blind, uif not sure those people can read what has been written a along by the Sun journalist Mr. Nades on corruption. BUT hwy nothing has done and investigations done on what NAdes has been written and also reported with all documents on what he has written????

    So what happen really to all those promises to clean out CORRUPTION???

So during these so called honey moon period and beyond, we the raykat need to monitor his every move,appreciate the good one/ones and critisise the bad one/ones.Hopefully NR now as pm will take the necessary action to clear up his name.As CEO of the country,his character /reputation,his personality including his wife/first lady,all his management and executive staffs reputation must remain beyond repraoched .NR also needs to monitor the rest of the governemt bodies such as the Police,AG,JC,MACC,EC to remain upright,fair, and free from fraud .Let’s give him the benefit of doubt.If he fails to clear up our doubt,then in the 13th GE,we the rakyat would judge him guilty as charged.

    The problem with Malaysians is not too soft, it is too gullibleThey don’t ask hard questions about a person’s track record,look at the integrity of the person,look at the character of that person,who his mentor is etc etc

    LKY,besides education,experience,drive and commitment views integrity as the most crucial factor in a leader.You can have all the 4 qualities but without integrity you are no good to him.

    So the question to ask is how can one be so naive as to think that Najib has changed his spots just simply by his cleverly employing rhetorics that sound nice to your ears within 24 hours of taking over.The perception of him as a man involved in grafts throughout his career,a politician who is ever ready to stir up racist sentiments if it means advancing his political standing and lately that of being involved in the mongolian girl murder cannot just vanish overnight.These perceptions have been created and built up by him throughout along period in his political career.More appropiate then is to ask oneself what is his ploy behind all those rhetorics?

    Even Indonesia with 250 million populations..have everyone glad to be Indonesians…….largely because it is a much more freer Nation than Malaysia..especially on religion …and no titles..all are equal..
    There you have few important reasons to vote for change…to actually free ourselves and let no UMNO crooks think they are so damn special…so smart….so successful….with false titles and stole money from country’s wealth.
    Yes…..sit back and note……all UMNO crooks are Datuks…Tan sri and Tuns.
    Is that not making themselves above all Malaysians who voted taxi drivers…..teachers…low class dentist….farmers.. to manage the country?

    What’s the big deal anyway?

    I am sure it is clear as daylight that (1) the ban on Harakah and Suara Keadilan was imposed with the intention of lifting it to mark the start of honeymoon period (2) the release of the 13 detainees was deliberately delayed to the eve of 2Bukit1Batang by-elections and (3) the promised review of ISA, similar to preceding premiers’ incoming fanfare, is nothing more than mere gas-bagging.

    If his advisers think that all these moves are meant to make it look good on Number 1, Malaysia must truly be, in their eyes, a land of dumb fools.

    Well Najib-Alat-antu-ya!? the 1Malaysia problem now….

    After the by-election day of 7 April 2009, Najib may announce his definition of “One Malaysia” as follows:
    1) One United Malaysian Nation to be ruled by the Malay Supremacy in the name of UMNO;
    2) One Single Malaysian Official Language, namely Bahasa Melayu, to be learnt and used by all Malaysian People and no other languages shall be encouraged for learning in Malaysia;
    3) One Single Malaysian Religion, namely Islam, to be preached among all Malaysian People and all other religions shall be discouraged or harrassed or banned by the issuance of Government decrees;
    4) One Single Malaysian Culture, whereby the Malay traditional culture shall be predominant and other minority cultures shall be assimilated or eliminated through the influence of the Malay traditional culture.
