Police Black Eyes
Anwar Ibrahim has been released on police bail this morning.
Yesterday, the Prime Minister Abdullah Ahmad Badawi promised that there will not be another “black eye” trauma for Anwar as happened ten years ago.
However, the police has received a “black eye” of its own making, in its highly-provocative, unprofessional and unjustifiable arrest of Anwar by police commandos in balaclava at 12.55 pm yesterday – when the former deputy prime minister had already promised to report to the police at 2 pm.
This is the second self-administered police black-eye within a week – the other being the completely unjustified three-day 1,600-personnel police operation to lock down the Federal Capital and the Klang Valley to thwart a massive demonstration in Parliament on Monday when there was not a single protestor - causing great and unnecessary inconvenience and hardships to hundreds of thousands of people, plunging public confidence in the efficiency, competence and professionalism of the police to an all-time low.
The two self-administered “police black-eyes” in the past week raises the question whether the Royal Police Commission set up in the early months of the Abdullah premiership and which made 125 recommendations to create an efficient, incorruptible, professional world-class police service – with its most important recommendation for an Independent Police Complaints and Misconduct Commission (IPCMC) – has turned out to be a total waste of time, resources and funds!

Yes, I do agree with seaturtle. We should concentrate on strengthening the governance and unity of PKR rather than trying to take over the government from BN in September which looks like quite impossible. PKR has not yet to convinced or prove to the Malaysian rakyat that they can formidably form an alternative government but instead they are still pointing fingers at BN and talking about “jump the ship” which is actually becoming very irritating. What has happend to all your promises made before the March 08 elections? Prove your capability first and the next government will be yours naturally. And DSAI please be humble and see to the rakyat’s needs first. As Jesus Christ said a leader has to serve rather than be served. That’s why he washed the feet of his apostles before he gave up his life for us on the Cross. That’s a leader to be admired. Even the great Mahatma Ghandi served his people to the end. In CNN he was prevaricating and not answering the tv journalist/host’s questions, especially, why the hasty arrest of Anwar before 2pm. When asked if the govt is worried about the impending backlash, Hamid said a straight no, because it is not anything political and the tv host evinced disbelief with the answer given. The only hinge of hope, however flimsy, is on the independence of ACA.
ACA had scored a major point last week with the arrest of the Immigration Director and his Deputy. Would ACA remained subservience to the IGP, the AG and their political masters? We know the desperation of that three institutions; a factor that we can connect directly to Monday traffic jam, the arrest of Dato’ Anwar and lately the arrest of Raja Petra.
Before the 8th March tsunami, I used to comment that the BN was in defensive over their administrative records.
Now that know the majority votes had been against them, they are desperately holding on, and using government machineries to prop this very unpopular regime. I am not surprised of the latest actions from the government, but I believe this is just the beginning. The people are tired of lies yet the administration is desperate to hold on; a sure sign that clashes would continue.
We had hoped for the King to step in. But no, not likely. Now it’s left for the independence of the ACA. Somebody need to be arrested and he is not Anwar.

The police will undoubtedly be able to get a court order compelling DSAI to provide a DNA sample (blood). There is no reason to believe that “evidence” will then not “materialize” consisting of blood stains etc. If possible DSAI should take measures so that any sample of blood taken will be with an identified “trace” that allows it to be proven to be from the sample taken as DNA sample. I know it all sounds like something out of CSI, but we are dealing with hardened criminals here and must be ready to be one step ahead of them.

The government’s major task is to convince the public that investigation, prosecution and trial of Anwar is professional and fair. This is uphill all the way because the Court of Public Opinion has already passed the verdict of ‘guilty’ on the government no matter how professional or fair it seeks to be. Not only the police has received “black eyes” but the whole criminal justice system beginning from police investigation, prosecutorial discretion and impartiality of trial! So how? Even if the government now allows foreign experts to extract DNA/blood sample from Anwar, procures investigation of the case by the FBI, gets the attorney general of US to prosecute and the Supreme Court of US to try Anwar – even were all these processes possible – people will say the government has exercised undue influence on all these foreigners to fix Anwar!
The prosecution on grounds of sodomy is seen by many as politically motivated, and it is different to change that perception and bias of the public. No one else, who is not criminal, has yet been charged for sodomy. All Malaysian and Singapore cases involving a prosecution of unnatural sex whether oral or anal also involve other criminal acts of battery, assault, robbery, rape or having sex with minor (stautory rape). No gay homosexual, lesbian, bisexual, travestite (“pondan”) estimated to form anything from 10 to 15% of the general population, who has otherwise perpetrated grame crimes as stated above, has ever been prosecuted….
Sodomy is a law that is a colonial relic, almost never invoked except to aggravate the prosecution and punishment of a criminal. Otherwise prosecutorial discretion is always to look another way or to leave the matter to religious officers to do the necesary whether counselling or punishment. As Tun Dr Mahathir said, “there are certain habits which are not easy to be rid off. Habitual smokers will tell you that. So will drug addicts”, and this (especially when it is consensual) is tacitly acknowledged and dealt with by turning a blind eye unless in extreme cases of collateral harm to the victim.
So when sodomy is turned against a political icon like Anwar who is otherwise never accused of any other crime then regardless of whether he really has this occasional queer habit or is baselessly accused of it, the public and people will always give him the benefit of the doubt because deep inside there is already a irrefutable perception that it is a political prosecution. The simple fact is non other, who is not otherwise suspected of criminal acts inflicting harm on victim, has ever been prosecuted.
And a political prosecution, even if proceeding on the most solid ground of fact and evidence, will never be accepted when large sections of the rakyat have already given up hopes on BN to bring change for the better in the country and pined their collective hopes and aspirations on Anwar to bring such change, whether or not these hopes are corectly placed or misplaced. This is the main challenge facing the government in trying to grapple with the problem of changing public perception to dymystify the persona of Anwar. It faces a Court of Public Opinion that repeatedly delivers judgment of guilt against the accusers (government) as if truth be told many are not even bothered at the veracity of the accusations against Anwar, whether well founded or not, for what they are more concerned with is that the change of govt and reform agenda is not derailed at any costs.
It is through Anwar that public hope of a better life and country finds expression and by reason of this Anwar could for now leverage extensively on this aset of a vast reservoir of public goodwill and sympathy to face his accusers.

Unnatural sex is difficult to prove. Section 377(A) deals with unnatural sex between conssensul parties. How to prove that? Which homosexual partner would snitch on the other when disclosure would bring equal shame and social ostracision (in this conservative and hypocritical society) to one ownself? The only way to prosecute is to force an unwilling participant to give evidence against the other partner which is difficult because you have to use trickery and coercion to extract the confession, which by reason of the trickery and coercion would render his evidence inadmissible in court.
The only way is to prosecute under Section 377(C) which is rape by sodomy. Here one has to prove not only taht sodomy occurred but also that it was forced onto the unwilling participant. How does one prove the second part of “force” in one-one situation, short of a hidden camera or presence of witnesses? Especially in a case where 90% of the public already favour the accused against the accuser???
If one cannot prove beyond reasonable doubt the second element, then in spite of evidence of the first, the whole charge of rape by anal sex will have to be dismissed.
So what is the point of the whole prosecution?
Is it to just to have it on trial record that the accused engaged in homsosexual activities never mind that he canot be held accountable for any crime because force and rape was not proven?
If that were the modest objective, forget it lah becauser you have already the 2004 Federal Court Judgment acquitting Anwar for sodomising driver Azizan. There the Federal Court judges by majority already expressed the opinion that whilst they ‘believed’ Anwar engaged in such activities (here “belief” is not same as proven) yet their belief was irrelevant to the fact that the specific charge relating to Azizan being sodomised was not proven beyond reasonable doubt (as Azizan’s testimony was not corroborated by other independent facts), and for that reason acquittal must be given to the benefit of Anwar.

The 2004 Federal judgment was a joke as well, because the judges said that by acquitting Anwar, it did not mean that Anwar did not indulge in homosexual acts. It was akin to acquiting a person charged with murder to say that although the accused was acquitted, it did not mean that he did not commit murder elsewhere.

I think we are all very selfish asking DSAI to do this and LKS to do that. Let us be fair, both of them are not supermen and there are only that much they can do as an individual. I want to pose a question to Uncle Lim and everyone in the blog.
1. What is the function of the press in Malaysia, like The Star, NST and so on?
2. Are the Chief Editors of the major newspaper in Malaysia appointed by Government officials?
3. Why is it after more than 50 years of independence ( so called independence), we are still chained fro voicing out in the press. There are many people voicing out in the blogs, but the majority of the people in the country does not read blogs or internet users.
4. What has been the result of voicing out this concern in the Parlimen. I’m sure it was voiced out before, but why didn’t the opposition take up this matter seriously.
When our press gains independence of publishing the real issues, only then, only then I feel that we have gained real independence. Until then, remain chained and be a slave to the Ketuanan Melayu.
