The police should stop harassing and intimidating donors of Hindraf on the spurious ground that they are funding a terrorist organization.
Malaysiakini reported two days ago that the police are summoning donors of Hindraf “over a possible offence of funding a terrorist organization”, grounding their investigations under Section 130N of the Penal Code on the “funding of terrorist activities”.
The penalty for the offence are death (if the terrorist act results in death), imprisonment for a term of not less than seven years but not exceeding 30 years and a fine.
This is most absurd, especially as the MIC President and sole Indian Cabinet Minister for over 28 years, Datuk Seri S. Samy Vellu had admitted in his recent visit to Tamil Nadu that the Malaysian government did not have any evidence that Hindraf had connection with Tamil Tigers or terrorists.
This is the Q & A on the NDTVG.com where Samy Vellu admitted that there is no evidence that Hindraf has terrorist links:
“NDTV: Do you have any evidence to back your government’s charge that the Hindraf has links with terrorists?
“D S Vellu: Hindraf said they would fight like the Tigers, the way the Tigers are fighting in Sri Lanka. It was by Vedamurthy. After he talked like that, we did an investigation and it was felt that he may have gone there for training.
“NDTV: Do you have evidence of this?
“D S Vellu: No. It is our suspicion.”
In view of Samy Vellu’s admission that there is no evidence that Hindraf has any terrorist links, two steps must be taken immediately:
• DROP all police harassment and intimidation of Hindraf donors on the spurious grounds of funding a terrorist organization or this will be a most blatant and flagrant abuse of police powers to use the “terrorist” provisions in the Penal Code to create police “terror” of their own; and
• IMMEDIATE and unconditional release of the Hindraf Five, P. Uthayakumar, V. Ganabatirau, M. Manoharan, R. Kenghadharan and T. Vasantha Kumar now that they have been officially cleared of any terrorist links – even without having to wait for the Advisory Board hearings over their appeal against the ISA detention fixed on Monday.

DAP should consider nominating Manohagran, one of the 5 HINDRAF ISA detainees, as DAP candidate to contest the coming General Elections for the following reasons.
1. He can be considered a symbol for all ISA detainees who should be charged in open court or be realeased. Voters be given an opportunity to voice their disapproval of the BN Government’s unfair action.
2. He can be considered a symbol representing the aspiration of all Malaysian who believe in Democracy and fair play irrespective of race.
3. He can be nominated to contest the same constituency which he contest previously as a DAP candidate or he can be nominated to contest Sg. Siput against Samy Velu, who need to defend his 28 years of poor leadership of Malaysian Indians in BN as their sole representative in the Government.
4. DAP did in the past had 2 MPs elected while under ISA detention. It is possible to repeat the distinction again with the awakening of Malaysian Indian voters against their marginalization by BN Government.
5. Malaysian in general are likely to vote for more opposition MPs this time to reduce the BN’s 2/3rd majority. Cooperation between DAP and PKR to have one to one contest will enhance opposition chances this time.

Samy Vellu says there is no evidence but only suspicion.
But hey! Evidence is what you look at during trial and not before. True some evidence would have to be shown at the preliminary hearing stage when the prosecutor would have to make his prima facie case against those accused. Failing which the case would be thrown out of court!
But then under ISA the government is not required to make a case against those detained. Instead those detained would have to show that the government has no case. How on earth are they going to do that if they do not know what the government’s case against them is?

The hindraf protests were mainly by the underprivileged tamilian hindus who came into M`sia under the `kangani` indentured labor system.
In this context it also has to remembered that Pandithan took the lower caste hindus out of the MIC when he formed the IPF. His mistake was to continue to stick with the BN.

We are inclined to believe that these Hindraf leaders who are in dentention have no links to the LTTE. That their unjust detention was based on a report that they ostensibly have links to the Tigers because one of the leaders reportedly said: they would fight like the Tigers for their course.
We feel the way our Police have handled this Hindraf matter have really brought great shame and, undone the high esteem it’s Special Branch commanded among the rakyat of this country, and governments around the world. As we all know, our SB was considered (hope it’s still is and we want to believe it’s so) the best in this region. It was because of their top-class effeciency that we were able to defeat the communist. They knew the latter, inside out, regarding their organisation right; down to their smallest cell, their strength, their movements, their modus operandi etc..etc.
It is therefore beyond our belief that our SB (the best in this region) would not have obtained any intelligence, from day 1, to the formation of Hindraf and its link to a terrorist organisation, whereas, they were able to track, trace and do survelliance on KMM and nip them in the bud. Why did they let them (Hindraf) grow and multiply until they were able to muster such force (as in the 30,000 demonstrators)? If they were terrorist-linked such big demonstration would have been followed with co-ordinated violence like arm insurrection, suicide bombing etc.
In short, the Home Ministry and police ( we believe its more of the Home Ministry) trumped up the charges on Hindraf leaders based not on credible intelligence but more on political persuasion of the government. The PDRM have been made use of by the politicians.

Without any doubt, the Hindraf Rally is one of the milestones in the history of ethnic relations in Malaysia. As many have witnessed and aptly described, it has liberated the minds of many Indian Malaysians, which for 50 years have given the most loyal support to the UMNO-led coalition.
I doubt the arrest of its five leaders under ISA will kill the movement. It certainly has not killed the spirit of countless Hindraf supporters out there.
In fact, BN may soon regret the arrest of Hindraf 5. By depriving their ethnic leaders, it has paved way for the angry Indian grass-roots to seek political expressions beyond their ethnic boundary.

When the British created the ISA, its not that they ignored the issue of check and balance. The truth is they made the ISA a prerogative of the PM so that only the PM is accountable for it. In other words, if people are unhappy with it, they have to take it to the PM, the only way is by demonstration. Our constitution guarantee the right of free assembly which is what the British thought would be its ultimate check not the electoral box which is indirect.
Our failure to take this issue to the street is a reflection of our apathy over the issue. This issue is not going to be settled via the electoral box. Its going to be settled in the streets one way or other.

Of course the 5 Hindraf detained have no connection with the Tamil Tigers. Samy knows the truth that he and the MIC have been cowards. They cannot put up with Indian sentiments and realisation spurred by Hindraf that they have generally been marginalised, which is the truth.
