Meeting with Speaker Pandikar Amin tomorrow on MP Teresa Kok’s ISA detention on totally baseless grounds


I will meet the Speaker, Tan Sri Pandikar Amin Mulia in Parliament tomorrow over the detention of DAP MP for Seputeh Teresa Kok under the Internal Security Act (ISA) and the actions which should be taken by Parliament over an MP’s arrest on totally baseless and non-existent grounds.

Home Minister, Datuk Seri Syed Hamid Albar said yesterday that Teresa was detained under the ISA as she had questioned the sensitive issues such as the azan (call for prayers for Muslims) and that could cause ill-will and disharmony.

This allegation was first made by the former Selangor Mentri Besar, Datuk Seri Dr. Mohamad Khir Toyo, which was then sensationalised by Utusan Malaysia.

Teresa had made an immediate denial that she had tried to disallow azan in Kota Damansara Sri Serdang and Puchong Jaya. The mosque committees in both areas have endorsed Teresa’s denial with the Masjid Kota Damansara officials explaining that a damaged ampliflier had resulted in the calls to prayer to be made without the aid of a PA system while Masjid Kinrara mosque committee said Teresa had never set foot in Masjid Kinrara and was not involved in the azan petition issue in the area.

The PAS MP for Kota Raja Dr. Siti Mariah Mahmud had also lodged a police report against Khir on Thursday for his statement published in Utusan Malaysia on Tuesday, as it was “maliciously intended and aimed at raising the anger and anxiety of Malay Muslims”.

The police has no basis whatsoever therefore to detain Teresa under the ISA for the baseless and non-existent grounds linking her to any azan controversy.

As an active political leader, how can Hamid repeat the baseless claim of the police about Teresa’s questioning the azan issue as anyone following the news whether in the printed or electronic media would know that it was the irresponsible and sole concoction of Khir Toyo and Utusan Malaysia?

The competence and professionalism of the police is suffering another fatal blow – after the scandal of the 20-hour ISA detention of senior Sin Chew reporter Tan Hoon Cheng – when they could detain an MP and Selangor Senior State Exco on completely frivolous and non-existing grounds, known to anyone who follow current news.

As a responsible Home Minister, he should have called up the police officer responsible for Teresa’s arrest to demand explanation wny the ISA had been invoked against a Member of Parliament and State Exco on completely non-existent grounds and even to take disciplinary action against the police officer concerned for such irresponsibility, incompetence and gross misuse of powers.

I want to discuss Teresa’s ISA arrest with the Speaker as it is not just about the violation of an MP’s individual human rights and parliamentary responsibilities, but the utter contempt of Parliament shown by the Police and the Executive when an MP could be silenced and Malaysians deprived of their elected representative and spokesperson on completely non-existing grounds!

The United States yesterday summoned Malaysia’s top envoy in Washington to protest its crackdown on dissent.

In response, the Foreign Minister, Datuk Seri Dr. Rais Yatim warned the United States not to interfere in the country’s domestic affairs.

Rais should know that in the present world of 2008, where human rights is recognised as an universal one, no country has the right to shut out international scrutiny, criticism and censure for gross human rights violations – and this applies to Malaysia as well as to the United States.

The United States must face the present-day international reality of being subjected to criticism by foreign governments and leaders including from Malaysia for any gross human rights violations such as the Guatanamao Bay human rights scandals.

Similarly, Malaysia cannot claim immunity from scrutiny, criticism and even censure from foreign governments and leaders for local human rights blemishes, like the recent spate of crackdown of ISA arrests and threats to media freedom.

It would be more worthwhile for Rais to invest effort to remove the causes justifying the United States criticism of Malaysia for the latest bout of human rights violations by getting the Cabinet to free immediately and unconditionally Teresa and RPK (also the Hindraf Five and other ISA detainees in Kamunting) as well as to cancel the show cause letters to three newspapers instead of issuing a meaningless warning to the United States.

    Pakatan Rakyat should take over the country now (14th September).

    We don’t know who is controlling the government. We are not sure who used ISA against the people. The Law minister was against it, Information minister, MCA ministers were against it, MIC, Gerakan,…. Then who used it? Was it the Home minister alone? Was it Abdullah? Or the fourth floor boys?

    The country will soon be in chaos if no one takes control of the government. By now, Abdullah has definitely fallen into coma

    With an IQ as low as a caveman, Syed Hamid is not fit to be a minister. He has made too many mistakes e.g. scaring away IT investors by banning and unbanning ‘Malaysia Today”, arresting Sin Chew reporter Ms Tan under ISA and arresting Teresa Kok without concrete proofs that she has threatened the nation’s security.

    Syed Hamid’s dismal and unprofessional work performance will only hasten fall of Abdullah’s government. No one can deny that the recent ISA blitz has created more foes than friends for UMNO. Surprisingly, Abdullah is foolish enough to allow an unqualified incompetent minister destroy his popularity and image.

Our so call Home Minister Hamid first give reason that Sin chew reporter was arrested under ISA because of her own safety then the next one even more childish. When asked why Ahmad Ismail is not arrested too he told reporter that UMNO already fine him. Hey UMNO is just a political party not the law how can you said that. But once chinese papers (Sin Chiew) published the fact by AHMAD statement, the reporter being warned by government. If the justice still exist, why shouldn’t the government just fair to both scenario? End up, the chinese reporter had been arrested under ISA which was clarified by Syed Hamid that the government using the act to PROTECT her? Don’t it sounds funny? Tan is a professional reporter and she’s just on her duly duty for reporting the truth!

    I would like to hereby stress the following again:

    Akta Keselamatan Dalam Negeri (ISA) is a legitimate law in Malaysia that has been around since 1948 and thank to ISA, Malaysia has been free from devastating turmoils in the past 30 years. Section 73(1) Internal Security Act 1960 provides that “Any police officer may without warrant arrest and detain pending enquiries any person in respect of whom he has reason to believe that there are grounds which would justify his detention under section 8; and that he has acted or is about to act or is likely to act in any manner prejudicial to the security of Malaysia or any part thereof or to maintenance of essential services therein or to the economic life thereof.” Its aim is to maintain social stability of the country.

    The ISA was created by the British primarily to deter the Communist Party during the colony time. There is no reason why it cannot continue to be used to deter any wrong doing by the Opposition Parties or individuals after Malaysia became independence, especially when the Opposition parties have gone out of control and tried to create fears and tensions in public, which gives rise to social instability. I would strongly suggest that the police continue to enforce the ISA whenever necessary and if the situation is critical they should extend the detention period beyond 2 years because 2 years of detention are seen widely as too short. Only when the detention period is increased people will take it seriously or else the country would be in turmoil from time to time. I would say if similar situation happens in China or India, the culprits would have been jailed for an indefinite period.

    Condemning the ISA is only what Anwar and gangs could do now when the likelihood of what PR calls the Malaysia Day diminishes. Our leader has already said many times that Anwar’s plan to topple the BN’s led government is doomed to fail. Our MPs have already pledged loyalty to BN and it is time they show their gratitudes to BN. Please ask yourself, if you are already living in comfort with power and prosperity, will you be so idiotic to do idiotic things whereby to lose what you have now? There is no reason why these MPs should take the risk. I am happy that they are mature and smart enough to see which is the party that can help them advance in their political career. Most importantly, BN is able to bring real benefits to the people and not like PR, who could only give empty promises. 16 Sept is a joke because it will not happen and I have already said it before. Even if our respected PM Datuk Adullah Badawi steps down, there are plenty of smart elites in the party who can lead the country to another new height. With our esteemed Mr Khairy leading the charge and other experienced veteran politicians, BN can only become stronger. So the smart people knows which party to follow and it now proves we are right and Anwar is wrong.

    I think you can tell Speaker Pandikar Amin that the decision to arrest RPK, Ms Tan and Teresa Kok is not valid as there is no COLLECTIVE agreement by the Cabinet to impose ISA on the three of them (in fact some MCA members protested at the decision). How can Syed Hamid make the decision alone – he is no judge! In this case, you can claim that Syed Hamid is trying to fulfill his hidden personal agenda to gain political mileage (perhaps to get promotion).

    ISA decision has to be made by a group of people (the Cabinet) not by one person.

    1. Please justify that can anyone be arrested based on a fake report?

    2. The law may be necessary, but why was it not been used on Ahmad ‘Squatter’ Ismail, Toyo’l, and Utusan. Is the law so weak that it was subject to abuse or at least seemed to be?

    No wonder Malaysia is in trouble, UMNO is so outdated! That’s not all, the issue here is not whether a law is legitimate, it is abuse of power.     hamid said he is not involved because he is a politician. he claimed he was informed in advance by police to use ISA but WHY DIDN’T HE DO ANYTHING!!?? i’m very sure he knows the end results won’t be pleasant and as home ministry, he should know that there are other laws for reason to arrest these people or sought an alternative for the police to act.

    doing nothing but letting the police to go ahead with ISA and ‘blame them’ is like giving the impression that the home minister is not doing anything within his power to maintain peace for the country OR has his approval !! say hamid approve the detention, he will still need the advice of bodowi. when bodowi didn’t object, its a GO AHEAD FOR ALL!!

    it saddens me that hamid with a vast experience and intelligence disappointed us as the home minister. if i’m not mistaken, he was also foreign minister prior to this so he must have been one of the most look-up and respectful person not only in malaysia but to foreign countries alike.

    *The destructions of official documents by his office shortly after PR was seen to take over Selangor*

    Mind you, I learnt about this from an article in MP Teresa’s blog, supported with 2 photographs around March-April. Numerous bags of destroyed documents with paper shredder were clearly seen in the photographs.

    Could it be a possible power abuse for personal revenge on MP Teresa? Just a random thought. I dun need personal protection, minister Hamid.

    Actually, the Police and Syed Hamid Moron, have both done Teresa a big favour.

    She now wears the Badge of Honour of having been detained under ISA, not that it is a pleasant experience nor she wanted it.

    But this detention should boost her popularity and reputation as a woman MP who cares and who will fight for the people.

    Next elections she will probably win 100% of the votes.

    At the coffee shop just now, there was a competition as to which Minister is the biggest Moron of all. No prizes as to who won hands down.

    Well, if Pandikar Amin even have the slightest behavior of reluctance in this issue. That means, some hidden hand has gotten to this guy before you guys can make a case in Parliament.
    Let’s hope that Pandikar really bent on helping the country instead of bowing down to pressure from UMNO.

    The case between Ahmad Ismail and Khir Toyo has one thing in common. They have real support of someone really powerful to say something like this. My bet is on Tun Dr M. He is pulling the strings. I might be wrong, but any one wanna put in the 2nd guess?

    Can Rais warn US of not going to UN for sanctions against Malaysia as proposed by Amnesty International for ISA ?

    Warm bilateral relationships risks being jeopardise because of these senseless act by BeEnd.

    Utusan should be given a show cause letter if we act like BeEnd for falsely reporting YB Kok. Anyway, ultimately we do not want any press to be opressed. Therefore YB KS’s upcoming suit to Utusan is greatly welcomed. It is civil and should stay a civil case.

    Selective persecution of YB Kok had angered so many of my Malay friend and truly, BeEnd deserved 308 and 916 they said.

    I think Ahmad is truly a national threat for what he did and subsequent ability to invoke ISA on the person whom reported truth.

    I put my last little respect for Ameno at least on Zaid because he risk the fire for speaking truth. ISA is cruel and outdated. For terrorist or communist, it would be even cruel. For an female MP ? I believe Ameno is desperate and becoming a loose canon like Ahmad Ismail.

    Everyone deserve a fair trial and investigation. Wild accusations needs to have a thorough investigation.

    An MP who won with the most majority in the country in the last GE and who holds an important post in the state administration bringing in investments to the state is termed as a threat to national security!

    No one seems to have the guts to admit that he/she was the one who gave the instructions for the three to be detained yesterday!

    Knowing the moral fibre of Pandikar Amin who has turned Parliament into a rubber stamp for the Executive, I fear you will get nowhere by appealing for his intervention.

    His expected reply will be, “Not urgent to debate” or “leave it to the Police”.

    Petitions are also useless although I’ve signed it anyway. Submitting petitions to these people calling on their decency is like casting pearls before swines.

    A better way is to petition the DYMM Sultan of Selangor to intercede.

    What got these goons to release Tan Hoon Cheng? It was public outrage. We must create the same public outrage to get Teresa Kok released.

My dear cleaner can read a little bit of the newspaper(other than butusan de liar) only because she was not educated. You see, a non educated cleaner can think better than a minister and also a “bekas only” menteri besar. I don’t know what will happen to Malaysia generally or Sarawak specially, but one thing for sure, I am going to use this month’s salary to prepare for at least two weeks worth of food and drink supply.     Kassim Amat – I think your brain has a size that is most definitely smaller than a pea.

    Whichever way you look at it, there is no justification for Teresa to be under ISA. Khir Toyo should be under ISA. Ahmad should be under ISA. Everyone in this country can see that except for a few jokers.

    This whole episode is like the case of a bunch of kids who can’t win a football match and had to call in Big Daddy to remove the goal post so the opponent has no goal to shoot at and get Big Daddy to become the referee as well!

    They should lodge a report against Toyol not YB Kok. The PDRM should be review the Standard Operating Procedures ( SOPs) , it’s flawed or of non existent. BMC,AI,Anwar,Teresa,Journalist shows that it is biased in performing duties.

    I personally had dealt with Detectives , PI , Inspectors , Chief Insps , ASPs , DSPs and I find true professionalism in these officers. What is lacking at the top levels is mind boggling. It’s like a 5 headed snake with a direction.

    The Police will have to show how the action of the accused had initiated threats to national security before ISA could even be considered. As it is, it was the former MBs Khir Toyo who alleged that Teresa Kok made certain utterances, which even if true, could not have amounted to threatening national security. Utusan Melayu sensationalized the issue in its paper. But the newspaper had not verified the reliability of its source.

    The BN government has illustrated double standards on this particular issue in comparison with its treatment of Tan Hoon Cheng verses Khir Toyo, Sin Chew versus Utuasan Melayu, and Ahmad Ismail verses Teresa Kok.

    Ahmad made his speech in the public, in the presence of DPM, whereas god knows whether Teresa Kok had ever mentioned what she was accused to have said. Ahmad Ismail’s statement is proven to require disciplinary action by UMNO but what Teresa Kok’s was alleged to have said is not known. If Ahmad Ismail could be spared the law, why should Teresa Kok stand abused in the name of the law?

    Tan Hoon Cheng is a reporter whose job was to report for public interest, but Toyo is not. Tan reported the statement by Ahmad Ismail which hurts a section of the Malaysian society. Khir Toyo alleged that Teresa Kok made utterances which are not agreeable to a section of the Malaysian society. If Tan should be ISAed for 20 hours, why shouldn’t Khir Toyo receive the same treatment to find out the truth of his allegation?

    Sin Chew reported facts in the newspaper, but Utusan Melayu reported allegation by a person, Khir Toyo, who was not a professional reporter. When Sin Chew had to be asked to show cause for reporting facts, why shouldn’t Utusan Melayu be asked to show cause for reporting possibly rumours said to have effects on national security? Utusan should have been asked to indicate what actions it had taken to verify the truth of what it reported. The police had first to be satisfied that both Utusan Melayu and Khir Toyo had been correct in what they claimed to be facts before the police could have the basis to interview Teresa Kok. As it is, the Police had spared the investigations on both Utusan Melayu and Toyo, but chose to arrest Teresa Kok for allegations that had no proven basis. This is double standards and is demonstrated to be so.

    Was it the intention of the police to exhibit its unfair treatment so as to cause public furore, resulting in circumstances for emergency declaration? Home Minister Hamid Jaafar stated that emergency would not be declared, for the present it seems. When did the thought of emergency declaration run through his mind? Was it planned but abandoned after the police had failed to arouse public reaction? Release Teresa Kok now!

    The police not only prove that they are conducting selective persecution. They interfere with national security for which they are supposed to preserve.

    Everyone in Malaysia except those in BN (& cronies) must prove their innocence. Otherwise it is guilty as charged. This is Law of BN. Which have already proven itself in the likes of Datuk Ahmad Ismail & Datuk Botox. These BN members are allowed to stir racial sentiments & cause racial tension but get away scott-free. The biggest punishment (wow) is just suspension (holiday is more like it).

    We demand Datuk Botox to provide prove of his allegations against YAB Teresa. Otherwise, forget about the 7 days dateline to apologize. We all know that BN never apologize for their wrong doing. Instead, they will twist & turn like putting on a 100m sarong.     Someone should teach PPIM & Perwaris to read English medium newspaper & not only believe everything written by Utusan Melayu. They have clearly not knowing the truth (blinded by BN $$$) prior to making silly police reports. The police should also have told them that YAB Teresa will be making a legal-suit if both Datuk Botox & Utusan Melayu do not retract their allegations. What is BN trying to achieve here? They are already in the drain & they want to drag the entire country/rakyat with them? True colours of BN.

    The main issues in every rakyat now is security from rising crime, confidence in the economy, tackling the inflation, even RM is sliding against USD (sometime it made big headlines when RM was highest against USD…why not when it is at its lowest?), more & more other persisting issues that are important to the rakyat. These are all neglected since the new BN cabaret was formed.

    Everything BN has put up has shot back at them. Thus, this is the last draw from them. Using ISA to intimdate & stirring racial issues via 2 of their henchmen. There is no racial tension.     Not emergency rule, but I think it was intended to create racial unrest. Obviously, neither Syed Hamid nor Badawi ordered the arrests. I can smell somebody’s evil hand in this. Somebody who should be enjoying his retirement but can’t stop meddling. Somebody who wants more than anything else for Badawi to step down.

    Someone who is ruthless enough to treat racial strife as collateral damage to achieve his ends. Some who has done it before in 1969 to force TAR to resign.

    This fellow could be in league with botox face and behind Ahmad Ismail’s extraordinary bravery in escalating racial tension.

    Whenever there is a power struggle in Umno 2 things are come to the forefront:-

    1. racial/religious issues are played up to dangerous level to unite the malays by the right wing elements in Umno.

    2. Opposition politicians are made out to be the culprits for stoking the above.

    Subsequently opposition politicians are arrested to reinforce above points 1 and 2. Moderate malays dare not stand up to oppose the right wingers for the fear of being accused as traitors to their race and religion and lost the power struggle. This kind of scenario has happened twice and the winners were seen as heroes to the malays; the opposition politicians and moderate malays were cowed and they get to dominate Umno and ruled the country.

    Are we seeing the same thing being played out again in 2008? We can argue that the country in 2008 is very different from 40 or 20 years ago but that wont stop them from trying to apply the same strategies to gain power again. Dont fall for the same trap again by butting heads with them.Use reasons and a soft approach to fight them.

    If Syed Botak is to be believed, he had nothing to do with it. “Gua tak ada bikin” is the catchphrase of UMNO. They think we are all stupid. No ISA detention is legal without the signature of the Home Minister or the Prime Minister.

    “Gua tak ada bikin.” And all the while, the pile of public funds keeps diminishing.

    The signature of the Home Minister is only required for ISA detention beyond 60 days. Obviously, Syed Hamid was also caught by surprise, you can see how he fluff his ridiculous explanation. As for the sleepy PM, he’s just not in the picture, he seems to be out of the loop of decision making.

    Somebody exploited a power vacuum to manipulate the police. Same as what happened in the illogical Anwar arrest.

    How much longer is the PDRM going to take all the crap for BN? How much $$$ is it going to be worth to ‘sumbat mulut’? If the arrest were supported by public, BN will take full credit & say they did the right thing ie in the case of putting known terrorist under ISA. But if it fails to get rakyat support or become unpopular, like the recent fracas, BN will wash their hands & blame the PDRM for taking actions into their own hands. If BN claim ‘not me’, then why no sound to ‘release them’ to PDRM?

    C’mon. Is our PDRM that dumb not to know what is truly going on or they are tied to their masters – BN? Then our PDRM is a laughing stock to the world. PDRM should uphold its credibility & integrity for the nation & rakyat, to serve the rakyat – not BN. PDRM moral we can see is at its all time low. There’s nothing proud to be in PDRM today. Joining PDRM is as good as being BN member. It’s automatic, if not by force. Imagine when PDRM officers go to vote, the superior officer will be standing in front of them to make sure they cross the right party symbol. In other words, it’s like losing one’s soul to the devil.

    The perception of people joining PDRM is because of easy entry & that’s where to get extra income. Thus, how can PDRM blame the public perception that corruption is high in PDRM? I don’t support ISA as it is inhumane. Even terrorist can be trialed properly in court. Otherwise, why have rule of Law & lawyers for. Datuk Zaid Ibrahim job is just to fill a vacant seat, not a responsibility. We may as well close down all the courts, abolish legal firms, etc.

    Whatever happened to the ‘study tour’ to HK ICAC? Perhaps ICAC is a shopping mall in HK?

    This ex-Selangor MB with Indonesian background and Ahmad Ismail with Indian background are a great threat to the peace and security of a multi racial and religious country of ours.

    They are playing damaging, divisive and dangerous politics of race and religion. The ordinary people should not let them, and many like them, destroy our country.

    They do not deserve a place in our country……it is long overdue for our leaders to show good leadeship by send them back where they came from!!

    ISA is used for the whims and fancies of the current government to suppress all initiatives taken by the rakyat for a fairer Malaysia.

    We as Malaysians immaterial of creed and race should stand together to let the government know of their abuse of human rights by the implementation of ISA. .

    Please Malaysians don’t be fooled into believing that the rights of any religion or race is abused by another even if it is what the government intend you to believe it to be, for their own benefits and selfish interest.

    NO ONE IS A WINNER IN WAR !!!!!! And NO RELIGION PREACHES TO START A BATTLE!!!!

    parliament to meet pandikar is a waste of time. assuming pandikar wants to help out, he doesn’t has the authority as the powers are in the hands of HOME MINISTRY!!! besides, conveying an emergency during rahmadan is totally out the question and neither will there be enough MPs to support the abolishment of ISA because there are TOO MANY MPs who do not want their ‘CARI MAKAN’ thrown out by bodowi!!! These MPs really made me disappointed and mad knowing we have STUPID MPs who doesn’t know anything about HUMAN RIGHTS and the RULE OF LAW!! I can only thanked those who voted for them into parliament and hope that one day, the police will just rush into their houses to make ISA arrest!!!

    everyone is entitled to JUDGEMENT at COURTS. tell me which country don’t have courts. ISA has been wrongly used here. Its main objective was to catch COMMUNISTS & NOT MALAYSIA – an extra info from me for the idiots who keep quiet or sokong ISA!!! there are many laws that can be enforced if a person is a suspect but WILL HAVE BE CHARGED IN COURTS and the suspect BE GIVEN A CHANCE TO DEFEND !!

    are the police of today acting like gestapo?? i surely hope not because i believe the majority of the police are STILL GOOD POLICEMEN !! We the rakyat need these POLICEMEN TO COME OUT TO PROTECT OUR CIVIL RIGHTS PLEASE!!!     I will reiterate:

    UMNO has in its possession not one but to trump cards,
    one is the MALAY/BUMIputra trumpcard and other being the ISLAM trumpcard.
    It conveniently uses one or the other card that fits the occasion in other to win the support of the majority Malays. They have but only been used to create fear..a potent mix of fear and anger at its best.
    Is UMNO really fighting for the rights of Malays or Islam? Any right thinking sensible Malaysian would know the answer.

    These trumpcards are used to gain money and power. They don’t care about their own race and religion let alone the race and religion of others.
    Using religion and race issues to make more money! That’s what they are doing.
    Do ponder on the following:
    1.How much do you think each cabinet ministers net worth is?
    2.How many companies does the PM own, under his name???
    3.How much do you think the DPM is worth?
    4.How much do you think the Chief Minister of Sarawak is worth?
    Most of these ministers have been in their posts long enough!
