Rais should lead the charge in Cabinet to demand dropping of Anwar’s Sodomy II charge

The 2008 Olympics opens in Beijing today but for Malaysia, we are obsessed with scaling a new Olympian height of national trauma and international infamy – the strangulation of what is left of the rule of law in Malaysia after two decades of judicial darkness in the continued political persecution of Anwar Ibrahim in the Sodomy II prosecution.

Thanks to this special Malaysian official obsession with sodomy, Malaysia was big news in seven continents when Anwar Ibrahim was charged under Section 377B of the Penal Code for sodomising his 23-year-old male aide, Mohd Saiful Bukhari Azlan.

Furthermore, Anwar’s Sodomy II trial and tribulation will be kept alive in the international stage because of the disgraceful, dishonourable and ignoble circumstances and motivation of the prosecution to the extent that the Foreign Minister, Datuk Seri Dr. Rais Yatim has made a most unusual and extraordinary decision to organize a series of information sessions by the Foreign Ministry overseas on Anwar’s Sodomy II “to give a true picture so there will be no misconceptions that can hurt Malaysia’s image”.

What is this “true picture” that Rais is going to tell the world in a series of information sessions overseas?

Will this be the same “true picture” that the Information Ministry will be telling Malaysians in the country, and particularly during the Permatang Pauh by-election from August 16-26?

Will this “true picture” include the following:

1. That the Cabinet had usurped the constitutional powers of the Attorney-General’s Chambers on its sole prosecution discretionary powers?

When Home Minister, Datuk Seri Syed Hamid Albar said yesterday that Saiful is not being charged because he is the complainant and the key witness in the sodomy case against Anwar, he has arrogated to himself the role and sole discretionary power of Attorney-General under Article 145(3) “to institute, conduct or discontinue any proceedings for an offence”.

It was also an admission that the Home Minister had been involved if not usurped the Attorney-General in the decision-making process resulting in the Sodomy II prosecution of Anwar – which is clearly an unlawful and unconstitutional usurpation of the powers of the Attorney-General!

The question is who else in the Cabinet had been involved in the decision on Anwar’s Sodomy II prosecution? The Prime Minister Datuk Seri Abdullah Ahmad Badawi and the Deputy Prime Minister, Datuk Seri Najib Razak?

2. That Saiful had sought “justice” (to use the word used repeatedly by the Prime Minister) as a victim of sodomy rape by Anwar but in the charge yesterday, Anwar was accused of consensual sodomy under Section 377B instead of Section 377C (sodomy rape) under the Penal Code?

Only on Wednesday, Abdullah said:

“Another person looking for justice is the victim. You seem to forget Saiful. You think Anwar is more important.

“This is an issue of law. Somebody feels that he needs justice and he makes a report to the police. And the police, therefore, have a duty to conduct investigations, to question him, to invite others to assist in the investigations.

“If there is nothing, no evidence whatsoever, drop the charge. Drop the whole thing, the investigation. Don’t do it. If there is evidence to charge, they have to charge. You can’t stop them from doing that. They have to think of Saiful.”

Clearly, the police have found that there is no evidence to support Saiful’s allegation that he is the “victim” who is entitled to “justice” and “police protection”.

Was the police “thinking” of Saiful to accord him “justice” when it decided to charge Anwar for consensual sodomy under Section 377B?

Would Saiful be charged with lodging a false report of sodomy rape?

Abdullah had said that he had been informed by Hamid “about the police decision to charge Anwar” (NST 7.8.08) – an involuntary and unconscious admission that the decision to charge Anwar was that of the police rather than that of the Attorney-General’s Chambers.

Another travesty of justice and the rule of law when the Constitution and the law are very clear – that the police has no business to decide on prosecutions as they merely conduct criminal investigations while the Attorney-General decides on whether to prosecute!

3. That Pusrawi Hospital doctor, Dr Mohamed Osman Abdul Hamid, who examined Saiful just hours before he lodged a police report of sodomy against Anwar on June 28 stood by his findings in a statutory declaration that there was no evidence of sodomy?

And Malaysia’s system of justice has been reduced to a flurry of statutory declarations with those making them being forced to flee abroad for the safety of themselves and their family, including the case of private investigator Bala Subramaniam over his two Statutory Declarations within 24 hours completely contradicting each other with explosive revelations involving the Deputy Prime Minister in the murder of Mongolian Altantunya Shaariibuu?

Instead of launching an international campaign to defend the indefensible, Rais should remember his trenchant, valid and legitimate criticisms of gross abuses of executive power in his book “Freedom under Executive Power”, pluck up courage at the next Cabinet meeting to demand the dropping of the Sodomy II charge and further persecution of Anwar for the sake of the good name and international reputation of the country.

If Rais dare to stand up and sound the alarm in the Cabinet, there may be other Ministers – from Umno, MCA, MIC and other BN component parties? – who might also find sufficient courage to speak up against the continued assaults of the integrity of the system of justice and national institutions in Malaysia after the March 8 “political tsunami”!

Can it be CIA has been investigating this case?

If CIA also investigated the Mongolian case, they should reveal the details.

I think it is not enough to just drop the case. Those who fabricated the case will need to be prosecuted, including the police tops and UMNO tops. These people are always on the loose. We can no longer tolerate this kind of assassination!

“I promise that, under a Pakatan Rakyat government, Malaysians will never again be subjected to such gross abuse of executive power as we are again witnessing today (7 August 2008). Arbitrary arrest and detention, frivolous investigation and malicious prosecutions shall be a thing of the past. Police officers and prosecutors who launch conspiracies to defame and humiliate the innocent will be severely punished. The use of police powers as well as that of the office of the Attorney General to persecute political opponents will be criminalised so as to ensure a healthy and vibrant democracy where dissent is not only tolerated but also nurtured.

In this regard, every Malaysian’s fundamental liberties will be treated as sacrosanct and safeguarded by a truly independent judiciary guided by principles of utmost integrity and an adherence to the spirit of the federal constitution.” – Anwar Ibrahim

    —————————————————————-

That was Anwar Ibrahim’s statement yesterday. It did not come with any heading. But if it did it could have been appropriately headlined: I promise to be a good, non-hypocritical Muslim.

Yes, that short sentence — I promise to be a good, non-hypocritical Muslim — which I have chosen as the title of this piece, aptly describes what Anwar’s statement could have been called had he chosen to give it a heading. This is the crux of the problem. This is what ails our society. This is the root cause of the breakdown in morality and lack of values prevalent amongst those Muslims who walk in the corridors of power.

Corruption, exploitation, abuse of power, political persecution, arrogance, racial discrimination, no respect for fundamental liberties and human rights, and much more, are not the problem. These are merely symptoms of another problem. These are just the end-result of the real problem. The problem that breeds all these symptoms of what ails this country is that Muslims do not know how to be Muslims.

Sure, I know, you are going to now scream, “Why target just the Muslims? There are also bad Jews, Christians, Hindus, Buddhists and whatnot. So why just target Muslims for criticism? Why not also whack the Jews, Christians, Hindus, Buddhists and whatnot?”

I think now Malaysia have already achieve an Internationl fame of being Sodomy. Is embarrasing !! Now that everytime I visit overseas, I am shy of mentioning Malaysia. Because I believe in International scene, Malaysia = Sodomy.

    *************************************************
    Dear YB,

For the sake or Malaysian Economy, Reputation and “Stability” (which UMNO always threatened the Non-Malays with this word). Please persuade all politicians to practice ETHICS and focus on more important national interest rather than SODOMY !!!!

    ************************************************

There are so many crimes happening each day, there are so many backlog cases of more serious crime than a consesual sodomy, there are crimes that even cause the death of innocence. WHY ONLY PUT SODOMY on the top of the Nation’s priority?

Then I would say the Mongolian murder even deserve more attention than Sodomy, because it causes a human life.

    *************************************************

Rais will be conducting workshops in London, NY, HK and Sydney. He will use a man-sized mannequin where he will do the illustration of how sodomy takes place, the various angles and the various positions. He will also show slides of damage to the anus.

How is the religious court doing?
It is an excellent chance for the religious court to perform, to show the public that the religious court is not like the Taliban court in Afghanistan, and never comparable to the boleh kangaroo court. To prove to the public that the religious court is more reliable and adhered to real justice.
I am not a muslim, but under this hopeless situation, we seek real justice from the religious court.
Perhaps all these ridiculous ministers should be referred to the religious court, else where is the justice?

MCA started opening the mouth that Anwar wanted to adopt the hudud laws. The second day, UMNO gave MCA a big slap at the face, since MCA’s lover, UMNO, is having adultery by trying to combine with PAS to come out with a Islamic government. Since then, MCA became naked and has no pants on.

Is Rais going for a holiday around the world at taxpayers’ expense? In Western and many other countries, homosexuality is not a crime so he’s going to be attacked on why Malaysia keeps such archaic laws. How is he going to convince them that the prosecution of Anwar for consensual sodomy is justified when they can’t even understand what crime has been committed?

Oh Rais, better tell them too that consensual oral sex is also a crime in Malaysia. May as well shock your audience.

    Haha, stupid idea…

The pakatan rakyat government must provide these foreign government their side of their story, supported by the evidence of this evil and draconian ruling government.

Although unpatriotic, i hope these governments boycott malaysia, pressure our government and condemn our goverment globally. This lie and con job by the BN government must stop. Their stupid excuses and justifications which contradict their own actions and earlier statements are making us the biggest joke in the worst.

I hope all will boycott Merdeka this 31st August, and together celebrate MALAYSIA DAY, which is 16th September, the true birth of Malaysia when it incorporated Sabah, Sarawak and Singapore. Together, we show them we are NOT of TANAH MELAYU, but citizens of TANAH MALAYSIA, regardless of race, religions and political inclination.

I think we are all forgetting that the BN (read: UMNO) has decided that they can’t afford to let DSAI become the next PM (I’m sure they know it will happen) & therefore they HAVE to ensure that he is convicted at all costs!
They will come up with whatever lies, BS, idiotic excuses, numb skull actions, etc, etc. to justify their acts now.
They don’t give a damn if they look stupid or they are deemed corrupted (they know the whole world knows that!).
If DSAI becomes PM, quite a few of them are going to be in real trouble! So the end justifies the means!

The ministers here are just out to provide more proof that they are imbeciles. And the beautiful part of it is that NONE of them can see it, which just goes to prove that the ENTIRE lot of BN ARE made up of incompetent and unqualified politicians. Where the hell did they get their degrees!!!

Since our govt is ‘obssessed’ with wanting to be in the Guinness Book of Records, I believe they’ve made it … the first country ever to explain ‘sodomy charges’ to the international scene. I never know issues of the a*** take precedence in importance over economic & judificial issues. And they think by doing this it is going to improve our image? Hellooooo! Issues of the rear do not do any thing to anyone’s image. Ayoyo! Please lah, show some sense.

Hey you umnoputras, you are all so caught up in your trap and in desperation to get out, you keep going deeper and deeper into the trap by doing stupid things … the apt phrase for this … to be hoist with your own petard.

  22. #22 by yhsiew on Friday, 8 August 2008 - 3:59 pm

Rais and Hamid have always assumed Malaysians and the international community are idiots. I don’t think many of them will believe Rais and Hamid’s explanation of sodomy II – at least 90% of Malaysians do not. A person of average intelligence will want answers for the following questions before he is prepared to believe sodomy II.

    1. Why the police did not thoroughly investigate Najis and
his wife in connection with the Mongolian murder which is
more serious than sodomy, but instead focused their entire
    attention on Anwar.

    2. Why Dr. Mohd Osman had to flee the country after giving his
    statutory declaration.

    3. Why was Anwar only charged after the polling date for the PP
    by-election was announced?

    4. Why was Anwar not given a copy of the police report until
    now?

    5. ……….and so on.

I doubt that Rais dares touch on the above issues. His explanation will only make the international community more suspicious of the government’s evil intention.

In fact, the US State Department on Thursday again aired doubts over the charges against Anwar, and summoned Ilango Karuppannan, the charge d’affaires of the Malaysian embassy in Washington, for a meeting.

Anwar is only accused of sodomising one guy. But by the Govt. taking up the case that is in tatthers even before the start (see Dr Mohd Osman statuory declaration) Badawi is ‘sodomising’ the whole nation.

SPANNER IN THE WORKS OF THE PLOTTERS? http://mrsmith2.blogspot.com

Something is not right here. It seems to me some people have thrown a spanner into the works of the plotters. Surely, this couldn’t be moving according to their original plan.

Let’s look the government’s aggressive stance over the last one month with what transpired in the Sessions Court on Aug 7.

It is as though the incessant roar of the lions have ended with a squeak.

Didn’t they shout from roof-tops, “Anwar is not cooperating. He should give his blood. The DNA sample is old. Saiful is crying out for justice?”

Are the plotters backtracking, as their conspiracy falls apart like a house of cards. Or is it because the salesmen have failed miserable to market their products.

How else would one explain the RM20,000 personal bond, no objection from the prosecution , no confiscation of passport and positive remarks on the good behaviour of the accused from no other than the police during the court proceedings on Aug 7?

Are there two opposing forces at work within the establishment. One pushing on with the conspiracy and the other against it. Which one will triumph?

How did a sodomy rape case end up as consensual sex? How come a traumatized sexual assault victim suddenly become a participant in consensual sex?

Is this the precursor to an eventual withdrawal of the charge against Anwar?

One thing I am sure, Abdullah is eating humble pie?

  28. #28 by grace on Friday, 8 August 2008 - 4:09 pm

They can explain till kingdom come, no sane person will believe in their story.
Now the only ones buying their story are those inUMNO, MIC ,MCA and Gerakan. Those people have no brains of their own anymore!!
If our police, Ag and ministers are so hardworking towards ither crimes, many would be solved. In some high profile cases that we have seen, the police was so sloppy that the culprit simply got away.
But now in Anwar’s case they work overtime!!! Ha!Ha!

  29. #29 by oknyua on Friday, 8 August 2008 - 4:16 pm

Mr Smith, I like this hypothesis. I commented along that line yesterday, but it got evaporated in cyberspace – moderator may thought it was imroper.

Some hints: why did Abdullah scolded the governemnt servants last week? Anwar himself has some support inside AG’s office and provided him some feedbacks that it was against AG to charge Anwar because of insuficient evidence. So Abdullah had to shift to the lower gear… or no gear at all.

You last statement “humble pie” you think he knows what is humble pie. “Unperturbed” with the lower ranking of apporval. In fact he is laughing.

  30. #30 by boilingmad on Friday, 8 August 2008 - 4:25 pm

PSM, I think they know they’ve lost. OK, let’s say they get their chance to convict Anwar, he gets thrown into jail with the max. prison sentence – 20 years. They know come the next GE, they will be anihilated, PR comes into power n Anwar gets released. So they are only buying time now. Between now and 2012, they intend to steal as much as they can and run away. And they will run before 2012, before they get a chance to be convicted. They know the whole country is now after their blood.

This is what we have to do — to prevent them from escaping with the billions of RM that belong to the country. We must not give them the satisfaction of having the last laugh, with fat bank accounts overseas. It is therefore, critical, that DSAI become the PM before 2012.

Wasted effort again. Why do you expect Rais and other Cabinet ministers to speak up against the Cabinet.
I think we should realise by now whether one is for or against the present government is dependent upon whether one is given a juicy position. Look at some of the outspoken UMNO MPs after they are appointed Cabinet Ministers. They changed their tune almost immediately, and all public interest issues that they so craftily highlighted are no longer important. They suddenly become more quiet and to me they are just trying to harvest as much as they can knowing that everything is so transient right now. So please, just think hard and come up with concrete strategies to seek power as soon as possible. All others are mere empty talks.

Rais is using the excuse “meddling in Malaysia internal affairs” as a shield to ward off US criticisms on Anwar’s case (see todays bernama news). The US is not stupid; Rice has made it clear earlier that Anwar’s case is a violation of rule of law and human rights, which is not so much about internal affairs.

He made a deal with the Devil called UMNO. Would UMNO cry if Saiful ended in jail for the next 20 years? Not likely. Does it make any difference to Najib or Abdullah? No likely. Saiful is 23, and 20 yrs in jail means he can kiss his fiance goodbye. He is a victim not by design; he has no brain. Leave politics to others. Go back to college, complete his degree, only then I can say he has brain.

    Nostradamus Quatrains on Malaysie

In the year of the great games started by the Greeks
Hosted by the nation of heavenly emperors of times before
    In a land called Malaysie
    Great turbulence and strife engulf

A land where a Genghis Khan’s Descendant was shred to bits
Blown by the winds to the heavenly clouds
Where the accused are finally crowned
    Amid great trepidation and acrimony

Then arose among men of honor
A man of the faith of Mohammedans
Kings and Rulers let him reign
And a new nation was born

Great leaders bring forth divination and revelations
A land of many tribes divided was thus united
The color of men was blurred and lost
By great competition to give their best

Herein lies the destiny of men
Who showed the meaning of democracy and humanity
Religions and languages flourishes as times before
A land as peaceful as Shangri La

Malaysie, a stopping point of travelers must see
Back to the days of great Sultans and Rajas

    YB Rais,

You had managed to stay with your principle for many years when you were outside the Dr. M Government.

You mentioned about 18 big fishes to catch when you was made as a minister by Pak Lah. although you were not able to do it but your intention was clear that you want to do something good for the country then.

In this Anwar’s case, have you changed your principle ? If so , is it because you feel you need to pay back Pak Lah because he had made you a minister ? Or is it because that you had started to enjoy the position and money you have as a minister that you do not want to rsik to lose it ?

    YB Rais,

Please recall back the rightous spirit you had before and work for the Rakyat and country.

Police Commence Investigation To Verify Authenticity Of SD – BERNAMA (8 Aug 2008)
    —————————————————————-

The police have commenced investigation to verify the authenticity of a statutory declaration which appeared on the Malaysia Today news portal yesterday purportedly made by Pusrawi medical officer Dr Mohamed Osman Abdul Hamid who examined Mohd Saiful Bukhari Azlan………

…….Criminal Investigation Department (CID) Director Datuk Bakri Zinin said in a statement here Friday that police are very concerned about several errors and contradictions in the said statutory declaration.

He said police also strongly believed that the article published with a headline “What The IGP and AG Do Not Know…. Yet” is solely intended to skew public perception and undermine the police.

Bakri said the police were not at liberty at this stage to disclose further information regarding the matter as the doctor is a witness in the upcoming trial of Anwar.

The Sin Chew Daily today reported that Mohd Annuar Bin Mohd Salleh, the Commissioner for Oath who handled Dr. Mohd Osman Abdul Hamid’s statutory declaration, did not have his (Commissioner’s) name appeared in the updated list of “Private Commissioners for Oath” on the court official website. The code number for the Commissioner was B275. But after code numbers B273 and B274, the next code number was B276 (B275 was missing). The “B” indicates that the Commissioner works in the state of Selangor.

Former Bar Council president Mr. Yang (spelling unconfirmed) said that could be due to two possibilities: Either the commissioner Mohd Annuar Bin Mohd Salleh did not exist or the court official website encountered technical problems.

Mr. Yang, who was surprised to find the Commissioner’s name missing, said the only way to solve the problem was to ask Dr. Mohd Osman Abdul Hamid or RPK who put up the statutory declaration on his website. Mr. Yang added that it was not difficult to fabricate a statutory declaration since ringgit notes could also be faked.

Yes Rais is going on a road show to 50 cities in five continents to tell the world that the charges against Anwar is just and fair. There will be satay parties to lure attendees to slide shows, photo exhibits and talks by IGP, AG, Rais, Syed Hamid and others, never mind the matter is subjudice. Mattress and Saiful’s underwear with semen stains will be exhibited. Anwar’s DNA profile will be enlarged to poster size for exhibition.

So RAIS and his rombongan can spend their time overseas makan angin and spend our hard earned tax payers money while explaining to the foreigners on why DSAI was charged on sodomy!!! Brilliant idea on how to spend our hard earned tax payers money without shame!!! I believe if there’s a live telecast on this explaination tonight at 8pm, not many people will be watching the opening ceremony of Beijing Olympics!!!

//…”The Foreign Ministry will organise a series of information sessions overseas on the sodomy case against PKR adviser Datuk Seri Anwar Ibrahim. We are preparing the facts,” said minister Datuk Seri Dr Rais Yatim. This will give the true picture so there will be no misconceptions that can hurt Malaysia’s image…”// – The Star Friday August 8, 2008.

    YB,

There is going to be a prosecution by the State and an ongoing trial of Anwar Ibrahim against the charge of sodomy under section 377B.

If Datuk Seri Dr Rais Yatim is going on an international road show to explain the government’s justification and grounds for prosecuting Anwar Ibrahim, such a case for the government will be necessarily prejudicial against Anwar and the fairness of the imminent trial, and therefore in all sense of the word Rais’s road show is “sub judice” & contempt of court (which they are so fond of throwing on others who comment on the irregularities of proceedings in the other Altantuya Shaariibuu’s murder case).

The selective use of threat of sub judice should not be manipulated to exonerate the government from skating on its edge. :)

Please do not make jokes on the leaders of our country anymore. You all have committed offence of slandering our leaders and please be careful when you write. I would not say our respectable leaders are perfect as they are also human. However, they are still our leaders who would look after the welfare of everybody and the stability of the nation lies on how united our people and how strong our government is. Look at during Tun Mahathir’s time, everyone is so united. Only a strong government can ensure coutinuous growth within the nation. Don’t forget you have also contributed to the 8% national growth that time. So why change your direction now? A divided nation will die eventually.

With Malaysia’s achievement in the international arena, the world would like to see Chinese continues to give full support to MCA and India gives supports to MIC. These are the only parties who can truly represent the respective ethnic group’s interest in the country. I am not afraid to repeat what I said as my aim is to always unite everyone in the country. My party strongly believe in justice and humanity. Support BN is the only way we can see prosperity and better life for the young generations. For Anwar’s case, it is definitely not fabricated but if all voters agree to unite behind BN in the coming by-election and PR agrees not to challenge the leadership of Adullah, perhaps there is no need for Anwar to be charged. It’s as simple as that.

    ” COWARDS DIE MANY times before their deaths;
while the BRAVE die but ONCE” wrote William Shakespeare in the play ” Macbeth.” Would Dr. RAIS YATIM rise to teh occasion and show his COURAGE and say what needs to be said ? Or will he CRINGE in the Cabinet ?

The same question should be posed to ALL the other Ministers. Do they have teh MORAL COURAGE to do what is RIGHT and not what is convenient ?

The World would indeed be LAUGHING at us for launching Sodomy II ! The Human Rights Groups in US, Paris and Bangkok are keep a hawk-view of what is happening here. Even CNN and BBC made broadcasts concerning teh charge against Anwar. So, our Ministers should not play dumb and deaf; and ignore world opinions, unbiased.

It appears that the PM is really running SCARED of losing the grip on the POWER. It is better to hold high one’s PRINCIPLES and DIGNITY and REPUTATION than to go down the road of NO principles and no integrity and no reputation. HISTORY will look back at this sad and pathetic desire to hold on to POWER in the face of vast DISSATIFACTION of the MAJORITY of the PEOPLE! People are suffering in the face of the high prices of goods and services. Rather than tackling BASIC problems, leaders seem to be OBSESSED with SEX-related issues like sodomy, bocor, mini-skirts, khalwat, etc.

GET REAL and SOLVE REAL issues that touch teh LIVES of MILLIONS of Malaysians!

There is internal inconsistency in this statement. 1st part – If there is no fabrication it implies then that the allegations against Anwar are true. It is irreconcilable with 2nd part of statement – if PR agrees not to challenge the leadership of Abdullah, perhaps there is no need for Anwar to be charged.

The 2nd part implies political motivation. It implies that even if allegations against Anwar are true, he need not be charged if PR agrees not to challenge the leadership of Abdullah, which, if true, may suggest to many the corollary that even allegations against Anwar are untrue, he need be charged if PR challenges the leadership of Abdullah. :)

This shows that what quality of those top post guys we got here ! No proper planning, no strategy, no persistence, no brainer !
The only thing they got is power & authority, & thats make them so lame. Any Tom, Dick & Harry could do better than that ! Frankly, there are number of ways to nail DSAI by hook or by crook without the public outcry is not that tough. Even DR.M did laugh about that, like what RPK did mentioned, power can generate anything. But without brainer, its totally useless to have these goons to do something for the country. Checkmate after checkmate, aren’t these goons get tired & knows what is enough is enough.
In war strategy, if one cannot afford to confront then a retreat is much more logical & these goons also do not know how to.

Why focus on a trial that is draining the energy of the whole nation?

The focus of the world now is on China and the up-coming Olympiad.

Singapore Outperforms Other Countries Because Of Good Leaders

BERNAMA NEWS By Zakaria Abdul Wahab

SINGAPORE, Aug 8 (Bernama) – Singapore has outperformed other countries because it chooses leaders on merit, builds trust between leaders and the people who work together for the good of all Singaporeans, Prime Minister Lee Hsien Loong said.

“Weve avoided the political turbulence that has engulfed several countries around us,” he said in his National Day message which was televised on the eve of Singapore’s 43rd birthday Friday night.

He said Singapore had not had strident protests from minority communities who felt unfairly treated or unruly demonstrations for all kinds of reasons real or imagined.

Lee said as Singapore opened up, the country must preserve these strengths and he urged Singaporeans to understand that all freedoms came with responsibilities to uphold social stability and security.

The Prime Minister said despite the uncertainties in the region and in the world economy, Singapore was in a strong position.

Anwar remains innocent until proven guilty, the country is united on this fact; however to make sure that Anwar does not assume premiership of Malaysia, i do not think it is unacceptable to ‘sacrifice’ one person (who is hell-bent on being the PM) and running the country into the ground further with his novicety; for the betterment of the stability that the country has enjoyed for decades.

The opposition has made Anwar the be all and end all of Malaysia’s future according to their designs, but without a consensus, they’d be foolish to think he would be their ticket to Putrajaya.

AAB said: “Another person looking for justice is the victim. You seem to forget Saiful. You think Anwar is more important.”

To AAB Saiful is very important to his career. AAB hopes that through the ars* of Saiful he could use the law to stop Anwar from becoming PM. The person whom AAB considered a victim was not a victim to the prosecutor. Obviously the person who was entrusted the role as a victim did not fabricate the evidence well enough to be considered a victim. AAB knew only the original script but was not sure of the final performance.

AAB said: “This is an issue of law. Somebody feels that he needs justice and he makes a report to the police. And the police, therefore, have a duty to conduct investigations, to question him, to invite others to assist in the investigations.”

To AAB, the law is to be used against any person who can be charged, with or without evidence. Last year some 30 Hindraf supporters were charged for murder in causing injuries to a policeman, though murder charge was subsequently withdrawn. AAB gives the impression that in the country of 26 million, there was only one person who needed justice and he made a report to the police. The headlines in the papers for the past one month show that the entire BN government spared no efforts to conduct investigation. The AG office finally took the case to court. It appeared that the person who needed justice violated the law, and he was not charged only because he was the witness for the prosecution. AAB statements implied that there were no other people who needed justice during the last month. But there were at least two persons who made statutory declarations seeking justice not only for themselves as Malaysians, but for all Malaysians who value justice. The SDs informed the government that justice should not only be served to the murdered victim, Atlantuja but also to all Malaysians who want rule of law to prevail in the country. PM AAB has not said that Atlantuja should have justice too. Does AAB think that Saiful is more important?
AAB: “If there is nothing, no evidence whatsoever, drop the charge. Drop the whole thing, the investigation. Don’t do it. If there is evidence to charge, they have to charge. You can’t stop them from doing that. They have to think of Saiful”
Saiful has now become a national ars* treasure where the police, the AG office will have to keep in their thought. Hundreds of police personnel have been involved directly and indirectly when the police decided that they have to think of Saiful’s ars*. They do not think about the victims of snatch thieves. They did not have to think about robberies and burglaries, and murders when Saiful’s ars* takes priority. They caused traffic jams through road blocks just so that people did not protest at government malfeasance in taking as absolute truth every word written in Saiful’s police report concerning his anus. The police found that Saiful was not raped. They should have dropped the case against Anwar and charge Saiful for making false police report. Instead, they chose to invent a new charge against Anwar. What happened to AAB’s instructions? Is AAB no longer in control?

Anwar remains innocent until proven guilty, the country is united on this fact; however to make sure that Anwar does not assume premiership of Malaysia, i do not think it is unacceptable to ’sacrifice’ one person (who is hell-bent on being the PM) and running the country into the ground further with his novicety; for the betterment of the stability that the country has enjoyed for decades. — zak_hammaad

Talking about hell-bent, AAB is also hell-bent on clinging on to the PM’s post (pretending to handover to a person whose balls he holds in order to stall for time) Najis is also hell-bent on being the PM (remember Razak Baginda’s wife saying that her husband is NOT the one who wants to become PM? everyone knows who she is referring to.)

Anal sex is not a homosexual act that it once was but is today practiced by heterosexuals and bisexuals. Malaysia needs to keep in step with developments elsewhere, where you do not have to be of the opposite sex before you could take your marriage vows.

To digress a little, as this is an important issue:

    Excerpt from Malaysianinsider:

“Press statement from the Malaysian Bar Council

The Bar Council’s forum scheduled for tomorrow will proceed. The concerns of some quarters including a number of cabinet ministers such as the DPM, Dato’ Seri Najib Razak, Dato’ Hamid Albar and Dato’ Zahid Hamidi, various NGOs and Pas are noted.

We reiterate that our concern is to address the issues of conflicts of laws facing families caught between the separate jurisdictions of civil and Syariah laws.

The Bar Council is not questioning the provisions of Article 121 (1A), which confer Syariah jurisdiction over Muslims on the Syariah Courts.

The co-existence of two separate legal jurisdictions is not a new or uncommon phenomenon and there are naturally issues of conflicts of laws arising from the different jurisdictions.

We recognize and respect Article 121 (1A); however, there is a strong viewpoint that it is unjust to compel anyone to be subjected to laws and courts that are based on a religion that they do not profess, and this viewpoint must be addressed.

Our concern centres on the manner of dealing with the current conflicts. There must be a concerted effort by the Government to address these issues constructively and not pay mere lip service to the concerns of many.

Although the Bar Council is heartened by the PM’s recently-reported statements calling for more interfaith dialogues to be held in order to promote and ensure religious harmony among Malaysians of diverse beliefs and we welcome his assurance that there is space for such dialogues, we urge that more be done by way of constructive dialogue and meaningful debates with all the relevant stakeholders to arrive at a just and amicable solution. However, the Bar Council is troubled by the continuing calls from certain quarters that its forum tomorrow be cancelled.

These statements that claim the forum will create misunderstanding, anger and tension, are in stark contrast with the PM’s assurances.”

Going by what had been said about such fora, that it would create tensions, real or perceived, is not acceptable in this age and time.

What if we look back in time when religious teachings were brought to our shores way back in the early part of 1800’s. Surely then the people would have been apprehensive and doubtful about them. But because of their receptiveness, the people did discuss about them. Else how would one learnt about Christianity, Buddhism or Islam, and embraced the religions and became Buddhists, Christians or Muslims?

Now, if people of yore could discuss about religions, why not the people now? We have the benefit of more up-to-date information and hindsight to help us discern deeper and better, than to fear discussions which may help clarify issues which are of concern to our society.

Those who oppose for the sake of opposing have reasons or motives known only to themselves. And it is not justified. Religions should not be a monopoly of or confined to just a particular ethnic group, let alone being manipulated by interest groups or being politicised.

People who are God fearing should know that a religion does not belong to them alone. It is God’s message and teachings for all humanity. So, don’t treat religion as a possession or commodity which would be used to position oneself in matters social, political, and economic. It is just not moral.

Even our PM had a lot to say about Dr.M once when he aligned himself with TR and MH. Najib had split personality then when he just sat on the fence and waited before throwing in his lot with Team A. Lots of examples in Malaysia e.g. Ezam, Chandra Muzaffar, Lee Lam Thye, TR, Wee Choo Keong, Ibrahim Ali, that Kinabatangan guy, Pairin and his brother etc.

That’s politics. But if you have shown again and again you no idea how to run the country and having the Rakyat’s trust and respect then you better run away. The longer you stay the longer we suffer.

What is the point of doing all the explanations to the world while all you can do is by merely restoring the integrity of our justice system? Drop DSAI’s case right now to regain the already little-to-none dignity in these BN goons.

And may I also suggest to LGE that since SPR announced the voting Permatang Pauh’s by-election date on the 26th of August, which is a Tuesday, and since they are not playing according to the rules, you shall also break all rules and declare the said date as a public holiday for Penang folks to convenient the PP’s voters to cast their precious votes. Just a suggestion though.

  135. #136 by Jeffrey on Saturday, 9 August 2008 - 7:15 am

Undergrad2 has cited at 02:29.05 above section 377A (definition of what constitutes “carnal intercourse against order of nature”), 377B (covering where such an act is voluntary) and 377C (covering where such an act is forced upon someone). These are very misunderstood provisions.

First they are very “sexist” provisions against only men. “Dykes” (a disparaging term for lesbians) are not capable of “carnal intercourse against order of nature”. Why? Because 377A defines the wrongful act of “carnal intercourse against order of nature” as being “sexual connection with another person by the introduction of the penis into the anus or mouth” and only men have, women including dykes don’t have penis……

Second, these provisions have no sole application to homosexual men. The wrongful act of introduction of the penis into the anus may be engaged heterosexually betwen a man and a woman! It also means that a woman partner can be active voluntary participant and encourages the man to do it but it is only the man who is giver and doer with his instrument who is punishable for the offence – not the woman or for that matter any “receiver” of that penis, whether man or woman.

So strictly speaking what Hamid says is right : the one who engages in anal & oral sex as “giver” and doer in consensual situation (377B) commits the offence, but the other voluntary partner being done to as “receiver” commits no offence!
So the active giver and doer is the only one committing offence where it is consensual (377B) and more so if it were by force (377C)! Saiful cannot be charged because based on allegations he is being penetrated or not penetrator!

As these provisions cover introduction of only the penis into the anus or mouth, they exclude introduction of plastic dildo, finger wood, tonque or other objects, therefore only fellatio is punishable not cunnilingus (therefore excluding lesbians)! Necessarily introduction of penis into any orifice (ear) other than anus or mouth is also not an offence! Also excluded sex with animals (bestiality) covered in other provisions of Penal Code….

All considered 377A, B and C are archaic, nonsensical, sexist provisions that should be repealed than enforced. Where they are enforced, it is often selective and engendering blackmail by the complainant.

Good morning to all, Opening of Olympic was great. Wonder if Malaysia boleh? What do you think?
Anyway, just got 2 topics to touch on today.
    1. True picture from Rias? Ever heard the word tranparent? Well you gotta imagine in an interrogation room. Depending which side you’re on, it’s amazing how this one way mirror thing work. Obviously Rias trying to be as truthful as possible, the only problem is, he forgot his on the interrogator side. To him, he only sees what others don’t. The rakyat is being interrogated? Emm
    2. ‘Back-door’ about DSAI, comment by Dr Chandra Muzaffar?
Chandra (Indian?) Muzafarr (Muslim?) Correct me pls. Is this name front or back door to Islam?
Dr Chandra’s, no doubt is knowlegeble and most time are correct in his views and observation. With due respect, sometimes he can also be wrong, right? His entire comment regarding Back-door and Anwar is most intersting and “Well Said” (although not all are correct) BUT may not be “Well-Motivated” – one must question his true motives for saying it.
    Why now? Timing is everything?
Here we are, trying to move ahead despite being subjugated by cruelty from PR’s Opposition, here comes a smart aleck telling DSAI the ‘IDEAL’ manner to form Government. Like most ‘Critic’ sitting on the bench, or ‘political Scienctist’ – Living in Jupiter, its easier to just give Ideals and comments. There are many of his view-points that can be wrong this time.
Anyway, the bottom line is: Dr Chandra’s view, Anwar was impatient and he is amazed how PR can form New Government withing this short period since March election. So, its not right, its called Back-door? The truth is, giving today’s situation – Its the ONLY door left! Consider Dammm lucky mate, at this rate the Goment is plotting, one do not need to go through windows or lobangs but then again, you can tell also, right?
Yes, Anwar was impatient but then again, that was in 1998, say – that’s 10 long Yrs!! THINGS MOVED BRO So, how long more, one has to wait to qualify ” Just Right”?
Know what? DSAI knew perfectly what price he’s paying to become PM. The truth is, he paid and sacrifies much more and above all, he stood by his dreams!
What about Dr Chandra? He do not have what it takes to become a politician, thats why I won’t blame him to become a ‘Political Scientist’ – big word eh? Bottom line here. If there’s nothing good to say about the coming New Government, then shut up! Meanwhile save all comments to himself and wait for his turn, Korrect?
It is paramount now that whatever we read, ask these questions. Is it helping or is it delaying or diversifying the formation of New Government? All the same, we need to be open minded for constructive criticism but not to be so open minded until the brain also drop out, ya? Cheers!!!!!

“Hasanuddin is a very close family friend and he allowed me the use of the apartment for my political meetings,” Anwar said…..

…..“Several of them have been questioned (by the police), including Hasanuddin, and the police know we can account for our meetings there,” the opposition leader said……

…..Anwar said that on the day of the alleged sexual assault he met an economist and a former banker, among others, to discuss economic strategies that his opposition alliance could pursue in the five states it controls…..

Rias is a nobody….never contribute to anything…just talk talk talk.
I dare him to arrange a talk show..in USA and explain.
The audience will treat him……..as the comedian of the year…or a real UMNO hypocrite.
I was watching the Olympic Show and was thinking…..30 years ago..we were more advanced than China. Now look…where are we.
Surely Rafidah…..Mahathir and Najib….can see the vast differences. Why? Is it Malaysians are so stupid…..can never do what the Chinese can do? Are we that lazy……or the other way round…UMNO is lazy?

How can they even use the word rape? Logically thinking, how would it have been possible that a physically stronger young man like Saiful could have left his goal post wide open without any attempt to save himself against his alleged attacker who is not as physically strong as himself?

Why the sudden need to obtain justice for Saiful, who has indulged in the alleged act which is “consensual” any way (if it happened at all)? No urgent justice for Altantuyaa whose body was blown up by C4 supplied by the military? What about the girl who was raped INSIDE the police station itself? Why no special mention on the headlines everyday?

We Malaysians are tired of seeing sodomy on the news headlines everyday. The police could do better by setting task forces to go all out to look for Sharlinie, not creating road blocks out of paranoia. And the PM should concentrate on other things, don’t just be thinking of Saiful and justice for his anus.

Olympic …. aiya, Malaysia sure can do better than China, ie if we have not spent so much of “innocent” corrupt money on projects like PKFTZ costing billions.
I believe Rais will not call on dropping of the case as he wants to uphold his post more than anything else.
He wont be goin rounding diplomats to “argue , justify and clarify” BN’s action against DSAI and rule of law in Malaysia.
He should also clarify the reasons why Dr. Chua and partner not charge in court for flouting 377b !
It’s clearly double standard but ultimately it’s going to be a double edge sword against BN

Our Foreign Minister, Datuk Seri Dr. Rais Yatim is doing the thing he is supposed to do and he has the duty to let other countries understand what the government is doing and the fairness and transparency that the police has shown during the investigation stage. The West is taking an opportunity to downplay our reputation so that they can gain World’s attention. Please do not fall into the trap of the West.

Yes, I have watched a bit on the opening ceremony of the Olympics last night and I would say that I am not that impressed. Several friends of mine and I think that Beijing still has a lot to learn from Malaysia in how Malaysia organised the 1998 Common Wealth Games. It is no doubt that the opening ceremony of the Common Wealth Games in 1998 is much spectacular than yesterday’s one. However, we are confident that Beijing will improve it along the way and show us they have the ability to organise such an event.

The ‘sodomy II against DSAI’ is the contribution and the service of the BN government to the people of Malaysia, and the whole country of people the laughing stock of the world.

What is this government doing anyway? One let down after another.

  155. #156 by ALLAN THAM on Saturday, 9 August 2008 - 12:55 pm

let us ask ourselves few soul probing questions.
Why it that a need to explain to world on the charge? Only if the sodomy charge has been based on our law and proper and professional investigations have been done by the police. And should all law and procedures have been follow why it that a need to explain then? Why majority of the people in Malaysia do not believe in the sodomy charge? Why they are so many conflicting reports on the web indicate this charge has been political conspiracy?

Now the fact that a senior cabinet minister find there is a need to explain to the world speak volume on this faulty charge, otherwise why it a need to do so?

It was very unfortunate that those other partners in BN still remain to be silent and keep to themselves and dare not to say anything and keep subversive to the big brother of UMNO.

Why spend tax payer moneys overseas to tell the world Malaysia justify this sodomy charge? This is simply insulting to all Malaysian and BN has keep tikam the rakyat from behind and after which rob the people money and waste it unnecessary projects, such this of embarking time and money to explain the charge.

The final analysis is like it or not BN will have to go and another party or coaliation, such as Pakatan Rakyat has to take over for a complete change to be possible. Only then there is hope for a better government

Kasim , Beijing learning from Malaysia 98 commonwealth ? …. pity u lah. we are no where near. I was at the Bt Jalil Stadium and there is nothing so wonderful about it.
I dont think Malaysia would be able to copy what Beijing did last nite. Choreograph ? sorry la.
Anyway, Malaysia is not ready at all to organise an event at such big scale like Olympic. We could not even organise our traffic nowadays with the BN’s obsession with Anwar.
We would probably make it if PR take over the feds and channel the money to right projects. not white elephants and cracking highways

    I agree with Jeffrey QC.

    This is obviously SELECTIVE PROSECUTION.

It’s obvious that if the charge relates to both Oral and Anal Sex, then, there would be many millions of such “criminals” in Malaysia.

Statistically, Malaysia has a total population of nearly 27 million people. Approximately 63% of them, or 17 million are in the age 15-64. Let’s assume 80% of this number are sexually active at some stage in their life. Various sex surveys have shown that something like 90% or higher of sexually active adults engaged in either oral sex and/or anal sex. This suggests that 17 million x 80% x 90% = 12 million are potential criminals.

And based on Jeffrey QC’s claim that only men are the criminals, this suggests that there are probably 50% x 12 million = 6 million criminals running around in this country!

Assuming each of these sexually active people engages in such act at a very conservative rate of 1 per month (I’m sure the average act is much higher than this), this suggests that 6 million x 12 = 72 million criminal acts are being conducted every year.

In the last 10 years, there should be 72 million x 10 = 720 million of such criminal activity! 720 Million!

Over the last 10 years, I have heard of 2 cases being prosecuted, out of a potential of 720 million “crimes”.

They both happened to be Anwar.

Does anybody dare to tell the international world that this is 2 prosecutions out of a possible 720 million “criminal action” is “random”?

I think DSAI does have a case, when he says it is “selective prosecution” is it not?

I don’t know about you, but the prosecution team – if they still have sense of common sense left – should immediately drop this case!

Maybe Malaysia will stage the 2020 Summer Olympics and Malaysia too would like to showcase its history during the opening ceremony, just like China did last night. Malaysia would then get 2020 performers to show that Malaysia is the epicentre of corruption and sodomy under BN.

  162. #163 by Jeffrey on Saturday, 9 August 2008 - 4:55 pm

There are a few cases but they are not “consensual” but forced anal or oral rape under 377C almost invariably part of a package of multiple other offences committed at same time such as abduction, normal rape, causing hurt and robery together. Where the act was voluntarily participated by the girl, (where her parents lodged reports) it is not consensual in legal sense because the girls were underaged deemed incapable of granting consent. Consensual between adults above age of consent (without aggravated circumstances of other offences) – first time I am hearing it!

KUALA KLAWANG, Aug 9 (Bernama) — Umno has to change for the better otherwise the future of the party is at stake, said its Supreme Council member Datuk Seri Dr Rais Yatim.

He said he could foresee this as he had been with the party for a long time.

“The first test is the Permatang Pauh parliamentary by-election on Aug 26 and if Umno is weak, we will not be able to defend our foundation.

“What I mean is that Umno has to shine again and we must know our weaknesses. We should not be unduly worried about the clash under whatever circumstances.

“After the contest, we have to come to terms with our views. But this requires energy and thinking,” he told reporters here Saturday.

…….”Some people say it is easier said than done. In politics, it is difficult… more so in a struggle, but we must endure,” he said.
    —————————————————————-

It is good to hear such statements made by Rais. I hope he dares take the lead and bring UMNO back on the right path – the path which is just, upright and devoid of corrupt practices.

  170. #171 by Jeffrey on Sunday, 10 August 2008 - 11:38 am

It is not a question of graphic. We should endeavour to be precise. For example an oversized clitoris is not an undersized penis to make dykes punishable under section 377. Otherwise a lot of problems when we’re loose and fast with words to construe them the way we want consistent with our agenda. In blog threads subsequent to this one, the argument put forth by Dawsheng focuses on whether the forum organised by Bar Council was an insult to Muslims or Islam, so the question is what really constitutes “insult”, and whether it is to be determined by the 20 NGOs opposing the forum alone?

It is the Malays who can either make or break the status quo of M’sian politics. Without Malay unity there can never be national unity.

Many comments here of late are reflective of the general rise in anti-Malay and Islamophobic stance taken by non-Muslim minorities, and if they want to compromise national stability for their vested political interests, then be prepared for many more May 13’s!

    zak_hammaad,

“It is the Malays who can either make or break the status quo of M’sian politics. Without Malay unity there can never be national unity.” — The topic is DSAI sodomy charge 2 … how is this related to this topic? I noticed it is a Malay who is charging a Malay of sodomy, so, what exactly are you trying to say here?

“Many comments here of late are reflective of the general rise in anti-Malay and Islamophobic stance taken by non-Muslim minorities, and if they want to compromise national stability for their vested political interests, then be prepared for many more May 13’s!” — No, I disagree. Despite the 170+ comments here, I have yet to see such comments that would cause a repeat of May 13 here.
