Rais should lead the charge in Cabinet to demand dropping of Anwar’s Sodomy II charge


The 2008 Olympics opens in Beijing today but for Malaysia, we are obsessed with scaling a new Olympian height of national trauma and international infamy – the strangulation of what is left of the rule of law in Malaysia after two decades of judicial darkness in the continued political persecution of Anwar Ibrahim in the Sodomy II prosecution.

Thanks to this special Malaysian official obsession with sodomy, Malaysia was big news in seven continents when Anwar Ibrahim was charged under Section 377B of the Penal Code for sodomising his 23-year-old male aide, Mohd Saiful Bukhari Azlan.

Furthermore, Anwar’s Sodomy II trial and tribulation will be kept alive in the international stage because of the disgraceful, dishonourable and ignoble circumstances and motivation of the prosecution to the extent that the Foreign Minister, Datuk Seri Dr. Rais Yatim has made a most unusual and extraordinary decision to organize a series of information sessions by the Foreign Ministry overseas on Anwar’s Sodomy II “to give a true picture so there will be no misconceptions that can hurt Malaysia’s image”.

What is this “true picture” that Rais is going to tell the world in a series of information sessions overseas?

Will this be the same “true picture” that the Information Ministry will be telling Malaysians in the country, and particularly during the Permatang Pauh by-election from August 16-26?

Will this “true picture” include the following:

1. That the Cabinet had usurped the constitutional powers of the Attorney-General’s Chambers on its sole prosecution discretionary powers?

When Home Minister, Datuk Seri Syed Hamid Albar said yesterday that Saiful is not being charged because he is the complainant and the key witness in the sodomy case against Anwar, he has arrogated to himself the role and sole discretionary power of Attorney-General under Article 145(3) “to institute, conduct or discontinue any proceedings for an offence”.

It was also an admission that the Home Minister had been involved if not usurped the Attorney-General in the decision-making process resulting in the Sodomy II prosecution of Anwar – which is clearly an unlawful and unconstitutional usurpation of the powers of the Attorney-General!

The question is who else in the Cabinet had been involved in the decision on Anwar’s Sodomy II prosecution? The Prime Minister Datuk Seri Abdullah Ahmad Badawi and the Deputy Prime Minister, Datuk Seri Najib Razak?

2. That Saiful had sought “justice” (to use the word used repeatedly by the Prime Minister) as a victim of sodomy rape by Anwar but in the charge yesterday, Anwar was accused of consensual sodomy under Section 377B instead of Section 377C (sodomy rape) under the Penal Code?

Only on Wednesday, Abdullah said:


“Another person looking for justice is the victim. You seem to forget Saiful. You think Anwar is more important.

“This is an issue of law. Somebody feels that he needs justice and he makes a report to the police. And the police, therefore, have a duty to conduct investigations, to question him, to invite others to assist in the investigations.

“If there is nothing, no evidence whatsoever, drop the charge. Drop the whole thing, the investigation. Don’t do it. If there is evidence to charge, they have to charge. You can’t stop them from doing that. They have to think of Saiful.”

Clearly, the police have found that there is no evidence to support Saiful’s allegation that he is the “victim” who is entitled to “justice” and “police protection”.

Was the police “thinking” of Saiful to accord him “justice” when it decided to charge Anwar for consensual sodomy under Section 377B?

Would Saiful be charged with lodging a false report of sodomy rape?

Abdullah had said that he had been informed by Hamid “about the police decision to charge Anwar” (NST 7.8.08) - an involuntary and unconscious admission that the decision to charge Anwar was that of the police rather than that of the Attorney-General’s Chambers.

Another travesty of justice and the rule of law when the Constitution and the law are very clear – that the police has no business to decide on prosecutions as they merely conduct criminal investigations while the Attorney-General decides on whether to prosecute!

3. That Pusrawi Hospital doctor, Dr Mohamed Osman Abdul Hamid, who examined Saiful just hours before he lodged a police report of sodomy against Anwar on June 28 stood by his findings in a statutory declaration that there was no evidence of sodomy?

And Malaysia’s system of justice has been reduced to a flurry of statutory declarations with those making them being forced to flee abroad for the safety of themselves and their family, including the case of private investigator Bala Subramaniam over his two Statutory Declarations within 24 hours completely contradicting each other with explosive revelations involving the Deputy Prime Minister in the murder of Mongolian Altantunya Shaariibuu?

Instead of launching an international campaign to defend the indefensible, Rais should remember his trenchant, valid and legitimate criticisms of gross abuses of executive power in his book “Freedom under Executive Power”, pluck up courage at the next Cabinet meeting to demand the dropping of the Sodomy II charge and further persecution of Anwar for the sake of the good name and international reputation of the country.

If Rais dare to stand up and sound the alarm in the Cabinet, there may be other Ministers – from Umno, MCA, MIC and other BN component parties? – who might also find sufficient courage to speak up against the continued assaults of the integrity of the system of justice and national institutions in Malaysia after the March 8 “political tsunami”!

    I know it is not a question of law but of fact, but could be a question of mixed law and fact: can dykes have anal intercourse with each other?

    The Bar Council’s forum scheduled for tomorrow will proceed. The concerns of some quarters including a number of cabinet ministers such as the DPM, Dato’ Seri Najib Razak, Dato’ Hamid Albar and Dato’ Zahid Hamidi, various NGOs and Pas are noted.

    We reiterate that our concern is to address the issues of conflicts of laws facing families caught between the separate jurisdictions of civil and Syariah laws.

    The Bar Council is not questioning the provisions of Article 121 (1A), which confer Syariah jurisdiction over Muslims on the Syariah Courts.

    The co-existence of two separate legal jurisdictions is not a new or uncommon phenomenon and there are naturally issues of conflicts of laws arising from the different jurisdictions.

However, the Bar Council is troubled by the continuing calls from certain quarters that its forum tomorrow be cancelled.

    These statements that claim the forum will create misunderstanding, anger and tension, are in stark contrast with the PM’s assurances.”

    Going by what had been said about such fora, that it would create tensions, real or perceived, is not acceptable in this age and time.

    What if we look back in time when religious teachings were brought to our shores way back in the early part of 1800′s. Surely then the people would have been apprehensive and doubtful about them. But because of their receptiveness, the people did discuss about them. Else how would one learnt about Christianity, Buddhism or Islam, and embraced the religions and became Buddhists, Christians or Muslims?

    Now, if people of yore could discuss about religions, why not the people now? We have the benefit of more up-to-date information and hindsight to help us discern deeper and better, than to fear discussions which may help clarify issues which are of concern to our society.

    Those who oppose for the sake of opposing have reasons or motives known only to themselves. And it is not justified. Religions should not be a monopoly of or confined to just a particular ethnic group, let alone being manipulated by interest groups or being politicised.

    People who are God fearing should know that a religion does not belong to them alone. It is God’s message and teachings for all humanity. So, don’t treat religion as a possession or commodity which would be used to position oneself in matters social, political, and economic. It is just not moral.

    Even our PM had a lot to say about Dr.M once when he aligned himself with TR and MH. Najib had split personality then when he just sat on the fence and waited before throwing in his lot with Team A. Lots of examples in Malaysia e.g. Ezam, Chandra Muzaffar, Lee Lam Thye, TR, Wee Choo Keong, Ibrahim Ali, that Kinabatangan guy, Pairin and his brother etc.

    In Mugabeland, we often cannot comment on court cases because it would be “sub judice” as there is a court case on. The “embarassed party” would often get a court order for this.

    However, we have a Home Minister and an Information Ministry which are striving very hard to tell everyone the “true picture”, the government’s picture.

    And we have a Foreign Minister who wants to on a world tour to tell the world this “correct picture”.

    And they are all lawyers.

    What has happen to “sub judice” now?

    And as for the fellow who is striving for a just and fair world, well he only emerges when it suits him. He’s been striving hard to get noticed by somebody, anybody, as he’s been passed by.

What is the point of doing all the explanations to the world while all you can do is by merely restoring the integrity of our justice system? Drop DSAI’s case right now to regain the already little-to-none dignity in these BN goons.

    And may I also suggest to LGE that since SPR announced the voting Permatang Pauh’s by-election date on the 26th of August, which is a Tuesday, and since they are not playing according to the rules, you shall also break all rules and declare the said date as a public holiday for Penang folks to convenient the PP’s voters to cast their precious votes. Just a suggestion though.

    377B.

    Whoever voluntarily commits carnal intercourse against the order of nature shall be punished with imprisonment ….”

    Undergrad2 has cited at 02:29.05 above section 377A (definition of what constitutes “carnal intercourse against order of nature”), 377B (covering where such an act is voluntary) and 377C (covering where such an act is forced upon someone). These are very misunderstood provisions.

    First they are very “sexist” provisions against only men. “Dykes” (a disparaging term for lesbians) are not capable of “carnal intercourse against order of nature”. Why? Because 377A defines the wrongful act of “carnal intercourse against order of nature” as being “sexual connection with another person by the introduction of the penis into the anus or mouth” and only men have, women including dykes don’t have penis……

    Second, these provisions have no sole application to homosexual men. The wrongful act of introduction of the penis into the anus may be engaged heterosexually betwen a man and a woman! It also means that a woman partner can be active voluntary participant and encourages the man to do it but it is only the man who is giver and doer with his instrument who is punishable for the offence – not the woman or for that matter any “receiver” of that penis, whether man or woman.

    So strictly speaking what Hamid says is right : the one who engages in anal & oral sex as “giver” and doer in consensual situation (377B) commits the offence, but the other voluntary partner being done to as “receiver” commits no offence!
    So the active giver and doer is the only one committing offence where it is consensual (377B) and more so if it were by force (377C)! Saiful cannot be charged because based on allegations he is being penetrated or not penetrator!

    As these provisions cover introduction of only the penis into the anus or mouth, they exclude introduction of plastic dildo, finger wood, tonque or other objects, therefore only fellatio is punishable not cunnilingus (therefore excluding lesbians)! Necessarily introduction of penis into any orifice (ear) other than anus or mouth is also not an offence! Also excluded sex with animals (bestiality) covered in other provisions of Penal Code….

    All considered 377A, B and C are archaic, nonsensical, sexist provisions that should be repealed than enforced. Where they are enforced, it is often selective and engendering blackmail by the complainant.

    Good morning to all, Opening of Olympic was great. Wonder if Malaysia boleh? What do you think?
    Anyway, just got 2 topics to touch on today.
    1. True picture from Rias? Ever heard the word tranparent? Well you gotta imagine in an interrogation room. Depending which side you’re on, it’s amazing how this one way mirror thing work. Obviously Rias trying to be as truthful as possible, the only problem is, he forgot his on the interrogator side. To him, he only sees what others don’t. The rakyat is being interrogated? Emm
    2. ‘Back-door’ about DSAI, comment by Dr Chandra Muzaffar?
    Chandra (Indian?) Muzafarr (Muslim?) Correct me pls. Is this name front or back door to Islam?
    Dr Chandra’s, no doubt is knowlegeble and most time are correct in his views and observation.With due respect, sometimes he can also be wrong, right? His entire comment regarding Back-door and Anwar is most intersting and “Well Said” (although not all are correct) BUT may not be “Well-Motivated” – one must question his true motives for saying it.
    Why now? Timing is everything?
    Here we are, trying to move ahead despite being subjugated by cruelty from PR’s Opposition, here comes a smart aleck telling DSAI the ‘IDEAL’ manner to form Government. Like most ‘Critic’ sitting on the bench, or ‘political Scienctist’ – Living in Jupiter, its easier to just give Ideals and comments. There are many of his view-points that can be wrong this time.
    Anyway, the bottom line is: Dr Chandra’s view, Anwar was impatient and he is amazed how PR can form New Government withing this short period since March election. So, its not right, its called Back-door? The truth is, giving today’s situation – Its the ONLY door left! Consider Dammm lucky mate, at this rate the Goment is plotting, one do not need to go through windows or lobangs but then again, you can tell also, right?
    Yes, Anwar was impatient but then again, that was in 1998, say – that’s 10 long Yrs!! THINGS MOVED BRO So, how long more, one has to wait to qualify ” Just Right”?
    Know what? DSAI knew perfectly what price he’s paying to become PM. The truth is, he paid and sacrifies much more and above all, he stood by his dreams!
    What about Dr Chandra? He do not have what it takes to become a politician, thats why I won’t blame him to become a ‘Political Scientist’ – big word eh? Bottom line here. If there’s nothing good to say about the coming New Government, then shut up! Meanwhile save all comments to himself and wait for his turn, Korrect?
    It is paramount now that whatever we read, ask these questions. Is it helping or is it delaying or diversifying the formation of New Government? All the same, we need to be open minded for constructive criticism but not to be so open minded until the brain also drop out, ya? Cheers!!!!!

    When Rais Yatim met Condoleeza Rice, as he was explaining things to her, you could tell Rice face as saying what a freaking waste of time! I have nuclear war in Iran and bloody Koreans to deal with besides a million other things and this joker is wasting MY TIME!!!!

    Rias is a nobody….never contribute to anything…just talk talk talk.
    I dare him to arrange a talk show..in USA and explain.
    The audience will treat him……..as the comedian of the year…or a real UMNO hypocrite.
    I was watching the Olympic Show and was thinking…..30 years ago..we were more advanced than China. Now look…where are we.
    Surely Rafidah…..Mahathir and Najib….can see the vast differences. Why? Is it Malaysians are so stupid…..can never do what the Chinese can do? Are we that lazy……or the other way round…UMNO is lazy?
