10 more deserving RCIs

APRIL 4 — The Barisan Nasional (BN) is apparently seeking to file a parliamentary motion seeking a royal commission of inquiry (RCI) to investigate a sex video clip allegedly featuring Datuk Seri Anwar Ibrahim in a sexual tryst with a prostitute.

Perhaps because he is a lawmaker and also the parliamentary opposition leader. Then again, he is already facing his second sodomy charge in 12 years. So why not another trial.

However, if the ruling coalition is keen on holding RCIs to investigate a tape of a man having sex, perhaps it should consider setting up royal panels for the following issues:

1. Corruption involving ministers, senior government officials and other decision-makers

2. Leakage and other distortions in Malaysian policies and initiatives, including the New Economic Policy (NEP)

3. Racial polarisation and discrimination in Malaysia

4. Religious freedom and the rights of minorities to practise their religion

5. Petronas and an in-depth look at how money from the national oil company has been used through the decades

6. Decaying and hollowing out of institutions such as the police, judiciary and immigration

7. Illegal immigrants

8. Use and alleged abuse of the Internal Security Act (ISA) over the decades. It is also a good way to find out more about Operasi Lalang

9. Deaths in police custody

10. Political patronage and the loss of billions of ringgit to taxpayers

Then again, what use are the RCIs if the recommendations are not acted upon. Examples include the RCI on the Lingam video clip and the one on police management.

If anything, BN has been on a good wicket working on reforms and policies to transform the country’s economy. So why waste time investigating a sex tape of unknown origins brought to light by a trio with questionable motives.

The RCI on a sex tape is nothing but a distraction and a red herring to push the opposition into a corner ahead of possible snap polls this year.

Perhaps then, it is the right RCI to pursue. The 10 listed here would not be beneficial to the ruling coalition, would they?

    The suggested RCI is to establish the person who featured in the Carcosa sex video. After that what?

    Chua Soi Lek admitted that he was the actor but there is no action. Is the government going to establish the identity of the person in the Carcosa tape and takes no further action? If so, why waste the resources and if not why the double standards? Would the government take action against a person having sex outside his wedlock? If so, then there are thousands doing it right now. It would be selective persecution if only those caught in the tape are prosecuted, and again on what law? Are we saying that Malaysia has the legal resources to establish RCI just to prosecute an individual for sex act, and that same procedure would continue. If not why only conduct the RCI when an opposition party leader happens to look like the actor in the video? Thus RCI is recommended because the opposition leader will remain a suspect for as long as the RCI is not concluded. That is party politics through government resources. It only goes to show that laws in the country and resources are manipulated by UMNO to tie up resources of opposition political parties so that less of the governemnt wrongs get exposed. That itself is corrupt practice. It is a wonder that UMNO would not be shy to exhibit that UMNO government is a secret society in fact, though it is a member of the United Nations? UMNO knows no shame.

    The RCI should perhaps be established to investigate why the Home Ministry allowed the sex movie be made and shown at Carcosa with impunity.

    With that moustache…even easier to imitate.
    Can anyone imagine Anwar about to have sex needs a man to be around in his room…giving instructions?
    Mind you…with a prostitute.
    Presuming that is Anwar…what is so sinful to all those hypocrites?
    This is a sick country with a very sick Government indeed.
    I guess the guilty conscience have reached the extreme…with all their most rediculous accusations and performances.
    Smiling away…telling half truths..by Mamak in his 900 pages book..all the Devil’s men and women are encouraged to deny and accused…starting with Anwar.

    Whether the video is true or false, it doesn’t matter much at all.

    It is limited hurt few.

    The most matter to all Malaysians is CORRUPTED POLITICIANS.

    As they are corrupted with Malaysian tax money illegal deposit outside Malaysia

    The money they stolen from us are supposed for Malaysia have enough fund to have free highway without toll, free highway with 3 or 4 lanes in from Sabah to Sarawak, every old Malaysians entitle pension fund of average income to live a standard life, low car, good standard affordable home.

    Because of corrupted politicians stolen our rightful money belongs to all Malaysians, all these cannot afford to do so.

    Whether the video is true or false, it doesn’t matter much at all.

    The most matter to Malaysians is CORRUPTED POLITICIANS.

    CORRUPTED POLITICIANS are more serious criminals matter hurt to millions Malaysians they are stealing our rightful money from Malaysian treasure which belongs to all Malaysians.

    CORRUPTED POLITICIANS stealing our money are serious CRIMINALS hurt MILLIONS Malaysians to suffer loss of their rightful money

    CORRUPTED POLITICIANS they should be locked up in jail.

    How can Malaysia not going bankcrupt..under these crooked racists?
    They don’t care. They do as they like.

    To bring down Anwar BN needs a public platform to highlight episode. It can’t be a court room because enjoying prostitute’s service is not by itself a criminal offence. So they come out with the alternative of a “Royal Commission” idea (RCI). The key Question and their problem is whether by terms of the Commissions of Enquiry Act (under which the King on Govt’s advice invokes a RCI) a Commission can actually lawfully be invoked for such an enquiry. If not that’s the end of the matter!

    Under the founding Charter (Commissions of Enquiry Act) the RCI is commissioned only in specified cses of enquiring into:-
    (a) the conduct of any federal officer;
    (b) the conduct or management of any department of the
    public service of Malaysia;
    (c) the conduct or management of any public institution which
    is not solely maintained by State funds; or
    (d) any other matter in which an enquiry would, in the opinion
    of the Yang di-Pertuan Agong, be for the public welfare,
    not being—
    (i) a matter involving any question relating to the
    Islamic religion or the Malay custom; or
    (ii) in relation to Sabah or Sarawak, a matter specified
    in item 10 of the State List.

    The Question of whether Anwar was the one in the video engaging services of a prostitute or not does not fall under (a)(b) or (c) and must come under (d) “public welfare” for an RCI to b invoked. The point of contention here is whether it is “public welfare” for an RCI commissioned by His Majesty to enquire into whether an Opposition leader (or for that matter any politician) engaging a prsostitute’s service!

    It may be public interest but how is it public welfare? Earlier RCIs (on IPCMC) Lingam & TBH all involved conduct or misconduct of police judges MACC officers – they are federal officers or under Dept of public service – and certainly pertain to governance issue relating to public welfare. But a private of a person/politician for commercial sex (even if one thinks is immoral) – is that public welfare to enquire???

    The perception of the general public has caused the Gomen to get another RCI; it took them some a long while! Obviously, the plot has misfired as the average Malasyians are getting fed-up with what is happening in the country. In reality, this is only time buying, i.e. until the GE is over. I believe, the opposition should spend more time with those living in the rural area, your message in the urban area has been received loud and clear, though may I suggest : stop all the bickering among you all. I can sympathize with Khalid in Selangor where many of PR still think in the past. Take more positive actions for the good of tha State, the younger set are less forgiving and they want to see positive changes: FAST!

    If PDRM is independent, fair and neutral, that tambik and his friends would have been charged by now, not out on bail and still roaming free and posing a threat to under-age girls.

    Don’t get me wrong: I am not saying the sex video an whether Opposition leader was or not the man featured is not a matter of great public interest. It is. I am not also saying that people ought not judge or make their own judgment on the matter and form their own opinion of Anwar and whether to support him politically as leader. What I am questioning is whether the matter which is of public interest, comes under the meaning of “public welfare” within contemplation of Commissions of Enquiry Act for a Royal Commission to be invoked.

    Look at this Contrast – The Govt/AG took the earlier view that the death of Teoh Beng Hock in MACC precincts should be enquired via Inquest and not the Royal Commission because TBH’s death under such circumstances was not under purview of RCI. This is contentious because MACC procedures of interrogation of TBH – and whether there are more than 2 officers surfing pornography – certainly come under conduct or misconduct of Federal Officer or management of Federal department/service within meaning of (a) and (b). The Govt took a narrow definition of “public welfare” and implied that it was not public welfare to enquire TBH’s death for RCI to be invoked. Would it not be strange to now say enquiry of whether a politician (not a Federal officer) took, in private, the service of a prostitute is now a matter of public welfare for RCI to be invoked but not so for TBH’s death???

    Got this latest in my mail box :

    “The man in the Tape is not Anwar… that much is sure.. but he looks very similar..
    – This sex video was actually in Barisan’s potential weapons to be used in 13th General Elections..
    – But what made them dust it off in a hurry and use it now… its got to do with Sarawak state elections..
    – BN’s internal polling revealed that BN will be losing far too many seats if the state elections due to anger towards Taib Mahmud..
    – BN’s internal polling shows that Taib’s party PBB itself is projected to lose about 50% of its seats.. and SUPP will lose all its seats etc..
    – They figured BN will still win.. but with a much reduced majority… lose is 2/3 majority and even just win by around 55-60% majority
    – BN needs to win S’wak big time in order to keep as many Parliament seats in 13th GE..
    – So Najib and Muhyiddin both went to see Taib in Sarawak about 2 weeks ago.. never have the PM and deputy PM gone to visit a state together…
    – They went to pressure Taib to resign.. and appoint a caretaker CM before state elections.. hoping with Taib leaving .. people will be less angry and they can still win handsomely
    – Taib.. it seems assured them he will consider it seriously…. but…. Taib threw a shocker
    – He sent off Najib and Muhyiddin at the airport.. . as soon as the plane took off.. Taib called for a press conference in the airport itself
    – He announced that he will dissolve the state assembly next week.. and will remain as CM.. and will retire after the elections after a transition period to enable the new CM to get up to speed..
    – Najib and Muhyiddin got the shocking news.. after they landed in KLIA.. Taib just “showed them the finger”..
    – Since the state assembly dissolution is announced.. nothing can be done.. and since Pakatan is getting stronger by the day in S’wak. Something needs to be done..
    – They had to dust off Anwar’s purported sex tape and destroy PKR’s credibility hoping that people will be wary of opposition..
    – In a hurry.. talk about dumb asses trying to frame people without goofing up…
    – The rooms that was used to screen the tape to reporters at Carcosa was booked… of all people.. by Risda.. a federal govt agency…
    – Risda’s chairman is Rahim Thamby Chick.. the guy who raped an underaged girl..
    – And the Datuk is also strongly linked to UMNO…
    – Then they tried to lure PKR MPs to jump ship by showing them the video and of course monetary rewards…
    – The room in Carcosa was actually booked by Ketua Umno Bhg Bukit Gantang, who is also special officer to Tan Sri Rahim Thamby Chik. Paid for it by credit card and worse of all.. he asked for a corporate discount by using his Risda’s corporate account.. this is going to back fire on them massively… “

    The sex clip thingy was supposed to throw the opposition into disarray during the sarawak election, and to distract anwar further. Of course it failed to produce that desired effect. Instead, umno people picked it up and went into a daily public orgy over the clip. Ku Li observed quite rightly, “No one believes it.” and I would add this: “except umno people.” So it seems to me, the distraction is actually taking place inside umno’s camp and not pakatan’s.

    Now he is dreaming of the good old days mixed up in his fantasy.
    He is no doubt an old man like me.
    Ruby is more prettier and sexier than Rose Chan…but Rose Chan have a better brain to capture audience imaginations.
    Remember…Rose Chan is the only one with a song “Rose Rose I love you” sung by Frankie Laine and promoted Penang to be visited by more tourists.
    Actually Rose Chan should be decorated to bring Malaysia to the spotlight of European countries.
