Good news for BMC controversy

During the debate on the last ministry – Home Ministry – on the 2007 Supplementary estimates in Parliament late yesterday evening, DAP MP for Serdang, Teo Nie Ching and I questioned police conduct in the Bandar Makhota Cheras (BMC) “thug and police violence” following public protest at the rebuilding of the barricade by the toll concessionaire, Grand Saga.on Tuesday night.

I had earlier met the Works Minister, Datuk Mohd Zin Mohamed at the MPs’ lounge and I asked why his Ministry could not resolve the long-standing BMC access road issue.

Mohd Zin said he has a formula to resolve the issue which he would be bringing to the Cabinet today.

I understand there is good news for the long-suffering residents over the BMC controversy.

you know what the formula is, is to build more solid wall, destroy the road so that BMC force to use the longer road…. that’s the formula ,,,,

If you can read Chinese, please read this article by the editor of SinChew:

    http://opinions.sinchew-i.com/node/5795?tid=5

The main points he raised are:
    – The petrol is subsidized using tax money
    – Forcing the residents of BMC to take the extra 6km will waste an additional RM230,000/day.
    – This means RM85m is wasted on the extra 6km road per year!!
    – Out of this RM85m, RM65m is subsidized using our tax money (our money)!!
    – Further suffering includes the toll paid, the time and energy wasted, the suffering of the residents, the air pollution caused, accidents caused, etc.
    – The above waste does not bring any economic value for the country. It only creates economic losses, suffer, and air pollution.

Do you see the logic now? BN = rubbish government!!!
Mr.Killer, see how you stupid UMNO bosses manage the country. If you want to debate with me, welcome!!

    Greetings! YB Kit

Thanks but it’s still early to tell if we can see the result.

Perhaps their so called formula may be just another ice-berg not the whole of hidden island that sank Titanic.

    Best regards.

    YB Kit,

I wonder if something can be done base on this:

THE Government is not allowed to declassify highway concession agreements due to a confidentiality clause in the contracts, says Works Minister Datuk Mohd Zin Mohamed.

He said before the Government did this, it would have to first get the consent from the parties involved.

“If the Government reveals the concession agreements without the companies’ consent, the concessionaires can take action against the Government for failing to abide by the ‘confidentiality’ provision in the agreements.

“The government’s credibility and image will also be questioned and it could affect investors’ confidence,” he said in a written reply to Teo Nie Ching (DAP-Serdang).

Base on the above, why is the highway concessionaires allow to increase the toll charges if the agreement is under confidentiality? If the people are not allow to see the agreement, how do we know that the contract allows them to increase the rates? Can we take the word from the ministry that it is allow in the agreement? If the ministry says so than the ministry can be charge under the OSA for revealing the terms of the agreement which they said it cannot be revealed due to a confidentiality clause in the contracts?

The basis is that the toll charges cannot be changed if the people do not see the agreement that allows it.

GE 13 – No matter what, we must ensure that racist umno bn do not regain the power like they had for the past fifty years.

If the problem can be finally resolved, I am happy for the people of BMC. However, I still want to know why we have to come to this stage before steps are being taken. Why are citizens made to suffer, injured and went to lock up and hospital? What kind of governments are we having at various levels? Do we have policies on toll roads within the Klang Valley metropolitan area, housing developers’ right to build roads to their projects and citizens’ right to have toll free alternatives? Why every damn thing in this country is decided on piecemeal stand alone basis? Why every damn concession agreement is a secret subjected to OSA? What public interest and national security are we talking about here? If privatisation agreements have implication on public interests, then how can they be a secret? What perverted logic is this? And how can toll road agreements be a threat to national security? May be they have, but someone must explain to the people why it is a national security issue. Is it because some of our privatised highways are also fighter jets runways? I am just giving you some ideas to bs, but please don’t try to use it, Ministry of Work!

I would like to get answers from anyone here with forensic knowledge. My house in Kedah has been burglarized yesterday and I am at oversea worrying about my family and anyone that is affected by it.

Police report has been made but the police don’t seem to know what to do all the time, these “tak boleh buat apa apa” and “tak tau larr” responses have been going on for years… and still they don’t know what to do!! there are no proper procedures, nothing.

Now, there is this lighter left by the burglars that my parents found and it may contain fingerprint evidences but why oh why didn’t the police retrieve it to do forensic!??

    My questions:

    1. Do we(malaysia) have fingerprint databases that allow easy search for the person we are looking for?

    2. I heard that malaysia forensic is the 3rd best in the world, is this true!??

    3. Is the police stupid!??

  8. #8 by max2811 on Friday, 30 May 2008 - 3:29 pm

It’s not just about the Gov. The problem is whenever there are any protests by non-malays, the protesters will sure be roughed up, beaten and kicked.

The police can even team up with thugs to beat up innocent ppl. What a shame! Racist mentality.

Decendents of the Dragon. Toughen up physically. Don’t fight like sissies. UMNO should know violence begets voilence. Don’t push the dragons against the wall. You can be the majority in Msia. We are the majority in the world.

Limkamput, you took the words right out of my mouth.

In this damn country, the citizens are raped first and if they protest, they are brutalised with the help of licensed institutional gangsters till they either end up in hospital or in jails or both. It is standard modus operandi of these modern robbers supported by a corrupt Govt.

Rarely we see any good examples of those cliche CSR crap the big money concerns talk about but never practise.

  12. #12 by KKK on Friday, 30 May 2008 - 3:46 pm

    From what I read:

Grand Saga own the highway so they have every right to charge toll. And build barricade to prevent people from entering for free. And police must help prevent it from being dismantled.

Barricade is a obstacle built on state land so every citizen has right it. And police must help citizen remove it.

If concessionary contract is unfair to rakyat, take the government who sign that contract to task.

Now the Works Minister is talking after questioned by LKS. He should have voiced out in the first place instead of letting the issue rots while he is keeping quiet all these while as if he wanted to watch how the situation can turn into a crisis and blame PR for the problem not resolved!!! really no good you Datuk Mohd Zin Mohamed (MZM), previously, it was Semivalue, now it is another no value, incompetent MZM!!!

Too late Limkamput. Singapore has already done this so obviously the Malaysian government copied it, thats why our highways are classified under OSA. Unfortunately due to cronyism and sub standard design, the highways can’t actually support fighter jets so they can’t let the people know.

The rakyat and PR had already removed the barriers, we do not need the cabinet to say so.

    Fellow Malaysian,

So do you see the picture? We need strong oppositions and PR to rule a few States in order for racist umno bn to toe the line. If racist umno bn is still in full control like they used to have, do you think this barrier will be removed?

But racist umno bn is still far from good, we need to continue the support for PR to ensure racist umno bn is humble down.

    From Malaysiakini
    Breaking News!

    Cabinet orders Cheras barriers removed
    May 30, 08 3:28pm

Finally some good news for the residents of Bandar Mahkota Cheras (BMC) – the federal government has ordered that a toll-free access road in their neighbourhood should not be barricaded.
    MCPX

BMC Open Road Committee chairperson Tan Boon Hwa said that he was informed of this by Transport Minister Ong Tee Keat this afternoon.

Tan said that Ong called him up after the weekly cabinet meeting to inform him of the cabinet decision taken today.

The residents have been fighting for years against toll contractor Grand Saga Sdn Bhd to remove the barricade placed by the company to force the residents to use the tolled-Cheras-Kajang Highway.

Works Minister Mohd Zin Mohamed, who visited the site this afternoon, confirmed the cabinet decision to the gathered residents, numbering some 300.

He told the jubilant residents that the access would be allowed immediately and that Grand Saga would be tasked to repair the road.

The minister however was unsure if the free access would be a temporary or a permanent feature, adding that it depended on the outcome of a court case between BMC developer Narajaya Snd Bhd and Grand Saga.

Also present was Grand Saga executive director Zainal Abidin Ali.

I’m glad that finally something good is coming out of the whole controversy. Unfortunately, it only came after the fight and bloodshed. The BN govt could easily have taken care of the matter at the early stages of controversy BUT FAILED. Not only did the govt allowed the matter to dragged, it escalated the tension by the high-handed manner of the police and FRU’s.

Finally, after the hue and cry, are we supposed to feel gratitude to the govt for this? NO, DEFINATELY NOT. It is the govt responsibility to listen to the people and resolve the matter.

What I’m glad is that it’s all over, for now.

  22. #22 by limkamput on Friday, 30 May 2008 - 4:58 pm

We shall NOT say a word of thanks to Ong Tee Kiat, the Cabinet, the Work Ministry, Grand Saga or the Police. Show them middle finger may be. Imagine without March 8, do you think they will make the decision the way they did? Why must they make the people suffered so much before they get off from their big fat a**?

Having said that, I am also not happy with the way PK handles the situation. I still want PAS, PKR and DAP to show a more united front on issues of concern to the rakyat. Don’t be racist; don’t always think of your own political survival. If you people have consistently done the right things for the people, the people irrespective of race will support you. We must all together make racism out of fashion.

But we are watching closely. We are beginning to feel a sense of hopelessness no matter who govern this country. Please prove it to me that I am wrong.

Whether the concession agreements are secret or not, I say it is time the government review all of them. Why secret, why a threat to national security? Who own all these concessions? How do we know whether the terms are fair or otherwise when the agreements are secret?

I believe toll rates are decided based on, among other factors, the cost of constructing the roads. How do we know the cost is justified? Was there cost padding? Why the government must guarantee revenue/profits of toll operators? Is this not “privatising profits” and “socialising risks and liabilities”? We call ourselves on the threshold of becoming a developed nation. Is this a cruel joke or what?

however, there are other ways Grand Saga will retailiate, legally. We have seen it on the Sprint Highway (in front of Eastin Hotel), where the timing of the 3 traffic lights are intentionally set to cause jams so everyone will turn up and pay the toll to get into PJ.

Siktainsai…..Almost all shops at SS15/4 at Subang Jaya are robbed….broke in..or forced in by armed men.
I have experienced two robberies…within one year alone!!
It is waste of time…to hope for police to catch the crooks. They have a very very poor track record…in solving crimes..nowadays.
In olden days…if one receive a bullet..for extortions..you report to the police….they will go all out..to catch the crook..as one bullet means…that guy has a gun. Those were the real crime busters of yesteryears.
    Nowadays….they eat …grow fat…doing nothing.
And even manning traffic lights…you can never see them…when it is pouring cats and dogs..or with a big traffic jam.
Yes..Police Dept….should have all the finger prints of all Malaysians…and that lighter finger prints should help..but being a lighter..the whole print may not be visible. Even if full print is there….don’t expect ..present low class police dept. .out to solve crimes. You may be seeing too much crime movies..hahahahaha
This is a 25 year old problem…take a long time to change for the better..and I hope they are doing it sincerely.
But right now..we all will need to submit police reports..purely for our insurance claims…yet that is another group of people…never keep to their words…to compensate fairly to victims.
So …don’t depend on police to do their rightful job.
Just try to install….all sorts of anti theft devices…particularly….an alarm system make so loud noises.. to scare robbers away.

Now is the time for the PR government to relief the road tolls for the residents of Selangor. A survey will show that many of the toll roads can be bypassed if the State Government were to construct roads to connect many of the housing estates situated on state land. One example is to link Damansara Perdana to Sri Damansara. This link will bypass the LDP toll at the Kepong side. A committee should be set up to study this.

Make sure the road remain open even AFTER court case. If the court does not decide in the residents’ favor, press the Federal government to compensate for loss of toll collection revenues and keep the road open permanently. Nevertheless, even if you are the latter, of course you’re welcome to comment!!! But stop spewing rubbish from your foul orifice by making wild unsubstantiated accusations cos to be honest, it stinks! And for your next round here with a different username, please do yourself a favour. Pack more ammunition and evidence!!

One VERY important thing to keep in mind. DAP/PKR/PAS coalition has only been in power for barely 3 months/90 days and we could see a significant shift in the landscape. How do you expect to shift the tectonic plate in a country that has rot for decades!!? So I would say they have done one hell of a good job! Dare you disagree, Killer? : )

Honestly speaking the toll concession agreements throughout the country are legal “Highway Robbery”, a project by Barisan Nasional for the Rakyat. This is one of the reason why PR will take over BN as the government. The new government then can open the books for all to see, so that all will have a fair deal. The only way to fix our country’s problems is to elect PR to be the government.

  43. #43 by Godfather on Friday, 30 May 2008 - 9:06 pm

The argument that concession agreements are under the OSA is total bullsh!t. The concessionaires use the agreements as security for their financings, and most of the financings are in the form of private debt securities, which are placed with EPF, and other pension funds. These securities require a placement memorandum which explains the terms, the risks, the project contracts and the memorandum has to be approved by BNM and the SC, on the basis that the securities may be sold to the public in the secondary market.

So what’s so secretive about the concession agreements ? They are simply worried that public sentiment would turn against the BN thieves for negotiating such lopsided contracts in the first place. Otherwise, there is nothing to hide.

Killer, are you with me so far ?

Someone in Malaysia have done it, so if your policies and ideas are judge by the voter as worthy, then you will be elected into office, if not, Malaysia will just ignore you.

You have taken these from a supposedly Keadilan website, but you must be careful about the authenticity of the accusations. First, there is no such bank as Israeli National Bank, even in Israel. Secondly, these people are not so stupid as to bank with banks in Singapore, because they are paranoid about being blackmailed by the city state. Thirdly, there are far more secure places in the world to have unnumbered accounts e.g. Luxembourg or Cayman Islands.

By re-posting the above without proper attribution to the original website that hosted such accusations, you are putting yourself and Kit at risk of libel.

Just to side track, why govt keep subsidizing foreign car, motorbike, on petrol,
why not, govt sell foreign vehicle owner petrol coupons (say RM15 for 5 litre) at border post, and ask all petrol kiosk to only sell to foreign vehicle owner with pet. coupon. Give some incentive to kiosk owner, say when they take the pet. coupon to claim from govt office, give them (say extra 4 sen / litre).
In this way, govt can easily collect a few million up front, unuse coupon can be refund say with deduction 4% charges. If car owner lost coupon , sorry lah !
YB Kit, what do U think ??

    limkamput,

Calling for the end of racism will not end racism! Like I wrote earlier, nobody can end racism – which does not, of course, mean that we must accept or condone racism and all its consequences when we formulate public policies or in our policy deliberations and day-to-day decision making as public officials or duly representatives of the people.

Let me re-post the critical part of my posting which you conveniently left out:

“What you can do is to make it irrelevant when it comes to public issues and decision making”.

In countries like the United States with a history of some 200 plus years, where discrimination along race, religion, gender, sexual orientation etc is illegal, racism is still rampant today and has as recently as this month been the subject of strong criticism by the world body, the United Nations. It is many times more difficult for a country like Malaysia with a history of a mere fifty years, where racism is institutionalized, and where racial discrimination is legal.

I don’t think anybody can disagree with that! I cannot see how that translates into an acceptance of racism and all its dire consequences.

  60. #60 by undergrad2 on Saturday, 31 May 2008 - 2:01 am

Racism is the belief that members of each race possess abilities specific to that race so as to distinguish it as inferior or superior to another race. When you discriminate based on such a belief it is racial discrimination. Discrimination is a practice, and racism a belief – so that we are clear of the meaning of those two terms.

Good news for BMC controversy, bad news for Chang Jiun Haur, Chan Siew Meng and two others : they are being investigated for causing injuries/attempting to cause injuries to FRU personnel for which they could be charged for attempted murder and rioting.

You should monitor and keep radar on this case. It has all the elements that could lead to grave injustice being perpetrated.

First of all it is hard for us to understand how if Chang Jiun Haur was the driver of the car, the other three passengers could be implicated in causing injuries/attempting to cause injuries to police personnel. Unless one imputes to the 3 as having common intent as driver to do so.

Or the other way of looking at it is that the other 3 could corroborate Chang Jiun Haur’s story that they were mere onlookers caught in the fracas, a version which if believed, would place the FRU personnel in very bad light when they beat the day lights out of Chang Jiun Haur, and therefore there could be a motive for perpetrators of the beatings to justify the violence by implicating the other 3 in common intent to injure, in order to discredit their corroboration of Chang Jiun Haur’s testimony.

The AG office should tread carefully here and not formulate a charge against the 4 based just on the version given by the FRU personnel there….There must be independent corroboration from other onlookers who were not police or ‘thugs’ sent by those who have vested interest in erecting the road barrier….

This is not a normal case of police’s word against a thug’s, when the former has vested interest in making their version stick (that they were giving him what he deserved) so as to deflect public focus on their own actions of beating up Chang.

It has been rumored that the authorities’ version is that 2 officers were injured, one on the hand and one on the thigh, after being knocked by a car. It is pertinent to find out where were these two officers hospitalised or treated as out-patients and whether these injuries were consistent with those inflicted by a car or scuffle with residents demonstrating there that night.

To be it is preposterous to threaten a charge of attempted murder or causing grievous hurt just because of a cut or abrasion on the hand and one on the thigh that at the very best requires out patient treatment of some antiseptic and admionistration of plaster!
It is really making mountain out of a miole hill!

To lay public like us, granted, even we were not there to witness events, it seems incredible that the young man Chang with 3 other pasengers would have the audacity to try mow down 12 FRU personnel in full gear….

It is potentially grave injustice to see a young man beaten up to the extent that he now lies in the intensive care unit of a hospital only to be charged for attempted murder or causing hurt when he recovers just because of some need to cover up brutality caught on YouTube (if the young man’s version of being innocent onlooker were true) …..

This is especially where there are political undertones. Malaysiakini reported that according to Deputy Minister for Home Affairs, “in the confusion, residents were beaten up by unidentified thugs and they decided to use more force by using a car to knock police officers over.”

How could he say this before investigations started???

Why would residents ‘beaten up by unidentified thugs’ would want to use a car to knock police officers over instead of the unidentified thugs who beat them????

Since an impartial investigation by police into a matter that involves their own image at stake is difficult – this is a case of conflict of interest -, I think you have every reason and justification to support the call from other quarters for an independent public inquiry into the violent events that night.

sad, very sad , if bee end says change it is a slective change, a change with conditions, with limitation of the ppl aspiration of change…no toll is one of these changes as i see it.

Boycotting the Grand Saga tollroad is indeed an option. Unlike the older tollroads, this tollroad is no longer under the minimum ridership guarantee of the federal government, which means that Grand Saga takes the risk of ridership numbers. An effective boycott over 12 months is enough to cause a default on their bonds.

  68. #68 by limkamput on Saturday, 31 May 2008 - 8:46 am

Godfather, not so simple, the federal govt may have to bail them out if the operator gets into “financial trouble”. Actually, I believe the operator of this toll road had already made all the money when they constructed the road.

Undergrad2, I did not try to conveniently leave anything out when responding to you. You know that this is not my style.

I don’t know – I don’t think my view is very much different from yours. I recognise racism is not going away and that is why I am appealing that politicians should make an effort to lessen it at least in areas where they can mutually agree like in this case (i.e. the toll road). There is nothing wrong or impractical to call for lessening of racism especially in our country where it is so institutionalised. The fact that there are racism still prevailing and very much alive in other countries older than us is beside the point. We must continue to harp on it so that those who want to resort to racism as an instrument to further their political career may be embarrassed to use it.

Bernadette, I don’t understand what is your point. If you care to elaborate, I will give you a response.

One has to start believing…before faithfully practicing anything..good or evil.
That starts…with evil minded racialists politicians….keep pounding and pounding the info into the minds…for years and years….and the belief ….becomes factual.
Then same theory…applies to religion too…that they are the one and only one…to save mankind and all those who embrace it.. will go to heaven …and others are Lucifer’s followers…bla bla bla.
Again..create the belief…and fanatics on religions are created.
But in this case….fanaticisms seems to stamped out from one…with a weak and guilty mind…that evil minded political and religious leaders are cashing in.

Jeffrey, can we sue police for making false charges? Almost every damn thing is attempted murder. Remember the Hindraf incident, it was also attempted murder. If so kiasi, don’t be a policeman or Fru, go selling pisang goreng.

Now the problem is we have to report abuse of police power to the police. This is real perverted logics which you lawyer should sort it out. We can talk so much about separation of power, the doctrine of natural justice – the right to be heard and the impartiality of adjudicating party, and yet each time there is an accusation of abuse of police power, we have to make the report to the police.

One more issue, Jeffrey, if the young man (driver of the car) really did something wrong, can the whole gang of well armed and well trained FRUs bashed him up like that? Can police retaliate when there is no more clear and present danger to the police personnel?

  78. #78 by limkamput on Saturday, 31 May 2008 - 11:18 am

That is why I have been campaigning – no toll within the Klang Valley Metropolitan area. I don’t care what would be the government’s argument. It is the responsibility of the government to provide roads as cities expand. If the government can’t afford, that government does not deserve to be there. We have paid enough taxes. Toll roads are sweet heart deals to enrich the well connected and their cronies. The government can afford to build those roads. There is no big deal – those big asses up there just have to travel less, abuse less, corrupt less, transfer less to good for nothing statutory bodies, GLCs, this tabung and that tabung. The money saved would be able to allow us to build twice the number of roads without imposing toll. This bloody toll thing within the city must go. It is nothing more than the rightist idea to suck the rakyat dry by this group of bloody parasite rent seekers.

It is not just Mahathir playing racial politics that we are concerned with. I think UMNO is now trying its level best to rejuvenate Malay supremacy to galvanise support among the Malays. Yet another hot potato lands on the Cabinet’s table for a decision. Why do these things keep going all the way up to Cabinet?

The Minister concerned and other relevant authorities should have the power and the ability to handle this “local” issue, and quickly too. Its not about a claim over some rocks in the sea that is claimed by two countries.

When you are Minister of this or that, then you are in charge of this or that. If Ministers neglect, avoid and do not use their powers, then they might not as well be Ministers but be just another “pen pusher”.

This “collective decision” thing merely diminishes their authority and responsibilities and delays taking decisive action. Its time for more efficiency and decisiveness.

Lets hope this issue and other similar issues are quickly settled, amicably, and not by brute force.

  89. #89 by undergrad2 on Saturday, 31 May 2008 - 7:30 pm

There is nothing wrong with the idea of having road tolls. They help to fund our highways and other infrastructure improvements. Revenues generated are meant to meet roadway projects costs. In the United States as you drive into New York City, there are a number of road tolls. But you don’t see street demonstrations against them. Pay-as-you-use is a more equitable and economically efficient than other roadway improvement funding options. The latter cause non-users to pay for improvements and are less equitable.

If we do not want to have to pay tolls then roads should not be privatized.

However, in Malaysia this method of funding our highways is popular for the wrong reasons. It is one more opportunity to corrupt politicians and their lackeys in business to line their pockets.

  90. #90 by Godfather on Saturday, 31 May 2008 - 8:26 pm

Of course it is an opportunity for politicians and their business cronies to line their pockets. So much so that in many cases, they grab the deals first, without any regard for their viability, and then abandon them or even sell them to unsuspecting buyers.

A classic example is the Putrajaya – KLIA highway. After almost ten years of “negotiations”, and umpteenth changes to the routing, the tollroad is now under construction. Of course we know that it is not viable, the government knows it is not viable, but the banks were pressured to underwrite the deal anyway. When it is completed, this highway will be sold at 50 pct of its cost, and guess who loses money ? Probably the EPF, or probably the government-linked banks. At the end of the day, it’s still the taxpayers’ money. The UMNO crony will have taken out his money through the construction contract.

  91. #91 by Godfather on Saturday, 31 May 2008 - 8:29 pm

I don’t really mind if the tollroad is a brand new road, with a new routing. Not like the LDP/Sprint, which is the widening of an existing non-tollroad. Or the deliberate attempts to stop maintaining non-tollroads in order to divert more traffic on to new tollroads. That’s cheating, and immoral. I guess these words are not in UMNO’s dictionary anymore.

  92. #92 by monsterball on Saturday, 31 May 2008 - 8:41 pm

But highway roads in USA and Europe are intelligently planned and users are willing to pay the high toll fees….feeling so safe to drive the freeways.
Even 35 years ago….European freeways..have one particular lane for buses and lorries. Here…they know how to charge alot….save every inch for the land…to make more money …by ways and means….such as…sold to oil companies..for petrol stations…make hundreds of millions…for advertising..and most such highway land are owned by government or Muslims.
Yes…opportunities to make corrupt money is more important than saving lives.,,by our govt.
Have we ever seen a lane…..solely for buses and lorries in Malaysia??
Send one to space….they know…to please youngsters….but never think of saving lives sincerely.
All their campaigns to save lives….means nothing…if they keep on playing golf…attending this and that world conferences…showing off….with new plane and yacht…and are just actors….with no real sincere work done for the country.

  95. #95 by limkamput on Saturday, 31 May 2008 - 9:36 pm

Godfather, if you want the modus operandi of privatization aka “piratization” in Malaysia, I can write you one. For you info, the banks are not pressured to lend the money at all. They would love to lend the money to privatised projects. You see, most of the loans taken by concessionaires were guaranteed by the government. That is why the element of cost padding is very real. What the concessionaires did was to make as much money as possible from the construction of the projects rather than from the operation of the projects. Once the projects are completed and if they found to be unviable (due to excessive cost which is actually profit they siphoned off), the government will have to bail them out because the loans are guaranteed by the government anyway.

If other countries have toll within the cities, let them be. In Malaysia, no toll within the cities, as a matter of policy, period. It is not like Undergrad2 only know there are tolls in NY. May be I was there earlier than him.

  96. #96 by Godfather on Saturday, 31 May 2008 - 9:51 pm

Limkamput, the earlier tollroad privatisations had backdoor guarantees e.g. the North South Expressway, the LDP, the Tuas secondlink, these had minimum ridership guarantees from the government, which meant that the lenders could never lose since the government always had to top up the shortfall.

Over the past 8 years or so, the government actually stopped the practice of providing backdoor guarantees, and the sponsors and lenders all had to take a view of ridership numbers.

  97. #97 by Godfather on Saturday, 31 May 2008 - 9:55 pm

In some other concession agreements, the government also had to agree that in the event of a default on the financings, the government was obligated to “step in” and assume the debt obligations of the defaulting concessionaires. This happened on the Tanjung Pelepas port privatisation, and also on the ERL privatisation.

All these forms of guarantees were developed during Mahathir’s tenure and were designed to “help” the BN cronies raise the financings with minimal fuss.

US privatised tollroads don’t have such backdoor guarantees as far as I know.

when a person who’s purported to uphold the law lies, he should be asked to resign or just kick out for being an ignoramus. Lately many people with Datuk to their names lie like there’s no tomorrow. Something is wrong with the process of awarding these titles…but since these titles are bestowed by the royal household there should be royal reprimands dished out to these jokers

Najib claimed in tonight’s Sin Chew Daily that the Federal Government ordered the barricade to be removed because the it cared for the people not because it bowed to pressure from the Opposition.

I find his comment utterly disgusting. Many BMC people know the road was blocked in October 2005 and for more than 2 years the residents there have been struggling to get the road open. Najib today has the guts to make the above comment. I wish to ask him why only now the Federal Government cares for the BMC people; why not way back in October 2005 or in 2006? Thick skin UMNO is quick to snatch credit from the Opposition!

    Unquote…

If it is baseless and they acted according to protocol please show us the PDRM protocol because RAKYAT want a new one done immediatly and backdate it to MArch 8 so we can bring these 20 FRU officers and the officer in charge to justice. Also, if Najib listen to rakyat show us you care by punishing all these STUPID comments make by your minister and PDRM officers. They could have say we will suspend these officers and reviews the evidence and punish them accordingly. But, no they have to defend their innocents and take rakyat as still stupid like four years ago.

Malaysia has one of the highest rate of road-tax. Since most of the roads are tolled, it should reduce or abolished the road-tax.
In the UK where the ‘B’ road is wider and better than our highway, there is not a single toll road.

“If other countries have toll within the cities, let them be. In Malaysia, no toll within the cities, as a matter of policy, period. It is not like Undergrad2 only know ….” limkamput

What is your verbal score on the SAT?

This is what I said earlier:

“In the United States as you drive into New York City, there are a number of road tolls.”

If you cannot see the difference in meaning between “no toll within the cities” and “as you drive into the city” your verbal score on the SAT must be very low.

“The police today maintained that there was no unnecessary excessive force used by the Federal Reserve Unit (FRU) personnel on a resident during a protest at Bandar Mahkota Cheras on Tuesday night…we are carrying out a thorough probe into the matter. But I would like to stress that the FRU personnel deployed on that day followed procedures”

Conclusion already made even by the highest authority in the investigation. So why are they saying “still investigating”?? Is this lip service?? Or just another way to waste more public $$ to conduct investigation??

  114. #114 by undergrad2 on Sunday, 1 June 2008 - 11:54 am

    bernadette,

The scores you give are only ‘average’. You need better than average scores to get into their colleges. You could still get into those ‘community colleges’ of dubious standards without an SAT score or poor SAT score. Many Malay students on scholarships end up in some of these ‘community colleges’ which explains their poor comprehension and verbal skills – a waste of tax payers’ money.

It is the result of a very good fight by the resident of BMC with the support from the PR Selangor State Government and PR MPs. The resident has exert their fundamental right to a just and fair society. It is not just commercial entities fighting for profit. It is more like day light robbery by the “Highway Concessionaire”, with its greed, to squeeze every extra sen from the poor, to enrich themselves.

It relented only when the MB of Selangor invoke the power of a major shareholder, which the Selangor Government is, in the Concessionaire, and threaten to restructure the Board of directors and Management team of the group; only then the concessionaire management relented, and sheepishly agreed not to put up the illegal barricade there again.

Then, when things seemed to be settled, only then followed by the Abdullah’s ministers, his deputy and his cabinet, when he saw himself and his government cornered with no outlet to escape, because the police was being impartial in this case and only present to ensure order but not to restrain the removal of the barricase by the resident over the last episode.

BN and its gang knew about the whole incident yet have the wait and see attitude. Very bad. Instead of showing the rakyat that they can do the right things, they just prove to us that what the so-called “rumours” are true.

As things keep on going the way they are, no doubt the coming election would be a good time to see the fall of the current Geng BN.

Hiaya, undergrad2, I was just joking only. Seriously SAT is not meant for me lah. Remember I studied in Attap University, so there was no SAT required. But if you want to compare GMAT, I don’t mind lah. You are famous for twisting and turning. If you read my posting carefully, you should know what I am referring to. I said Klang Valley metropolitan, not KL city. So similarly, you should know I implied the same when I am talking about NY, ok? Anyway don’t need to quarrel lah. I thought we are on more friendly term now. Seriously I enjoy your postings and also Jeffrey’s and Godfather’s. Got standard lah.

  120. #120 by undergrad2 on Sunday, 1 June 2008 - 7:45 pm

You did not say “Klang Valley metropolitan”. So let’s not mislead readers who may be reading this.

  121. #121 by limkamput on Sunday, 1 June 2008 - 8:55 pm

I did lah, so many times i mentioned that. If you read every of my post, (i believe you did), you should know. I always mentioned no toll within the Klang Valley metropolitan areas. After all there is no toll within the KL inner city. When was the last time you were here? Has Adam sent you the ticket yet. Anyway, you can afford.

I think PKR is too soft in tackling the issue. Hence, all the misfortunes. but better late than never. it also showed the true colors of DN. a crony based govt. Cant decide bcos their own interest involved. If BN were to have been on power for another few years, probably the shares owned by state govt. would be sold to cronies for a few ringgits or maybe state govt need to pay compensation huh … ? BN is too dirty and disapponting. PR PLEASE do better than BN.

    Salam Sejahtera,
Apabila dikatakan PAKATAN maka wujud beberapa parti politik bergabung. Tetapi dalam soal ini kenapa LKS hanya highlight DAP dan LKS, Macam mana dengan YB Ahli Parlimen Hulu Langat, MB Tan Sri Khalid, Dan Ahli Parlimen Pakatan Rakyat yang lain. Kena la mention sama. Nanti penyokong DAP kata wah DAP sahaja buat kerja, Ini semua atas usaha BERSAMA @ PAKATAN. Kalau tidak bubar pakatan DAP jaga diri sendiri.

  125. #125 by lew1328 on Sunday, 1 June 2008 - 11:15 pm

    Salam Sejahter, saudara Ridzwancherus..

    Terima Kasih.

We are the master; and the government (Prime Minister, Ministers, officers of government etc) are our servants.

It just does not make sense for our servants to tell us that we cannot question them or know what they are doing.

National security, that is understandable. But Highway concession contracts? Confidentiality clauses? What utter nonsense.

The government are accountable to us and are responsible for all their deeds and misdeeds.

We must know all about them. We must be informed.

Not only are they opaque in their ways, as if they are afraid that it was not enough, they decided to privatise some of their responsibilities and then mask them with confidentiality clauses.

The ploy: Yes I can am accountable and responsible. No. I cant tell you somethings.

Are we stupid? Such confidentiality clauses are clearly against public interest and policy. The laws of our land would strike such provisions out of the concession contracts. Our courts would not enforce them (some of us would doubt this in view of the Lingam clip issue).

So tell us. Just lay the contracts bare for all to see. Dont use the confidentiality clauses to avoid your responsibility.

  128. #128 by badak on Monday, 2 June 2008 - 2:30 pm

Firstly everyone in AG,s chambers must be sacked.WHY…Because all goverment contracts from HIGHWAYS to building of sports complex are one sided …The BN led goverment had been made to look stupid.

  129. #129 by Godfather on Monday, 2 June 2008 - 6:40 pm

    badak:

This one we can’t blame the AG’s Chambers. They acted only peripherally in the highway contracts. The agency responsible is the EPU, and they were “advised” by the JKR in terms of routing, and costings.

Hence Mahathir and Semi Value formed the best tag team in the history of Bolehland – a tag team for highway robbery, that is.

  130. #130 by Godfather on Monday, 2 June 2008 - 6:41 pm

And the BN government wasn’t “made” to look stupid. In most cases, they pretended to be stupid so that people won’t be watching while they siphoned off the money.
